I think you are right - as soon as they see I140 revocation they are doing the easiest thing, that is to reject underlying I485. They can easily check the 180 days period; alternately they can actually issue NoticeOfIntenttoDeny (NOID) and give a chance to the candidate why I485 should not be rejected - this is also equally easy for them to do (just send a letter and give a 45 day or something similar time). I think they are simply rejecting so it reduces the total pending I485 cases. It might be possible for us to open MTR and resolve this but if working on EAD we will be in soup and also MTR's typically take longer to get resolved.
I guess this discussion is going on in a different direction.. "AC21 is the focus here" while we are at it, I want to ask if someone has seen a denial, just because someone used AC21 and the I-140 was not revoked.

btw why is everyone presuming that the 60,000 approvals went to India and China? EB3 ROW is retrogressed- all the extra numbers could have gone there. that would in any case be all the better for india/china in the longer term- the faster that backlog is finished, the greater the chance india/china lines will show meaningful movement.
also did you notice the cantwell-kyl compromise amendment in the failed CIR 2007 had a provision for 485 filing w/o visa numbers current?

Because I do not remember which address I used on the visa application, and how I translated my employer's name in home country. In China, at least those days, everyone had a residence record showing your address. We had ours at my in-law's address, while living in a new development. We might used one of those two addresses. Same thing with company names, merging, name changing etc was common.
According to Crystal and Milind70, I am a bit relieved as my visa application was a long time ago. So I may not need to worry about it. Thanks everyone.

This letter is utter nonsense. Admins, Moderators...pls stop this nuisance as this will cause internal fighting and end up in nobody receiving any benefits in the near future. If USCIS responds +vely to that letter, then do u think EB2s will keep quiet??? This will cause chaos and thus nobody will get anything out of it. Why is this thread still alive. Pani, the starter of this thread shud be banned for initiating this effort. Shud anything -ve happen to EB2s as an outcome of this, I'm gonna hunt that fellow and sue him for ruining my life.

There has been no definitive guidance. H-1b is specific to company, candidate with job duties. If there is a "material change" then it should be amended.
Material change has not been defined in all encompassing ways. it is a gray area whether one needs to amend h-1b for another location. In that particular case; aao seemed to imply that another work location was a material change. There was no follow up after they made the decision. One of the posters who participated on that thread said that he knew that particular person and after that decsion his lawyer showed LCA's and the case was approved.
However; it still wasn't conclusive of whether that was good enough. Reason being was that the candidates labor was filed in 2000 and he had 245i protection and that in itself would have protected him from his out of status issues; ultimately on that specific case of working on different locations would not have had an impact because he was protected in other ways.

Looks like India is employing a cold start strategy. In the first phase of operations, Indian Air force will strike LeT camps in Muridke and Muzaffarabad and then ask Pakistan to refrain from taking retaliatory action. The onus will be on Pakistan to take the decision regarding further escalation of hostilities.

Sarah: (laughing) Yes.
DJ: Alright. When did you last have sex, Sarah?
Sarah: Oh God, Brian....uh, this morning before Brian went to work.
DJ: What time?
Sarah: Around 8 this morning.
DJ: Very good. Next question. How long did it last?
Sarah: 12, 15 minutes maybe.
DJ:! Hmmmm. That's close enough. I am sure she is trying to protect his manhood. We've got one last question, Sarah. You are one question away
from a trip to Florida. Are you ready?
Sarah: (laughing) Yes.
DJ: Where did you have it?
Sarah: OH MY GOD, BRIAN!! You didn't tell them that, did you?
Brian: Just tell him, honey.
DJ: What is bothering you so much, Sarah?
Sarah: Well, it's just that my mom is! vacationing with us and...
DJ: Come on Sarah... where did you have it?
Sarah: In the butt...
(long pause)
DJ: Folks, we need to take a station break
and hearing this. Many Chicago folks DID hear this on the WBAM FM morning show in Chicago. The DJs play a game where they award winners great
prizes. The game is called "Mate Match." The DJs call someone at work and ask if they are married or seriously involved with someone. If the
contestant answers "yes," he or she is then asked 3 random yet highly personal questions. The person is also asked to divulge the name of
their partner (with phone number) for verification. If their partner answers those same three questions correctly, they both win the prize. One
particular game, however, several months ago made the Windy City drop to its knees with laughter and is possibly the funniest thing I've heard
yet. Anyway, here's how it all went down:
DJ: Hey! This is Edgar on WBAM. Have you ever heard of Mate Match?
Contestant: (laughing) Yes, I have.
DJ: Great! Then you know we're giving away a trip to Orlando, Florida if you win. What is your name? First only please.
Contestant: Brian.
DJ: Brian, are you married or what?
Brian: Yes.
DJ: Yes? Does that mean you're married or you're what?
Brian: (laughing nervously) Yes, I am married.
DJ: Thank you. Now, what is your wife's name? First only please.
Brian: Sarah.
DJ: Is Sarah at work, Brian?
Brian: She is gonna kill me.
DJ: Stay with me here, Brian! Is she at work?
Brian: (laughing) Yes, she's at work.
DJ: Okay, first question - when was the last time you had sex?
Brian: She is gonna kill me.
DJ: Brian! Stay with me here!
Brian: About 8 o'clock this morning.
DJ: Atta boy, Brian.
Brian: (laughing sheepishly) Well...
DJ: Question #2 - How long did it last?
Brian: About 10 minutes.
DJ: Wow! You really want that trip, huh? No one would ever have said that if a trip wasn't at stake.
Brian: Yeah, that trip sure would be nice.
DJ: Okay. Final question. Where did you have sex at 8 o'clock this morning?
Brian: (laughing hard) I, ummm, I, well...
DJ: This sounds good, Brian. Where was it at?
Brian: Not that it was all that great, but her mom is staying with us for a couple of weeks...
DJ: Uh huh...
Brian: .and the Mother-In-Law was in the shower at the time.
DJ: Atta boy, Brian.
Brian: On the kitchen table.
DJ: Not that great?? That is more adventure than the previous hundred times I've done it. Okay folks, I will put Brian on hold, get this wife's
work number and call her up. You listen to this.
(3 minutes of commercials follow)
DJ: Okay audience, let's call Sarah, shall we?
(touch tones... ringing...)
Clerk: Kinkos.
DJ: Hey, is Sarah around there somewhere?
Clerk: This is she.
DJ: Sarah, this is Edgar with WBAM. We are live on the air right now and I've been talking with Brian for a couple of hours now.
Sarah: (laughing) A couple of hours?
DJ: Well, a while now. He is on the line with us. Brian knows not to give any answers away! or you'll lose. Sooooooo... do you know the rules of
MateMatch?
Sarah: No.
DJ: Good!
Brian: (laughing)

Personally I think "Obviously" response was derogatory and not funny at all.

I was reading through this thread and couldn't help replying.
Before i voice my opinion, i would like to mention that I have a Ph.D in Aerospace Engineering (2002-2006 from a very reputed univ. in the US). My husband's employer (non-IT) had applied for his GC in EB3 - in 2005 which makes sense since the job required a B.S (Even though he was MS and was working for this company since 2002). We have our 485s filed and are using our APs/EADs. Now, i haven't applied for GC through my employer yet, but if i apply, it would most likely be EB1 or 2, and would love to port my PD of 2005. The reason i haven't done that is because i personally do not think that getting a GC couple of years earlier is going to make my life any different than it currently is.
Having said that, I completely understand what "rolling flood" is trying to say. And I also agree to what his point of view is. When a person who initially agreed to apply with EB3, changes his mind/company/ or whatever and wants to apply in EB2, he should theoretically start over. Why is it reasonable that he/she cuts in line ahead of a person who was already there. There is a reason why these categories are formed.
Shady means or non-shady means, EB2 means that u have superior qualifications and you are more desirable in the US.
EB3 means there are a lot like u, so u gotta wait more. Period.
