Godbless, I am sure you can get your post 6 years H-1B extension based on the Cornin and new Aytes memo of 12-5-2006. Can you ask your lawyer whether it is possible to file your H-1B extension after 01/26/2007 but BEFORE June 2007 or it must be filed before the expiry of your parolee I-94? Also, you said the Immigration Officer at the POE did not let you use your H visa but the AP. Is it because you showed him both of your H-1B visa and AP? If you did not show the AP, he would probably let you enter with the H-1B visa, right?
Sorry for my knowledge but why would anyone need an AP if he has ample time left on H1 ? Is it a rule that after filing I-485 , you have to have an AP to travel ?

Atleast desi body shoppers does our green cards and also pays unlike TCS, Satyam, infy crap.They bring people on L1 visa and they pay so less and these people on L1 killing oppurtunities for US based people and they take the job to India. H1s are not the problem. L1 are.

Why do you even need a GC, my friend. Stick with H1B visa. the only difference between GC and H1 is independence of employer and why do you even bother about it. You can always get a job where you want, buy a house now, sell it tomorrow, then after 6 years, go out for a year, come back on new H1.
As I said, people here are highly motivated and do want to follow the rules and achieve bigger things in lives, creating value in the process. But not many are willing to wait for 5 more precious years, after your greencard takes 10 years. Or 15 years on GC and 5 years for Citizenship. Once you work very hard, then you tend to ask for the right fruit, not just take anything.And whatever the Citizenship requirements are.. they will be met while waiting for theis damn GC..

Assume your school makes your 4 year course extended to 6 years and in the process makes you do a lot more..What do you ask at the end of it. 4 year degree or a 4+2 year degree.. .something similar..

AILA has obtained and summarized the draft of Senator Specter's draft of Comprehensive Immigration Reform Act of 2006, which will be introduced in the Senate Judiciary shortly (March 2, 2006). This is basically a Republican bill that put together various pending bills with some adjustments, such as the PACE Act, McCain-Kennedy bill, and other Comprehensive Immigration Reform bills. Recapture of employment-based immigration visa numbers since FY 2001
Exempt from the employment-based numerical limitation of the spouses and children of the EB immigrants

As these members have observed, we all know that any one who has filed for AOS/I-485 can potentially be hit with this issue, especially in the current job market situations. If you believe in the old adage prevention is better than cure, this is an action item you have to subscribe to. It will be only a matter of time the number of such denials is going to spike.
In recent weeks there has been a spate of I485 denials by USCIS in the AC21 cases. In most of these cases, the underlying I-140 has been revoked by previous employer. But AC21 regulations and related memo�s require that I485�s should not be denied based on that � provided I485 has been pending for more than 180 days and the applicant has changed to a new job that is same or similar. USCIS has been rejecting cases without even issuing a NOID � again required by AC21 regulations. So USCIS is not following AC21 regulations and related field memo�s for whatever the reasons.
Obviously this will have a very bad impact on us � in addition to tremendous amount of stress it can have very bad economic implications including loss of job. In the current economic conditions we cannot afford to lose the job change flexibility provided by AC21 regulations. IV has started a campaign to fight this.
After a brief campaign to write to Ombudsman, it has been decided to intensify this campaign and write to various officials in USCIS hierarchy. IV core members have been actively involved in coming up with a strategy and are actively supporting this effort. By sending large number of letters we can draw their attention to this issue and resolve as quickly as possible. There are other strategies that are being discussed and will be underway soon to tackle this issue. This is the first and the most important step up on which other steps depend.
I request all the members to start sending the following 4 letters. For your convenience the letters have been completely written including addresses to be sent � all you have to do is download following 4 google documents � add the date, your name and address � and send it to the address provided on each letter.

At personal level ( micro level) these people are making right decisions. As long as you are not committing crime, nothing wrong with making decisions which are good for you. I will probably do the same thing if I am in that situation.
The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....
So right now, remember wealth is always relative. So since you haven't bought house, you don't have negative equity or declining value home.You haven't foreclosed so you can still get loan at decent rate and buy house at much cheaper price. All the people with money in the market are affected by recent downturn. So relatively speaking you are doing much better than a lot of other people ....
BTW I am in the same situation as you are and waiting for good opportunity to buy house at cheap price. Do you see the positive side ? I hope you do .....
People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.

Right, it will not be good for anyone- nonimmigrants, employers or american economy. last i checked - there are plenty of flights between JFK/Newark and all major cities including Boston.
also - all airlines work on a hub and spoke arrangement

One thing to realise is that direct point to point flights will take a while, and even then there is no guarantee that you will want to fly it because it may not be economical or convienient.
And the absence of point-to-point flights has more to do with the airlines following a hub and spoke model than with any government restrictions. Point to point flights were identified as a core part of Boeing's product strategy only recently. The situation should improve over the next few years as airlines take delivery of new models, but until then we are stuck with the hub and spoke arrangement.
We were very satisified with Continental even though we flew Seattle->Newark->Mumbai.

Due to the pending caseload at NSC, the processing time of your I485 application has been extended. Allow extra time for an officer to review your application. You can dissect it a million ways from here to sunday, the fact of the matter is that EB 3 as a whole and E3 I&C in particular are messed up big time. We cannot sit twiddling our thumbs while we wait, most EB3s have supported most of the action items. What is wrong in exploring different options. we are not obstructing anybodys efforts. Vertical allocation or horizontal allocation doesnt matter, what matters for most is that there should be consistency in actions. They keep changing the rules every couple of months. if we know the number of people stuck in each category per year/per country we can come to our own conclusions and decide if we want to stay or go. There are greener pastures everywhere. Every year our lawyer tells us that its a matter of 12-18 months and you keep waiting...the only reason is that...we have been waiting so long, lets wait a couple more and see. i know some will immediately give comments like, 'leave sooner, one less family in the queue'..or..'port to EB 2 you ##$@'...to them i say i hope you are fortunate enough to avoid getting trapped in a situation like us.

I am only seeing only 100% illegal discrimination in these scenarios. Pretty soon, they will stop hiring US citizes of Indian (or Chines or Japanese or Italians ..) origin.
This is plain stupidity. These employers should first take a good look at an EAD and a GC. As for as work authorization is concerned, both these cards provide us with the same rights. The EAD says �The person identified is authorized to work in the US for the validity of this card� where as the GC says �The person identified by the card is authorized to work and remain in the US�.
So why does the legal department come into picture here? Is it because of the expiry date associated with EAD�s? If that�s the case even a GC has got an expiration date (a later date maybe). Does that mean that an additional budget is required to hire GC holders?

Hi everyone,
I have 2004 W2 but cant seem to find my tax return. I have 2003, 2005, 2006tax returns but not 2004. What can I do to get that return. Please any advice will be nice.

go to irs.gov > personal section and find somethink like transcripts. you can oder transcripts for free or copy of your tax return for $39 ( I guess)

I got the CPO on Sep 7, 2010. But we did not get any email about dependent application. Yesterday, I just called the customer service and spoke with level 2 officer to confirm about our cases. According to him my application is still pending with the officer and no decision has been made. I am really concerned that still no approvals. Moreover, I can not even open a SR because my status shows CPO. Btw I had my FP done on Sep 3, 2010.
