You have hit the nail right on the head. They issued 225000 H1b's between the years and 2000 and 2002 but the GC quota remained the same. Also, there is no quota for H1 (large # goes to India/Chine) but there is a quota for GC.
The idea is they want to control it so that only a third of the ppl who come on H1 end up getting a GC. They make the GC process hard one way or the other. Either you get stuck in the labor queue or in the retrogression queue. The average time to get has always been 4 years. Some ppl get lucky and get it in less than 3 and some get unluck and spend over 5 years trying to get it!
Ultimately the question for everyone is how long are you willing to put your life on hold? If you wait long enough you will get it. They seldom reject cases (unless it was a fraudulent case).
Having said that lot of us are thinking about leaving because US is making harder and harder for people like us to stay here and lot of us don�t want to put our lives on hold for years and years hoping that may be one day I�ll hit the jackpot called green card. After reading so many cold calling failures, I am yet to see a "success story" of this methodology.
If nobody got "converted" after being approached by a total stranger in a public place, why does BWW/Quixstar/Amway continue to do it.
Perhaps we should ask Q/Teddy to collect this data, analyze it and prove to them the futility of it all. Maybe then they will stop and everybody can shop/work/study in peace. :D

I'm sorry, I haven't monitored the web-site since my last posting.
Today reality hit me very hard. I am in my late thirties and I haven't had much adversity in my life regarding financial, career, family, etc.
However; today reality really hit me hard.
One gentlemen, his name was Raja Pitchai. He had asked me to help him file his I-140 and ask for cross chargeability to his wife's place of birth (singapore). USCIS accepted his package and his 140 got approved in a couple of months. (his priority date; india became available one month later anyways (he was from india eb2).
He was the one of the nicest guys I have talked to. Very courteous fellow.
They couldn't approve his case because he was stuck in name check. Well, his wife called me today and told me that he passed away last week (brain tumor). He had two U.S. citizen children but him and his wife have no relatives here.
She doesn't seem to be interested to stay here (she wouldn't be able to keep the greencard process going anyways because the death of the petitioner is automatic denial). She is leaving USA and was going through all the things she needs to wind up. I don't know if she would have stayed here if she got the greencard and I didn't want to task. Reality really him home today.
I need a couple of days to get over this.

The EAD/AC21 is still only available to those who are July 07 filers. There are many who have missed the oppurtunity. What many people are asking for is for something such that anyone can change a job after some given time, irrespective of Visa number availability. Even for those with EAD's, you are still restricted to be in the same field. So if you want a career move and do an MBA or acquire new skills to change your career, you cannot do that (unless EAD is for a dependent). If this is not pigeoning people, what is.
No point trying to get EAD for non AOS filers.
We should rather ask for faster processing of applications, transparency and more accountability.
EAD also has lot of restrictions and our goal should be faster green cards through faster processing and more visa numbers.

I still dont see any discrimination on the existing laws. The number of visas divided equally to all countries.
If no one (including the Govt.) is allowed to discriminate based on national origin then how can the Govt. discriminate on EB Emigration based on national origin ?
I think this is a fair question and most Americans in my work place agree with me. I don't know if we will win the case or not but if we win we can get
1) Removal of country based quotas
2) recapture of Visa's lost due to country based quotas
If we lose the case we will at least get more attention of the national media, it's up to us how we manage the media attention and have a positive effect on the popularity of our cause.
IMHO taking the opinion of the best attorney on constitutional law can not hurt. :)

No matter which side you are on, the quota system sucks. Period.
1) Once you start receiving benefits out of being born in a particular country/ race/ sex/ religion, a notion of "entitlement" quickly builds up within you. This adversely affects your ability to perform, for you just don't have to work hard enough!
2) If you are punished for being born in a particular country/ race/ sex/ religion, you have no incentive to perform, as you won't get what you deserve no matter how hard you work!
How about this... during every Olympics, most number of Gold Medals are won by Americans. Now imagine a rule that prevents more than 7% of all Gold Medals going to people born in any one country. How does that sound?
I will myself hate it if athletes from India (who haven't won anything in the Olympics till date) started winning gold medals simply because other countries cannot receive more than 7%!

I just got my medical forms from Canadian Consulate in Buffalo. Our documents were accepted on December 8, 2005, and the letter that accompanied medical forms and request for updated documents (interview has been waived) is dated October 4, 2006. Heh, I wish USCIS had this kind of turnaround. :)

You have the right to an opinion, after all this is a free country. You have expressed it and some people may not like it. Just care less for them.
But most importantly you need to understand that IV has the immigrant community best interests in mind. After all these are regular folks just like you and me who are doing this voluntarily....and we are reaping the benefits of it.
But again you may have a different idea or opinion which is always welcome for debate. For example i do not support piecemeal legislation(DREAM act) but after hearing IV point of view thats the best shot we have right now. So it made sense to me.
Long story short....IV has our best interests in mind.

TSA/CBP officers are no angels and are known to be rude to passengers at times. Having said that, I think we are all over reacting to SRK incident. Even the famous American Ted Kennedy had to face similar situation. GOI should lay off this incident.

My friend works for Deloitte & Touche and they charge $550/hr and he gets $75/hr.. so what? And he is USC.
Do you know the rates top consulting company charges? they normally starts from $400/hr+ in Accenture, PWC, KPMG, E&Y Etc and their employee's do not get paid more than 20%. Its a practice around the world.
I used to work for Big 4. I didn't care what they charged the client, I got a handsome salary with great benefits, 4 week vacation, cell fone, air card and perdiem.
Who pays 30K per annum? TCS used to pay 50K in late 90s. Are you kidding me? Who pays 30K. My friend who works for desi dalla gets 4K per month in hand after paying 900 insurance for his familiy.
No full time deloitte employees gets paid 75 per hr, it's an annual salary so they should not worry what they are charging the client. If ppl are worried abt billing rate, work as a contractor.
This is bad news for us all irrexpective of whether we work for desi dalls, Big 4 or Infosys. It can hurt us anywhere anytime based of what USCIS interprets of our application.

I work for this company and I moved to the different state. Now my company has approved labor from the state I was before in with similar job as mine with similar degree as mine. What do you guys say, should I go for substitution? Lawyer says that even though I am in a different state, he can apply for this, but if it takes more than 6 months, he will file state change and I will be ok. Worst case is, I have to move, but only when its approved. What do you guys say, should I go for it?

Guys, I am sure everyone in this forum will get greencard, unless they don't want it. You just need to be patient and wait for your turn. My priority date is 06/03 and EB3. I am pretty sure, I should get my GC by EOY 2011. I am in this country since 1997. Just hang on to your jobs or find a job if you loose one. You will get your GC. GC shouldn't stop you from pursuing your interests buying house or starting a business, there are always ways to do it.

Better get it cleared. As far as I know, if you have earned 40 quarters (worked in the US for 10 yrs), you are entitled to get SSA at your retirement irrespective of your status. There are some exceptions, but for India/China citizens living in their home countries, they will get it. Of course, 25% non-resident tax will be cut at source.

Language is a very hot boiled subject. We have to be a bit practical about what makes it work. Anti-hindi agitations have other roots as well. Understanding Dravidian history needs an open mind. Same is the case with everything about India.
IMO, India is not formed with a single ethnic group colonizing almost empty land and forming a nation based on some principles and later vast immigration followed by years on assimilation based on melting pot concept. It is more of an idea that is formed politically. All 4 south Indian states having a vast culture being ordered to use one language perhaps backfired fueled by resentment against upper castism that existed in Congress during that time.
Again, it is not either supporting or criticizing any event. That is what happened. We have all Hindi movies being super hit in Chennai. Once can walk in any street in Chennai and transact in English. I find many auto-drivers or even common man,go out of way to help when I speak in English in Chennai. So, please dont stereotype,
