Chanduv23:
I understand your enthusiasm of spreading +ve ness , but you need to also look at the practical implications on the situation. You are too criticizing and self-centric in what you beleive is the right thing to do.
Things do not work the way you expect at times and backfire. All I am saying is to give it a second thought if you are not getting a huge turn out of people. If you believe you are the smartest ass in the forums, tell me how many people you beleive would come forward and write a letter to the president. It's nothing to do with whether you did it, but are taking off the apprehensions and motivate other people to do it.
I agree with comments from walking_dude as it's inspiring and has a point. Get out of the shell and look at the world from a different perspective.
I am pretty straight forward in my approach and do not know how to "sugarcoat". This is not my own organization, I am not the founder of this organization, I am just a member like you. While it is individual's choice of doing what they want to do, what I have noticed is that the negative energy does have cascading effect, especially when things do not happen, those who spread negative energy seem to influence people. Once again, this is individuals own perspective. The fact that things do not happen easily we have to blow trumphets into the ears of people. Like a member said sometime back "Eagles which never flew - would not dare to fly until they are pushed, and when they are pushed forcefully and dropped into the air - they automatically start flying".
I have done what I can in the best of my capacity and continue to do so, I have considered IV as a self help group and also conducted meetings in the tri state area and continue to motivate people to make them feel a sense for the community.
If you look at IV as YOUR organization - you can see why it is important to feel a sense for the community.
The biggest issue our community faces today is the flow of negative energy. To quote examples, I was able to convince some friends for the rally in DC. Everything was going well, now when these people discussed with their collegues they were reluctant and did not show interest. The negative energy prompted my friends not to attend the rally because they felt that not many people are going for it and they tried to convince me out of IV. Such negative energy flows everywhere in the community and we have to overcome it. We can do it only by example.
Look at all those other immigration forums where people are talking bad about IV including their administrators and their owners - people who follow those websites will hate IV and hinder all our efforts. Such negative energy when it is flowing at a greater level - will cause more and more damage to our community.
It is simple - if you attack me for what I do - you are spreading negative energy - you are making a common man take a back seat and not encourage them to cooperate
If I point at h1bmajdoor's posts - I am doing it just to make sure that the positive energy flows and negativity does not influence the community.
it is a tough battle especially when you have thousands of daggers pointing at you ready to poke you.
Well, you say I am a smartass - so be it.
And if you do not support the community - stay away - why poke at someone who is doing something?

I think it would be fair to split the leftover numbers the same way they split whole year quota.
50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?

I guess, we need to hire, one octopus for every months' prediction. That will be cheaper, instead of we put our brain in predictions.
People are not contributing for Advocacy day and they will contribute to hire the octopus ??

Getting any sort of data out of any of the immigration agencies is often frustrating. Especially something like how many eb2 I-140 did they accept, approve, deny... However, they do randomly throw number out and we can scavenge through them for `clues'. Here is one such link.
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/index.cfm?formtype=7&office=5&charttype=1)
I agree, thanks.

Think about all those EB3 I out there. Have some shame. How would they feel if you talk about your own GC and get giddy about it in the forum when they have no hope. At least take your rejoicing to a private donor forum.
Thats the least you can do

The second paragraph from the link says that the new spill-over policy is not a random, ad hoc decision by USCIS but rather a careful one after consulting congress etc.
"...after further review, additional legislation, and consultation with Congress, they concluded that they have to allocate the fall across within individual preference petitions first..."
I wonder what additional legislation he is talking about here. Was there anything new we know about? If consultation means finding the intent of congress I wonder how much of it is BS.
This whole thing does not look objective. Even if it is, in all likelihood we are getting screwed by something that can possibly be changed again under the right circumstances.

To let you all know,
There is no contract to change the plans. I just spoke to Vonage customer service. She clearly explained me about the contract requirements. In fact there is no commitment for the new users also. The 1-year contract which shows on the website is for the Phone Adapter. They only charge for the phone adapter if you discontinue your service before 1 year. No strings for the existing customers.
Enjoy calling to India.......
Talked to a vonage customer rep:
For new users signing up for vonage, there is a contract of 1 year. If we cancel the service before 1 year, will have to pay.
Cancellation Fee: $39.99
Equipment Fee: $70+
For existing customers, plan change won't cause any change to their contract.

Congratulations on getting GC.
I think the fact that you had same A# helped you despite multiple filings. There are cases of people where even though they have declared their second application, USCIS assigned them a second A# number.
Pls. Stick around in IV and help others with your knowledge.
I have received two A#s since I submitted a second set of AOS (first set had a number of omissions and I did not want to miss the boat).
I think there is no reason to lose sleep over this issue (actually I was told so by a renowned lawyer with whom I just did a consultation), and there is not much we can do anyway. Except... if possible we should send a letter to USCIS telling them about these two sets of applications and then asking them to choose the one which is approvable (again, I was told so by the same lawyer).
BTW canadian_dream: heartiest conrgatulations on your green card approval, your posts on the multiple filings issue have been very helpful.

You can sue this firm, if they have really suspended the work on I-485.
How can they react to rumours?
Mathew Oh says this
06/29/2007: Notice to The Oh Law Firm Clients
* We have suspended the work for July 485 filing development pending the clarification of the rumor next week. Please bear with us in this confusing and difficult time.
I am of the opinion these rumors may not be rumors, they have some insider information. We are out of luck I guess

Not only the laptop but all your personal items such as purse, camera etc. BOYCOTT UK. These people are racist.
Sorry to hear all these stories.
I always fly either Singapore or Cathay Pacific (i am from California) and i never encountered these problems at the transit points (Singapore, Hong Kong, Seoul etc). Infact Singapore is one of the most pleasant airports for any layover. Usually, whenever i fly Singapore, i have a layover of over 9 hours, but the airport is so huge and so many nice facilities that one rarely gets bored (You can get a complementary tour of the city too, courtesy Singapore tourism or get a nice room inside the airport to relax, get a massage...). Add to that, ppl are so friendly there and you can see many Asians (Indians etc) working there that the environment is friendly and non-hostile, unlike most of th European transit points. (Earlier, i have flown via Frankfurt, Amsterdam where ppl were really hostile, as though every colored Asian that passes through their airports is a terrorist or an inferior human ...sick!)
Anyways..if you can take an extra flight from the east coast, please do try Singapore airlines from SFO or LAX and see the difference (no, no, i am not being paid to say good words about them :-))...

Reform H1B and L1 Visa Program - Introduced on April 23rd 2009
Grassley Works to Eliminate Fraud and Abuse from H-1B Visa Program
http://grassley.senate.gov/news/Article.cfm?customel_dataPageID_1502=20327
Consulting comapnies will get the major hit due to the below clause:
* Prohibit the blatantly discriminatory practice of "H-1B only" ads and prohibit employers from hiring additional H-1B and L-1 guest-workers if more than 50 percent of their employees are H-1B and L-1 visa holders.
We should support, as it puts end to consulting companies abuse.

The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.
I don't think so. EAD is a valid form of employment, just like a Greed Card. If it is not then why certain employers hire u on EAB and why crtain do not?
It is just a matter of filtering out by claiming policy.
Most times, the hiring manager never gets into these things. Hiring manager is more concerned about skills and about how a peron fits the job best, but then in big corporations a lot of nepotism works (which is a different topic altogether and we can discuss nepotism in a different thread). It is the matter of how resumes are presented to the hiring manager and how the manager can be influenced prior to submitting the resume.
If a reqruiter or a HR starts fussing about ur resume and goes back and forth about EAD etc.... ur resume is never even going to the hiring manager no matter how much you convince.
In one instance, when I applied for a job, the reqruiting agency did all the initial crap discussion about skills, visa status etc..... after 2 days she gets back to me and first question is, "I know you are past 180 days on EAD, but can you tell me when you will get a Green card", I told her "I will get it anaytime and will continue using EAD till then". She said "Oh great". Then after an hour she calls me back "I just noticed on your resume that you have 2 short term projects, we place people in these companies and they stay for years together" , I said "contract projects can be short term/long term and there were personal reasons for me to hop these projects but you are most welcome to talk to the managers who I worked with", she dais "Oh absolutely not a problem". Then after half an hour she calls me "This work location may not be the best for you especially because you have to pay a toll on whitestone bridge, would you want to consider something in Manhattan?" I respond "Toll is fine, please go ahead and submit". Then she responds "Hmmm, ok".
I did figure that she did not want to deal with EAD but she was taking me on a roller coaster going back and forth. she never submitted my resume to tyhe hiring manager.

Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
This is plain stupidity. These employers should first take a good look at an EAD and a GC. As far as work authorization is concerned, both these cards provide us with the same rights. The EAD says “The person identified is authorized to work in the US for the validity of this card” where as the GC says “The person identified by the card is authorized to work and remain in the US”.
So why does the legal department come into picture here? Is it because of the expiry date associated with EAD’s? If that’s the case even a GC has got an expiration date (a later date maybe). Does that mean that an additional budget is required to hire GC holders?

LC substitution was wrong because it became a business thing for some unscruplous employers who started to sell LCs and get people to work like slaves. That being said I have no ill feelings towards people who used the opportunity to get their GCs faster, albeit by puttting in more of their money and/or working like slaves for a better life in the future (hopefully). EB3 to EB2 portability is someone trying to better his/her life after suffering in the queue forever and I have no issues with such people.
I, therefore, cannot support this case. BTW, I am an EB2-I with Sep. 2006 PD.

Call USCIS customer service and insist that you want to speak to the immigration officer. Be persistent. IO will be able to tell you that. No need to waste time for Infopass.
