Folks - Amsterdam, Dubai, Brussels are the best way to go. 4 years back, I had problems with Lufthansa, I did not know I ahd to take transit visa and they never allowed me on flight and I had to travel the next day by going to german consulate in morning get visa and went back in afternoon, and surprisingly they had blocked me for that day. Until then, I always used to travel ONLY by lufthansa, but after that experience, I never wanted to. I always fly emirates and I like it.

This is a million dollars question on everybody's mind. Although the books says you can, I bet no body will take the risk.
Nobody can predict when July filer will get AP too.
There is a good chance I am taking this risk. But if there is any hope I will wait. Contrary to that if there is no hope I don't want to keep waiting until July next year for AP.

Why don't you find someone who is in similar situation ? i.e. who is on EAD or on H1. There several websites that can help you : shaadi.com, jeevansathi.com, bharatmatrimony.com. Now I'm not endorsing these sites. Just providing you with some options you can look at. Man accept it - life is tough. We have to play the hand we have been dealt. Also remember one more important quote:

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.
That's what I meant . Since he started usinlg the H1 his H4 visa was no longer valid . Doesn't that mean that if he goes back he will have to get some kind of visa stamped to come back ( either H4 or H1 ). Could someone throw more light on this situation.

I don't think there is any problem in EAD approval if you go out of country after filing it. I left USA the very next day of filing I-485. Still out of USA (in Canada). I already got my EAD and am waiting for AP. My attorney also said that for filing EAD, AP, 485 I must be physically present in USA.
Just to be safe maintain your H-1B status in case there is any issue with AP (because of what murthy's firm told). I can update on my AP status as soon as I hear something.

My wife and I have an appointmnet on the 20th of Feb at Chennai. I am taking the same set of documents I took couple of years ago (of course the updated ones). Olny thing is this time my I-140 is approved and I have disclosed that info in my application. I am hoping that nothing will go wrong. PM me if you want feedback after my interview.
Well ...I know a friend who was asked bu consulate to provide the proof that he has a labor pending...So they already know your immigrant intent..and they have accepted it...So your I-140 info should not be a problem...

I have been feeling sad that I have not been able to make it to the rally and after hearing about the energy, the camaraderie and the excitement you all shared I know for sure I missed out on a once in a life time oppurtunity, there will always be that sadness in me, the only comfort I have is that I tried to contribute in ways other than attending the rally.
But I am very glad that this turned out be such a resounding success.

Doesn't your H1 renewal come with a valid I-94? Please check that. If not, Why don't you go to the local office in person, I am sure they will adjust it. Try going to the border it does not hurt, I thgink the rule is 30 days as mentioned in your other thread.

Without any changes to the current system, How many of us will be in a similar position in 3 yrs time?
I am only asking this question since we all know how many of us are in the queue with PDs in 2001-2004 range. If 2800 per country EB category get out of this queue then, absent relief, this could easily be us in 3 yrs.

Few of my friends are trying EB3 to EB2 - which is a good alternative to waiting but doing nothing.
They believe they are wrongly put in EB3 as they believe their education and job requirements match with EB2. But wrong company policy put them in EB3.
Will post if I hear back from them.

I wonder on what basis did they advance the dates by whatever margin they did. No doubt, any positive movement (in hours, days ) is good but the consolidated database is not in place as I understand and so this seems pretty much a watershed. The dates might move with out any GC being issued :)

Thanks for the responses. I have contacted my attorney and they are evaluating my case. Mean while I want to educate my self to see the available options.
SKI Dude12 - I did n't cut others to use labor substitution. My employer has a left over labor, which I used for my 140. The original guy has two labors and he left my employer.

Thank you so much for your responses! I did not mean to lie to the consulate when I answered "no" on the form the previous time. I think the thing that we've actually came back in time proves it.
This is not a valid reasoning. The "no" is not related to immigration intent. It is related to if you made factually correct statements.
The new DS-160 form doesn't have this questions because I've heard that many people were confused by it. The consulate officer did not ask us if we were planning to immigrate to the US. I know of quite a few people who were issued a non-immigrant visa while replying "yes" to that question. Does it mean the law was broken on that case?
Does it matter if the "I-130" was not approved yet? Does it count "immigration intent" from the date they've received documents from my brother? Please comment. Thank you.
You need to *prove* that you have no intention for immigrating to US. Your intention is within your head; it does not start from any given date or given action by USCIS. The IO needs to "read your mind". The legal standard is that the court concedes that no one can know for sure what one's intentions are, however, the immigration officer can make a reasonable guess at the intentions by observing the actions you took or someone else took on your behalf.
In your case:
1. Someone filed I-130 for you. This is for permanent immigration to US.
2. You have family ties in US.
3. You have traveled to US before (I do not know how frequently).
4. You want to join a university that does not even have your major; that too you do not know what exactly you will study in that university. This itself is a very strong indication (at least in my mind) that you are not really interested in the education, but you applied to that university just for coming to US.
All together, it shows a clear pattern of observable evidence that your intention is to immigrate to US.
