The annual limits are 140000+FB, the FB spillover number are available during the first quarter itself. So it is possible for DOS to estimate the annual limit very early in the year, it seems unlikely that they will wait till the last quarter.

Anyways I only did a quick scan of your rather utopian scenario. But wouldn't the following help the that situation?
1) Flow of un-used visas from ROW to OS countries
2) Increase the TOTAL EB quota
3) Exclude dependents
4) Re-capture ( If any. But I doubt there will be anything left to recapture because in your Shangri-La USCIS would have been efficient enough to use up all the visas in the previos fiscal years).

No electoral reforms, no police reforms or strengthening their morale and weapons, the administration is still run the way it functioned during the Sahebs; and despite having won a well-fought war in 1971 we couldn't settle the Kashmir issue or control the jihadi tail-wagger in the neighbourhood.
Minorities were so well supported in Congress regimes that in the sixth decade after independence they felt a need to provide special crutches for them. Show the 'M' card and get the privilege, became the new secular psalm, further shrinking the space and opportunities for the condemned majority.

Exactly, why is India never an option to go back? Our economy is booming. On July 2 after USCIS announcement, I was ready to go home, I had had enough of the USA.
Many years in US and all we have to show for it is 25 lb bag of immigration papers!! And struggling to maintain status!!

My 6th yr H1B expires Dec 2008
H1B Maxout Jan 2008
I am short by around 20 days Should i recapture the days by going out of country for 20 days and apply H1B 1yr extension, Will i Qualify for 3 yrs in this case...?
or should i just Apply for I-140 PP in Oct 2008 and 3 yr H1B Extension without worrying about recapturing 20 days.

Just an FYI , I recently read in an article that Australia is changing its rules to require 4 yrs residency instead of 2 for citizenship.
In Canada you apply after 3 yrs but it takes nearly a yr to get it so defacto its 4 yrs. There was a lot of controversy in both Australia and Canada recently because they had to evcate thousands of Australian/Canadians of Lebanese origion from Lebanon during the recent Hezbollah/Israel standoff there.They were questioning if it was worthwhile giving citizenship to ppl who would never work or pay taxes in Oz/Can.
The company I work for has an office in Sydney, Australia and recently opened one in Toronto but it is not fully operational. In such a case E3 might work better than Canada PR since it takes 3 years to get Canadian citizenship and 2 years to get Australian citizenship and one could potentially retain the US job if one manages to strike an arrangement with their employer. Also this option might work better for those whose home country is close to Australia (eg Indonesia, Singapore, New Zealand etc). Also note the benefit of the E-3 is that one's spouse can work without restrictions and it is indefinitely renewable while the TN's spouse is not allowed to work. They both have pros and cons. Geographically and culture wise (ie way of life) Canada makes for an easier transition back to the US. Personally I have applied for the Canadian PR for the reasons you cite.

If we do file a lawsuit against the discriminatory country-quota laws in EB immigration, in worst case scenario, even if we loose it might help highlight the issue and send a message to Washington that we are serious and we mean business. And the judgement might help us at-least get the recapture visas back if the court is made aware of our plight.
IV has spent so much money on Patton Boggs etc. . Maybe its time we think about this option as well. Maybe this method might work as clearly other approaches have failed and we haven't gotten anything. I wouldnt mind waiting in Tirupathi line or waiting in line at Jai Mata di temple, for that the choice is mine. I am talking about lines which I have to get to or have my bahadur/driver/employee if I am in business do it for me.

Anyway don't take it too literally but I will give you a real example. I could never pay my electric bill for a commerical place even if I wanted to. There is a middle man. If you don't go through these middle men they will hassle you every month. Will come up with something so they can threaten you with a disconnection. Now at a business place and specially in service oriented business you cant fight them. For house electric bills thats not case though.
Same for sales tax guys, excise tax guys, ca's and lawyers. To get my IT clearance even after having every paperwork, commissioner (IAS) tip was Rs. 1000. forget babus and chaprasis.
As for your GC comments that is not the right comparision, as we don't require a GC in India. The closest would be Passport line (3 months to 2 years) and you have to bribe the enquiry man no matter what, and which state. HDFC Draft Line, Visa Line (after 40-100 days wait), Wrong passport picture run get new and go back to line. Not mentioning H1B sponsoring employer line.
:-) and I am not saying I am 100% right. You may come from a fortunate/honest town/village where there is still honesty and sincerity or Maybe one didn't face it as someone in their family was a bigwig, meaning every one knew (fiction) Anirudh is son of Income Tax Commissioner or Malaika is daughter of H P Dwivedi who is MP from Rohtak, Haryana. so for those guys it was sir, sir, sir all around.
but when Sachin hits a century or sets a world record.. Mera Bharat Mahaan. (India is great) Right? Sanya anyone? Right?
I am only implying convenience is a big factor in deciding your future and your children future and where would you like to concentrate your energy/passion for the rest of your life.

I'm not sure if you r a tamilian or not, but u defenitely sound like India's neighbour Pakistan who claim that their fellow muslims are killed in kashmir by indian solidiers and who also cliam that muslims have been opressed and want a seperate statehood just like the LTTE.
Lemme remind guyz like u, that LTTE has been responsible of killing Indian Prime minister along with many inncocent civilians & presidents, many prominent leaders, innocent civilians in srilanka.They have been labled as a terrosit organization.
Srilankan Government has been facing LTTE atrocites for many decades & now that they decided enough is enough & doing what they think is right for their country.

you are right in Aug 2008 so many people wth PD of 2005 & 2006 got approved. I would have been a lucky one but unfortunately my Birth Certificate turned out to be the culprit and ended with with an RFE. By the time I answered the RFE visa # were exhausted and I was left behind.

One of my friends that filed PERM in sep 2005 before the dreaded retrogression was gonna hit - he got approved in jul/aug 2007 and consumed 2 GCs. another with Nov 2005 data got through last august 2008 and consumed 4 GCs. there are a lot of such folks and not every updates .
the unknown factor though is the traditinoal EB2 RIR labors filed in mar 2005, before PERM got in. Just from CISCO, I think there were around ~1000 applicants.

IV is for everybody and IV has always tried to be balanced and fair to all categories. Please read the provisions that IV is asking for.
The goal is for zero backlog -Then where is the question of EB3 lagging behind.
IF we get what we are asking for- ie: recapture, not counting dependants and no country quota, then there wont be backlog in any of the categories.
