I wrote about our retrogression problem to our senator Barack Obama three months ago and I got reply from him today.I couldn't find the answer to my question.Can you help? Here is his response:
Thank you for writing me regarding immigration policy. I have heard from constituents on both sides of this issue, all making passionate arguments. This is unquestionably a complicated policy challenge with far reaching ramifications across society.
After much study and discussion, I have concluded that the best course is to pass comprehensive reform that reaffirms the rule of law and brings the undocumented population out of hiding through an earned path to citizenship. In my view, the approach presented by the immigration bill passed last year by the Senate lays the foundation for such a permanent solution.
To address the immigration problems in our country, that bill put forth a three-pronged response: 1) it strengthens border security; 2) it establishes a path to citizenship that included fines, a requirement to learn English, and adherence to the rule of law for immigrants and their families who may have entered the United States illegally but are now contributing and responsible members of society; and 3) it creates a "guest worker" program whereby American businesses can temporarily recruit foreign workers for jobs that American workers cannot or refuse to fill. This proposal passed the Senate by a 62 to 36 bipartisan vote, but a joint House/Senate conference committee appointed to reconcile the differences between this bill and a separate version passed by the House of Representatives (H.R. 4437) was unable to complete its negotiations before Congress adjourned.
Like our nation's religious and civil rights communities, I opposed enforcement-only approaches like H.R. 4437. That House bill is also opposed by the U.S. Chamber of Commerce, the AFL-CIO, the U.S. Conference of Catholic Bishops and over 200 other faith-based, business, labor, religious, local governments, civil rights, and ethnic groups. The common denominator of this opposition is that the bill would have had a profoundly negative impact on workers, on businesses, on families, and on local communities without making the country safer or fixing any part of the broken immigration system.
The President and Congress should look at immigration reform in a comprehensive manner to guarantee both that enforcement and border security are enhanced and that all workers, including immigrant and “guest” workers, are treated fairly and are afforded basic labor protections. This approach will curtail the flow of illegal immigrants into the country, reward work and unite families. I look forward to continuing to work with President Bush, my colleagues in Congress, and the people of Illinois on this important challenge.

The main issue is not the expiry date of the DL, the issue is why make us verify all the documents and add the 6 month validity constraint even for "Change of Address" requests, and why give us a completely different Vertical Style DL unlike the standard Horizontal style DL.
Also, I have not reached that stage, but what happens with people with EAD? You have to renew every year and can renew only 120 days before Expiry. The expiry date of DL and expiry date of EAD will keep chasing each other and at some point you will LOCKED OUT of DL because of the 6 months validity constraint...
People from other states = Do you have to go through the whole verification process even for "change of address" requests?

I think what is being conveyed is NOT that he is superior .... but that he has been in the US atleast 2 yrs more than when he actually started the journey towards GC by formally putting in an application

For the August visa bulletin, USCIS gave all the extra quota to EB2. I don't think this is fair for all the EB3 people. I thougt the reason they gave all the quota to them was the EB2 included NIW. But NIW is just a small portion of EB2. Majority EB2 peopole are like EB3 working for companies and not necessarily important to give all the extra quota to them. If the policy continues, our EB3 will just become fake immigration. You don't know how long we can finalize our case. Gugs, please work together and let our voice to be heard by USCIS. Hope our organization can help us.

I have a 4 yrs BE (ECE) degree. so am not sure what could be the RFE. Do we also have to submit education evaluation for a 4 yr BE degree from Ind?
also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?

number of PERM approvals from 03/28/2005 - 10/1/2006 = 83,151
assuming 60% of those are for EB2 and EB3 (EB3 other workers are also included in the total 83151 count) = 49,890 ~ 50,000
50,000 = 39% of 128,000 unique labor certifications/primary applicants.
from my perspective this is very promising

I can totally understand a 2005 India EB3 filer thinking this is the worst news ever...and i do feel ur pain.

When you go to the ASC, BRING THE ENTIRE APPLICATION AND FILING RECEIPT AS WELL AS PASSPORT/DRIVER’S LICENSE . At the ASC they will photograph you and take your index print. The photo and index print will be digitized by the ASC and will be forwarded electronically to the SERVICE CENTER where the I-485 application is pending.
NOTE: THE ASC has a "PRINT OUT" of all the APPOINTMENTS that were made by calling the 800 NSC number. So when you go to the ASC they will have the information about your name, APP time, A#.
Things to take at the ASC:
Current Unexpired EAD.
Printout of the EAD APPLICATION that was filed online. (Note the ASC uses the "BAR CODE" on the Application to enter some data during FP)
Driver Licence
Sample Covering Letter for PRINCIPAL APPLICANT:
Dear Immigration Officer,
I have submitted my EAD renewal application electronically on xx/xx/xx. The BCIS Receipt number is xxxxxxxxx. My A# is xxxxxxxx
Currently, I am working on the EAD which was issued on xxxxxxxx.

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 problems, GC backlog processing etc.
Any other thoughts from your side would help.
I am an ex NYFA student in digital film making. I would like to make the above two things by end of this year. Any of you are interested can participate. Again I don't need any money contributions. Just need your participation as actors, script writers and as other team members.

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.
Kindly refer me to appropriate material if you know of any.

Surprised to see that you were unware of this. Getting GC is painful process as we all know. There are three situations
1) Don't file I-485 till you get married. Risk, you might have already used 6 years on H1.
2) File your I-485 and get quickly married , then you can add your spouse. Do a court marriage in US and later you can do a marriage ceremony in India.
3) File your I-485 and get green card with out having chance to add your spouse
Since you fall in category 3, your situation may be worst.
Couple of options
1) If the girl(or guy :)) is in US, absolutely no problem. Only thing is if girl is already in US, you will get lot of family pressure from girl side.Have to compromise on lots of things. May be will become a house husband.
2) Girl from India, now you have to find a really smart girl who can get admission to universities or pass TOFEL GRE etc with flying colors. Then long distance affair starts. Girl in city X studying guy in city Y. Meeting once in a month. Lossing lot of money on commute and mental peace.The girl will have now her own friend circle and over period of time she might start liking someone else. Based on real situations.
3) Move to Canada and apply for Canadian citizenship. That's easier to get and easier to bring spouse there. But again you won't be able to bring her to US
4) Wait for 5 years. Who will want to wait for you 5 years.
Best Option
Return to your home country and enjoy life there. Believe me you won't have never any regret in life. It's just not worth for all the pains and miseries it bring in one's life. GC : Grievance Card.
Good luck with whatever you decide.

dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.
I am July 2 filer, ASC in Bay Area. My case was receipted at CSC with ND Sep 6. It was then transferred and received by NSC on Sep 21.
I then opened a service request for FP on Oct 2. On Oct 22, NSC responded that case is waiting for biometrics at local ASC. I then lost all my patience and on Nov 6 shot off a mail to ombudsman, Prakash , highlighting my details.
Subesequently, my FP notice got generated on Nov 7 and my spouse's was generated on Nov 8.
I am writing the details to highlight that for NSC_CSC_NSC filers, you definitely have to act to get FP notice, especially if you are in Bay area. You might get lucky and fet FP by waiting, but it is better to act.

If you are H1 - as long as you are an employee - the employer has to pay the salary as per H1 papers, whatever be the business issues. If that be the case they can be reported as a violator.
Non solicitation clause should state a time frame - but otherwise most contracts have them

I had applied for I-140 Dec last year(2006) EB3 and was checking for update and found that an RFE has been sent on Dec 12. To whom is RFE sent....My company had done all the paperwork...is it to our company lawyer or me....Please advise

Can anyone please help me with the EFile of EAD. I am applying for my first renewal.
1. Question: Have u ever applied for EAD? if Yes, Date for application:
Which date should we fill in here. Should it be First EAD Received Date or Notice Date or approved Date?
2. While Efiling we have a field (With dropdowns) Current Immigration status(Visitor, Student etc..) which drop down value should we fill if we are on 485 Pending (AOS) as my H1B expired already?
3. If you pick C9 for Eligibility Status Question, we have a Text box for the question, please provide information concerning your eligibility status.. what should we fill in this box?
4. At the end of Efiling, does it provide us with any supporting documents that needs to be mailed? or Do you know which one to send? As per the Paper based document instrcutions we should send, 485 copy + EAD Copy. No photos as per the Efiling instructions and should send the EFiled receipt notice..
I would appreciate if anyone can help me with this info.

Unless you can play some smart games using an attorney, you cannot use an EAD to change job classifications as long as you are the primary applicant.
