It takes about 2 weeks get the RFE. It contains 2+ pages, first page is cover letter and second page+ will contain RFE details. NSC is know to issuing RFE on ability to pay, education (if 3 years degree) and detailed professional experience letters.
I have a 4 yrs BE (ECE) degree. so am not sure what could be the RFE. Do we also have to submit education evaluation for a 4 yr BE degree from Ind?

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?

Cool down dude, I can understand OPs frustrations, I am in same boat and see similar cases around, not that ead or ap is anything great, just that someone who applied before feels rejected seeing TSC giving out eads like cookies:)

Yes, I honestly think that quantity matters in meeting politicians. What is so clear to us may not be clear to them. Not because they are lesser mortals than us, they have a different perspective. Why and How is entirely not up to me to worry about. Someone has a different view and I can only respect that view. I cannot, and do not, think that I must invest my time in brainwashing anyone. I wouldn't call it a crab mentality either without knowing them personally.

Myht 1: If I-485 gets denied I have H1-B to as a back up.
Think of this - you get AP and EAD based on pending I-485. Similarly, you get H1-B extension beyond 6 years based on your pending green card process. Once your I-485 is denied, your AP, EAD and extended H-1, all are gone at once. Yes, extended H1-B is no longer valid after that. You simply can not fall back on that.
Myth2 : I want to continue on H1-B even after getting EAD, I feel safer.
Think again. Suppose you came to the US in 2004. In 2007 during the visa gate scandal, you filed your I-485 and got EAD. At that point of time, you had two options. You could have continued H1-B or changed over to EAD. Person A changed to EAD. Well, once he changed to EAD his clock of "Time spent on H1-B" stops right there. Come 2010, if his I-485 gets denied, he still has 3 years of H1-B left and he can use it till 2013.
Person B decided to continue using H1-B after 2007 and kept his EAD as backup. Same thing happened, his I-485 got rejected in 2010. He can not go back to H1-B. He has utilized H1-B for all 6 years and he can not get it extended without going out of the US for one year.
So by keep EAD for "in case I-485 goes south" and using H1-B, you are killing your options. If someone has a choice between EAD and H1-B, he should use EAD.
Gurus.....any comments?
Answer to Myth1: If your 485 gets denied, you CAN fall back on your H1, provided you are still working for the H1 sponsor and your H1 has not expired. If your 485 is denied, then your EAD cannot be renewed but is valid to its expiry. So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.
He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.
I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.
Also, can you share with us your city/state - just curious which USCIS location has become so efficient :)

In short as long as a person is on H1B he is no better than his indian counter part working in a multinational or maybe he is worse, atleast person in india is close to family ,spouse can work anywhere etc etc.
So the sooner the person gets GC the faster he has made his efforts worthwile - otherwise he will find his story similar to what sai posted in first article of this thread.

because USCIS is not even willing to talk if the Service center does not have processing dates current. And if my case is in California (which website says), then the processing dates are not current and have never been current and probably will not be current for a very long time. CSC does not process 485 applications at all.

In this scenario, if I goto India, say in Feb, get my visa stamping done, what will be the validity of my visa in the passport?
1. 05-Jun-2007 to 04-Jun-2010 as stated in my 3-yr extension or
2. the date I went for interview till 04-Jun-2010??
If its the former, then how can I get into US during March '07 as there will be a gap in my visa dates in the passport?

If you missed last time In 2008 then dont bother. You can still claim with 2008 tax filing. (If you are eligible).
Dont do these mistakes
1. File Married Filing seperately and later amend the tax return. You will do a Big mistake and many times case is screwed and you will lot of problems. I personally handle some of the cases where client screwed the case and we correct the tax return. But for CPA also is a Big pain. and most of the time IRS people will confused and you will be keep getting demand letter and they will treat as a seperate tax return.
2. 2008 payment was just a estimated payment only. This will trueup with 2008 tax filing (in 2009).
Pl consult with CPA / Good tax preparer who has good knoweledge how to handle immigrant taxes.
