I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.

I have applied for my H1b extension back in April......Have not heard anything yet........once I get my H1b approval, can I apply for H4 extension from inside the country?? (Is that even required if you are already in AOS pending status?)
No, it not required but maintaining H1/H4 status allows person to remain in USA and apply for appeal if, for some reason, I-485 is denied. Otherwise, person is out of status from the date I-485 was denied.

msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.

On one side kids at a age they should be enjoying... work hard at something and excel at it,whatever it be.
On the other side so called highly educated (?) people ...supposedly people who should excel at something find faults with these kids saying they aren't good at all facts of life.
Are any one of us good in everything ? or for that matter is anyone in this world good ?
Learn to appreciate achievement, for they have achieved far more than most of us did.
To all those people who keep saying this is rote learning of words, do you know how many words there are ? and if it is humanely possible to remember the spelling of each of the words ? There is much more logic involved as words of a specific origin (greek,Italian etc) have a specific characteristic and trend it is all about picking out the trend...keeping your cool and spelling it out taking into account all the smaller variances.
Before any of you go off on how kids work too hard, take a survey of the most successful people in the world most them spent their childhood working extremely hard towards a goal.
These are kids they can grow up and learn and become more rounded, hopefully that can apply to some posters here.
This is just a foundation for a bright future....but apparently people are seeing only how they are not more rounded today.

The only thing that can help us predict Sep bulletin is how many visa # have been used so far from 2009 quota. Since USCIS will be rushing to use up all visa # the quantity can least give us an idea if dates will move few months or few years. USCIS should not have trouble with either since they have so many pre-adjudicated applications to take care of both scenario's. I am pretty optimistic (realistically confident) that there will be a forward movement.
Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.

OKay, when I commented on the English, I was trying to be funny (which obviously I am working on) and see if that can help you in the misinterpretation angle.
Also, when someone does not support your theory, he/she is actually supporting you, by letting you know that your theory does not sound reasonable.
Contact a Taiwanese/Asian lawyer and ask him to help you. You can add him as a lawyer, and even if you are replacing your lawyer, and if asked, you can claim language barriers with the old lawyer.
And no, we are not experts here, and no one has claimed to be one, but I believe the real purpose of yours posting your situation here was to have ideas. There are thousands of thoughts going thru your mind on this situation and you are definitely not able to see thru clearly.

As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. My wife is writing the mail to DA and wish it helpful to my case. I will have several rehearsal with my attorney in coming weeks. Anyway, we will fight for the justice and not accept that ridiculous battery charge.

A# is assigned during I-140 approval process. Unless you get an approved I-140 from your employer it is difficult to get the A#. BTW, I didnt knew my A# so I just left that field blank and sent I-140 Tracking number instead.

I always wonder when Thackeray, Modi can become ministers after committing such atrocities and walk freely in India, why can't people like Dawood Ibrahim (after all he is also indian and successful in his own profession).

Looks like it is for illegal immigrants as it asks for continous stay. Most legals would not have stayed continously as they might went out of country for vacation

The text of the current bill states that the applicant needs to apply under this bill's section to adjust status, similar to 245i. Now if this means reapplying under this section, that would mean another flood of applicants. Obviously with such a deluge, you wouldnt need a quota, the CIS system itself will take years to sort out the applicants.

I just wanted update this thread with my experience. Could be helpful to people like me who searched many forums frantically. I have 10th year h1b extension valid upto 2010. Instead of going for stamping at US consulate in India, I decided to use advance parole. Most troubling thing about my history was that I had one dwi (Driving While Intoxicated with Alcohol) offense. It is not a deportable offense. However, I was concerned that it would show up at port of entry and they could ask me to go back for consulate processing. I kept all my case related court documents handy. This is very important for anyone travelling with dwi or other serious charges against them.
Officer directed me to the secondary inspection. Another officer there entered my information into the computer and after making gazillion keystrokes, he stamped my advance parole document/I-94 with 1 year validity. I got up from the chair when he called my name, walked upto his counter and took my documents from him. NO QUESTIONS ASKED. NO BIOMETRICS.
Hope this helps others.

Yup, Gandhigiri will work.. We have lots of time in our hands.. British enjoyed their 300 year stay in India.. Lets enjoy our stay in US also.. at the hands of our employers, lawyers etc.. :o

Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

Our state is like Indian farmers. Indian farmers look for rain in July, August and september for good harvest...we look for July, Aug and Sept for good visa bulletin. Government will not do anything for hard working farmers in India and here for hard working professionals.
