I am in the same situation. They say once you start using AP, H4 becomes invalid....my wife IS working on EAD, she was in India for a while and came back on H4, again resumed job on EAD...then we renewed her EAD and put her current status as H4.........no issues whatsoever.
Use EAD, travel on H4......live life. I do not see any issue.

As you have said that working on EAD immediately invalidates the H4 status. This is OK for me, but at least I have avoided the AP procedure stuff. Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Let me know if this clears your doubt and if so, can you think this would work out. Also, if you can, please respond to my other questions

When you transfer money outside the USA, one of the questions that FDIC mandates the finanacial institution collect is: SOURCE OF FUNDS. If you put this as "salary" then you (and your employer) have ALREADY paid (or will pay by next year) on these funds. There are no additional US taxes on the money. If the money was not earned thru salary (which would not be legal since you are on H1B) then you will need to declare it while filing taxes. If the money was NOT earned "under the table" and was above $600 then, the payer will send you a for called 1099 which will show how much you were paid and you have to pay appropriate taxes on that amount. In your case it most likely looks like "salary", so you have nothing to worry about.

Going to Initial Review after approval is scary but normal when you get done FP after approval. I think if you have the I-797 approval then there is nothing to worry about. If you follow a thread in tracki*t you will know that couple of people also got similar status change after FP.

Please don't get me wrong. I am not against any one getting it. The date I chose here is just an example and my PD is not in 2003. I thought if they approve cases with newer PDs and reject older cases that raises an interesting point.
I guess i dont have a PD as old as some of the other folks , but Its been 3 yrs since we applied to 485 and still waiting on some news. 3 FP's. 4 EADs and not a single update online. Am i STUCKKKKK..

If they allocated visa number on 1st July then, why was the approval done on 10th? I think in one of the earlier posts it was mentioned that they need to use it in 7 days or else return it to DOS.

Good question - based on what I am reading on this forum, it seems to me like the RFE is requested for people who travel a lot in and out of the country. My wife has traveled a lot of times - I even lost track in the last 5 years - and she did tell me that they did not take her I-94. It would be still attached to the passport and when she enters back - if the travel time was less than 20 days, the officer discarded her new I-94 and asked her to keep the old I-94 - in some cases, he/she would just take it during entry. This happens mostly when she travels to Mexico or South America. The evidence that was being requested is the dates of travel and type of visa used to enter the country with the required documented evidence on the passport (color copy).
In my scenario, most of my stay in US, was limited to the stay period mentioned in my VISA though I-94 was given for longer period. There was one instance when I-94 date was given for a longer period than Visa expiry and I stayed till my i-94 date though visa expired. For this particular stay, when I look at the US Entry and Exit dates it would say as if I overstayed though legally allowed and only way to prove that would be the I-94 copy. I dont have the copy of that I-94...

My employer had legal dept and lawer filed G28 form for me when applied for I-485. Do we really need to hire a lawyer to represent us? I am planning to move to client under similar job description this month end and would like to see if I have to file AC21 and change the lawer representation.

You do not need a lawyer. Just make sure CIS has your correct mailing address and keep watching your cases regularly for RFEs.
In the event of an RFE, you can respond on your own most of the times. If you think it requires a complex response or if you are not confident, you can hire a lawyer at that point to respond to that RFE.
I would even say handling your case on your own is safer as I know some cases where the lawyer goofed up by not responding to RFEs. The applicant was not even watching his case status as he had left everything to the attorney and he had no idea about the RFE.
It is also not necessary to inform CIS about your job change unless there is a possibility that your previous employer may revoke your 140.

I think that instead of exhausting our energy on this issue, we better think how to make progress in our fight against injustice. And to all those who are using an abusing language .... please show your guts when you go for your next visa stamping or when entering the United States on a port of entry and try to use the similar language.... you surely will get an answer/lesson you will remember for rest of your life.

Do not forget to count the effect of the fact that once congress pass FBI Background Checks Improvement Amendment to CJS FY 2008 Appropriations Bill, total load again will cross more than 650,000 (320000 + June application load +Namecheck stuck files + August and onward load) at least. So in theory Namecheck stuck guys will start popping out of the system first and then us. And this may make all bulletins till 2008 end slow not moving beyond 2003 for almost all EB2-3 categories in general. Now Senate has already passed that Amendment.
