    Background:

    My wife did her MS from US university and is currently on OPT working with a small US Oil services company in Texas. Her OPT ends next May.

    Question:

    Can a non E-Verify company file for H1 visa?

    Can a person extend their Drivers License in Texas during cap-gap? My wife's OPT ends next May and if her employer files H1 visa, can she work from May till October and extend her drivers license also?

    Legalese was never my strong point. Which part says that EB-1 unused must go to EB-2 of same category, and then to EB-3?
    None. USCIS has discretion on it and it has choses that to be the case.

    A 700billion$ bailout is not helping much. You think we can help the economy? We are at the mercy of the employers whose earning results are going down because of recession. :( It is hard for me to believe that we can help the economy by buying houses and how are the law makers going to get convinced? Show me the proof.

    500,000 Legal immigrants in limbo:
    lets say (I mean lets Tell them) 1/5 th of that # buy on an average $300K houses.
    That equates to $30 billion.. Not a bad #. But I am sure all want to buy houses eventually. Thats $150 billion. Not a small #.

    Lets say (again tell them).
    1/100 th of 500,000 start companies, of 5 employees each=25,000 jobs.. Not bad again.
    This idea is inline with our IV campaign that was discussed sometime back. We can tell in different forms to the media. Somebody may publish.

    The Immigration and Nationality Act (INA), the section of government law that guides immigration, specifically states that any non-immigrant alien visitor to the United States must have a passport that is valid for 6 months beyond the intended period of admission. That is to say that if your program or employment runs until May of 2008 you must have a passport that is valid until at least November of 2008. If the alien visitor is from a country that is in agreement with the United States to automatically assume that the alien's passport is valid for 6 months past the passports expiration. These countries are referred to as 6 month countries. That simply means that if the alien is from for ex. India and the passport date will expire before the end of of program date, officers are allowed to make the I-94 valid until the end of the passport. If the alien is not from a 6 month country the officer can only admit the alien with an admission date on the I-94 with a date that is 6 months before the passport expires. Officers at airports and deferred inspection offices do not have the authority, at a later date, after a new passport has been obtained, to change the original I-94 to the date that would have been given at the original time of entry had the passport been valid for 6 months beyond intended period of entry. The alien must request an extension of stay with an explanation submitted to the USCIS office, no fee is required, and a new I-94 with the appropriate date will be issued. However, if you call USCIS and are fortunate enough to get to speak to someone, that person, an information officer, with 2-5 weeks training, will tell you a CBP Officer can change it. Some officers will change the I-94, however, they have no authority to do so and can face penalties for doing so.

    Hi,

    Does anybody know of and have used any good lawyer for AC21 related matters from bay area in CA?

    I reside in bay area and would like to consult a local lawyer regarding the "same or similar" nature of the new job that I wish to take using AC21.

    The reason for requiring him to be local is to use his services, again if needed, during adjudication.

    I appreciate any help in this matter.

    I was also planning to phone consult Murthy.com lawyers and would like to know of any experiences.

    This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?

    You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
    The credit card will be charged once, may be charged twice or a valid CC may get rejected.
    Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
    USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
    In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
    There would be an online survey after you buy it which would never get submitted 99% of the times.
    In case it did get submitted, somebody will read one out of 10,000.
    After reading it he will throw it in the trash can.
    If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.
    I wonder how many customers would USCIS have eventually ??? Any guesses ??? :-)

    eb3nepa & srikondoji, it is not just non Indians that not standup, there are close to quarter millions Indians in the queue who follow immigration news and who want things work but just do not want to standup. It could either be "fear" or "no care" attitude. It is true with immigrants from other countries too. Immigrants from all countries have a hidden fear, as it is not their country but a country they want to immigrate to and do not want to do anything that displeases the country. It is factual. Very few people actually have the guts to question.

    I have roots in two countries in different part of the world and I will make sure that the mess with the US legal immigration is well explained and "advertised" there. Young people in these countries should know what is going on here and should thing before deciding to go the US. Even if they still decide to come here, they would be better informed and prepared. At least they should know that their social status as "legals" would be lover that the one of the illegal Mexican illiterate lettuce pickers (the latter would have more rights in terms of obtaining permanent residency)

    I never demanded permanent residence in the US as my right. But I have the right to have my LCA adjudicated in a reasonable time (months, not years) by the US administration. Months, not years! I am here legally, I work hard for this country, pay honestly my taxes and I am entitled to get a quick reply to my application. If it is rejected, OK! Fair enough, I will look for other opportunities.

    I believe that the IV as a face of the "legals" have to put this issue before the lawmakers and the media and to demand for its resolution. Yes, to demand - this is not too much to ask. And if the US administration is still unwilling or incapable to resolve at least this problem, than I would ask myself what I am doing in such "great" country :-)

    By the way, creating of these "BEC"s is not a resolution of the backlog problem, just another cover up of the DOL's impotency.

    This date movement could also be to silence amendments like Cantwell's which are based on Backlogs. A parallel GC system to Point based was called a poison pill by Sen. Kyl. I guess may be this is a way to lock up one of those pills. Could be Chertoff's trick to mine-sweep the path for CIR.
