    If push comes to shove, it does not really matter how strong you are. I survived the 2K to 2K3, but have seen many smart people suffer.

    Dude - think practically. If the billing rate that the company is going to get from the client is $70/hr and they keep only $5/hr then they have to give him $65/hr. If they have to keep him on the payroll, they will have to pay 7.45% in payroll tax, which is employer's portion of Social Security Tax and Medicare (reducing their rate from $70 to $65.1575). This means they will be making 15.75 cents/ hr (translates to $315 for a year assuming that you work for 2000 hrs - the remaining 80 hrs go in holidays - for which they may or may not pay). Even if they are outsourcing payroll, do you think that it will cost them less than $315 a year to pay him? even if it costs $0 - who would be willing to keep you on their payroll to make only $315 a year? Would you? and if you take unemployment insurance and liability insurance into account, the company would make a loss. If you owned a company would you follow this business model? If you are - you might as well just give your money for free to all your employees.

    The only way you can get a company to keep $5/ hr and give you the rest is if you agree to a 1099 (and you cannot do that on a H1B - you need to use EAD for that). On a 1099 - there are other tax implications - now you have to pay both your share and the employer share of payroll tax (14.9%). And now since you are an independent consultant (which is what a 1099 is), you have to get your own Liability Insurance. To prevent people from suing you, you will need to form a LLC or some other type of corporation. You might want to get a good CPA to setup your company so that you can setup the right kind of company to benefit from the right tax deductions.

    There is nothing wrong in making more money - just like you want more money, the corporations are out there to make money too. No one is in the business for charity. As long as the relationship between employee and employer is symbiotic, all is good. Once the equation changes, it is either time for the employee to say good bye to the employer or for the employer to off-load the employee from the corporate bus.

    I have seen many posts in this forum complaining of "blood-sucking" employers and how they exploit employees. To me, that is the same as:
    - programmer's guild complaining about us stealing their jobs or
    - people losing their home and blaming the banks "for not disclosing terms"
    - anyone who is blaming anyone else for their troubles
    If you are being exploited, it is because you are willing to be exploited. Don't blame the employer. Blame yourself. If you don't want to pack your bags and go home when you lose a job and cannot get another one, don't blame the employer and tell others that they are "sucking your blood". Everyone is here to make money.


    I understand what you meant..i forgot to mention in my post that if i expect the employer to keep 5/- only then i will take care of running payroll(means pay ADP to run payroll). I will pay employer to keep my h1b status.
    I do understand there are expenses incurred on the employer side too.
    Also i will work with the vendor on EAD but on W2. So no worries about liability insurance. But thanks for your informative post. I need strong information like you gave so that i dont take a wrong step..

    This is B*^#S*&^. Take this to an attorney and see if it’s legally valid. I suggest you not to sign as he puts every possible issues and make you responsible for that. I never come across any agreement like this. Normally they ask only for non-competent agreement.

    Why do you care if the client does not pay your employer and why you pay for the recovery. Simply Blood suckers. Tell him that you can not sign as he did not inform you about this agreement in advance and its not fair.

    My H1B is valid till April of 2008. When i went for vacation and entered the country in March 2007, the guy at the border patrol did some mistake and put the date on I-94 as 16th sep of 2007 instead of April 2008.

    I tried to get it corrected at the local CBP office but could not do it ... So i am planning to make a trip to Canada before my visa stamp expries to get a new I-94 which is valid till April 2008.

    But since i have sent my passport for renewal, i am not sure if ic an make the trip bfr my I-94 expires.

    And also i am not sure if i can file for extension of my H1B as it is more than 6 months ( it is about 10 months eatly) before the expiration date on my current H1B.

    At this point i am helpless with out my passport. I hope i get it soon.

    So what i wanted to find out is, is my status still legal after 16th sep 2007 if i file my 485 ...

    Buddy, what were you doing for 40 days after your got terminated? If you knew it was coming you should have made efforts to transfer H1 or right after. If you transfer H1, then obviously INS will look for pay stubs etc from the last sponsoring co. Since you mentioned you never actually worked for them (if I understand this right) then you are in trouble. You can use EAD but you lose your H1 status. If you want to get back to H1 then you are back in the lottery mess to qualify for one. Obviously you need to decide what is important to you at this point. Marriage or your job/GC. Good luck.

    As everyone pointed out there are lot of things in favor of the employers, Attoreys & USCIS when I 140 is revoked. The only thing that comes to our rescue is AC 21 when followed as per the guideline which is currently not being done.

    Guys, Please support the IV AC 21 Campaign and let us help ourselves..

    like the historic successful flower campaign, can some one come out with a great idea to bring CIS attention to this issue? 'Satyagrah'??? Gandhi style fasting??? ideas?

    What happens to an employee at any company who has done something positive but has been caught abusing his colleagues a few times. He gets warned by HR first and then gets fired right.

    We have lot of things to focus on to get relief for our community and there is no reason to tolerate this behaviour towards fellow members.

    Did I mention EB cap in my earlier post? I mentioned CAP which does not conclude that it is EB cap. I went through the bill too.


    A ha! Now I see where the misunderstanding lies. And I do apologize if you got offended.

    As I wrote earlier my "bummer" post was specifically in response to your and whitecollarslave's posts about Masters in STEM. whitecollarslave's replied (http://immigrationvoice.org/forum/showpost.php?p=231838&postcount=5) to your post asking "H-1B cap or EB green card cap?" And so I replied expressing my disappointment with the bill that Masters in STEM were exempt only from the H-1B cap.

    You thought I was correcting you, but I really wasn't. It was my bad that I quoted your post in my response instead of quoting whitecollarslave's post. My apologies once again. Let's bury the hatchet.

    Well said !

    We all know this EB3-EB2 game is total non-sense and unjust.

    So many extra-ordinary people who could/should have been in EB2 are in EB3 simply because : corporate lawyer filed in wrong category, they did not want to work for a desi employer who would file in EB2 in exchange for a lot of things, they did not want to buy an approved labor and create fake experience certs/affidavits, or for various other family/job realated reasons which have nothing to do with his/her education/skills/experience.

    At the same time, a lot of street smart people got their EB2 labor/I140 approved while they worked at gas stations.

    In my opinion all IT professionals, MBA's, Lawyers, Doctors and all other BE/Btech/ME/MTech engg. should be in SAME category (EB2 or EB3). The only people who should be in a preferred category are the scientists who are actually working as research scientists for a govt or non-profit organization (not just anyone who bought a PhD from Dhanabad University for Rs 15000).

    If there must be EB2 vs. EB3 then it should be based on a well-defined, measurable and well followed criteria, for example a aptitude/IQ test, interview/GD, there are many other ways to cover all types of talents.

    Your situation is slightly different than many I have come across. If your qualifications, research work, project etc have unique qualities, then you may still have a fighting chance. But you may have to do a lot of homework: find out NIW holders in your / related engg field, ask a few lawyers: do not believe right away if somebody promises they could, try to enroll in as many professional associations as possible, enlarge your skill portfolio etc.

    BTW, is any degree of you from US?

    I do have a D70 as well as other AF and non-AF cameras and never had such problems before. I have backfocus-problems with all lenses on the D70. I ran some simple testing that confirmed this. In practice, this will only be a problem shoting faces wide open - but here, it's quite bad.

    I keep on hearing about cases of 2000 and before. Good luck to your friend. I am with PD Sep 2001 and I am too mentally prepared to wait for more years..:D



    I recently came across an old friend of mine. I was shocked to hear his case. He is an original applicant EB3 India with PD of September 1998. Please note he is the original applicant and this is not labor substitution.

    Here are the details

    Sep 1998 : Applied with Texas Workforce Commision as regular Non RIR.

    Oct 2001: TWC asked to do recruitment. No action was taken on submitting results.

    October 2006 : Labor finally approved from Dallas BEC. Concurrently file I 140 and I 485.

    Jan 2007 : I 140 approved.

    Nov 2007: Took Infopass appointment. Was told case pending name check.

    This case is absolutely amazing. My friend doesnt care anymore since he recently married US citizen (genuine case ABCD). He has worked at the same company since 1998 and stuck to stupid job (non IT). My PD is August 2001 and seeing his case I am getting mentally prepared for much much longer wait.

    The aim of participation on these talk shows is two fold- One to increase the awareness amongst the general masses regarding the problems being faced by legals as the masses are mostly ignorant about out situation. Secondly, for people who are waiting for their GC's and could be potentail members of Immigration Voice for them to join the organization. It has been proven time and again that there is strength in numbers and also the organization needs resources from it's members.

    It is a logistical challange to put a program like this together with the host and the panel and IV did a good job at it with knowledgebile authorities like Stuart coming out strongly supporting our cause. Every one felt that the moderation could have been better. It is the skill of Larry King or Neil Conan of NPR that sets them apart but some times there are moderators who are very knowledgible, not necessarily on every issue but are challenged becuase of their heavy accent and other reasons.

    One of the posts questioned about the publicity stunt of having a senator on the program. I am not sure if every one realizes the amount of ground work that has to be done to make that happen and must I say that all the efforts were made to get them but it did not work out finally in the end because of issues with timing.

    Over all, in my opinion, it was a good program and served IV's agenda.

    Never go directly to a bank for your mortgage. Let the lenders fight for your money! Plus mortgage companies will combine a few loans together, present to the bank and get a overall lower (group) rate.
