    Hi, here is my case information

    I-485,EAD, AP applied on 24th July, RN received today,PD May 2004 EB3, I-140 already approved
    2nd labor in PERM applied in early 2007, got it approved in May 2007, I-140 applied in PP in June and approved with the same PD as EB3 I-140 i.e. May 2004

    Now, my attorney is going to iterfile my EB2 I-140 today and according to him, my I-485 file should be updated in 3-4 weeks. Has anybody got it done before? If yes, please share.

    asking for donations is nothing wrong. After all Immigration voice is for everyone's benefit.

    I got an update via CRIS

    UPDATE: On August 5, 2008, we transferred this case to our NORFOLK, VA location for additional processing.

    My current status: My case was filed as EB2 and the PD is Mar2006, so I am current for another 6 days (Oct 2006 is retrogressing to 2003).

    I have talked to several of my friends and they said this update means an interview is in the works.

    Do you guys agree?

    If so, I had questions based on that. Me and my wife were planning to travel to India this December.

    1) Will I still be getting an interview since my case is not going to be current starting OCT 2008?

    2) In case we should expect an interview, should we wait till we finish the interview?

    Any input would be appreciated.

    While no doubt, getting PERM approved is difficult at this time, it's not impossible (I have a few close friends who got them approved recently in EB2 though they had to wait a long time for it) and giving it a shot is well worth it if things work out in OPs favor.


    I think ur friends PERM got approved becuase they filed before this economic depression. meaning, when the recruitments efforts were made for your friends case there is not much unemployment and might not have received any resumes. And I believe DOL check when the labor filed.. not current time.. while approving or denying it. So as some one mentioned now its not the case.

    Thanks for your post. It's good to hear the perspective of a core member of IV like yourself. I understand your point of view but respectfully disagree with your definition of the greatest good. The greatest good will not be achieved by just passing the labor cert. stage. The greatest good is achieved once we have the GC card. Your effort on retrogression to benefit 250k & 200k is plausible. But you help them to pass one bridge, to just get stuck on the next. If there are 25k people stuck in name check at this time, imagine what will happen when the estimated 200k-250k reach that stage.
    If the 25k spent in average 3 years in the name check, what will be the wait time for that massive population that are headed that way after retrog & labor cert? The EB process is a big picture and the greatest number will not get the greatest good until all these obstacle are resolved all the way to the end.

    sroym, i think the point stucklabor was trying to make is, that currently most of the people are stuck in retrogression and labour which makes things far more unbearable than actually having an EAD/AP and such benefits. There is a whole thread on this discussion where members of all nationalities have complained about IV not taking the FBI name check issue seriously. I think the moot point that IV core members are focussing on is, the fact that retrogression is making life unbearable for just about everyone. Plus given the following facts:
    1) A Serious Majority of the IV members are affected more by retrogression+labor as compared to FBI name checks. and
    2) IV core members have full time jobs and spouses and are working pro-bono for the good of everyone and money collected is also coming in slowly and thorugh the IV members themselves.

    These 2 facts mean that both time and money is at a premium and they have to spend it solving the problem they originally started to solve. Believe me, some of the core members themselves are stuck with the FBI name check issue for the past 2 years or so.

    Given all these facts, you have to understand where IV and it's mission/policy stands. To my understanding the policy is "One step at a time".

    You are right and I don't know the circumstances vicks_don had chosen to post this. As I posted elsewhere (http://immigrationvoice.org/forum/showpost.php?p=43868&postcount=662), now the time is ripe to act decisively.
    Note: I am posting this, one more time, in this open thread, as the above post is behind a login.

    A small step for special interests ... a gaint leap for us
    I had watched this forum growing by leaps and bounds over the past year. I personally know how the core group is acting towards our stated goals. Now an opportunity has come for us, the foot soldiers to act in unison. As the title of this post suggests, we will watch, observe how big brother is acting and will emulate the same.

    In this connection, I beseech (implore, beg, request, ask, entreat, plead, press, demand) to watch out the efforts to introduce / incorporate retrogression relief for healthcare in the coming days / weeks. Read the block quote in full and you will understand what I am saying.

    The government's current Continuing Resolution continues federal funding until February 15, 2007. At that time, another funding bill must be passed. Similarly there is an Iraq War funding bill set to be acted on this Spring. Legislators have traditionally allowed urgent legislation to be attached to funding bills like these.

    We have made inroads with many of these members' staffs. A personal relationship with one of the Senators would likely be enough to secure a Schedule A retrogression amendment as an attachment to one of these two bills.

    The current strategy is to obtain a small Schedule A retrogression amendment (anywhere from 15,000 - 90,000 visas) in the Spring; we will then push for a permanent Schedule A retrogression amendment (Brownback amendment) whenever Congress considers Comprehensive Immigration Reform. Our contacts tell us that Congressional leadership is willing to allow the Brownback amendment as part of CIR.

    But for now we have this small opportunity to secure 15,000 - 90,000 visas. Please contact Chris if you have any personal relationship with these Senators or even their most senior staff.

We will write to lawmakers, our employers, particularly the big and kind corporations, we will write letters to editors. Let's mount one more coordinated effort on this front.     Your 797 approval notice will have updated I94 which will supercede your previous I94. The new attached referes to your 797 number starting with "RAC" or "WAC" like that.
    You need to submit this one too along with any old ones you have when you leave the country.

    I am confused because I read that you have to declare any foreign accounts held.

    This applies to US Citizens ...it may apply to you if you already have your green card...but i am not fully sure about this....and i am quite sure it does not apply if you are on a work visa

    IV should publish backlog examples such as this one to the media. This person has waited for over 7 years to get immigration benefits from the govt!!

    Maybe I am missing something here but the green card for this beneficiary was started in 2005. The PD of 2000 is due to a labor-substitution. Aren't those the facts here?

    You need to have your old I-140 approved to port PD to your new I-140. If the old 140 is not approved by the time you file you new 140...thats fine. At a later stage when your old 140 gets approved have your lawyer send a letter to the processing center with PD porting request for the new one. At that time your new 140 can be in processing stage.

    Hope this helps.

    My Old I-140 (EB2) from previous employer is already approved but i left that company and joined a new company. I checked status of my Old I-140 online till today it shows approved and i have the original copy of my Old approved I-140. So the question is do i need to send a letter for porting the date after new I-140 is approved or the letter can be sent along with the application for new I-140. OR file new I-140 and later on send a letter to port priority date.

    Second option that comes to my mind is, joining the previous employer again next year... but i am still thinking about that, i am already in my 5th year of H1b.

    Having a special quota for masters or any other criteria would be absolutely beneficial as long as it does not come from the existing quote (like adding 20000 for Masters on top of 65000). Having any additional numbers would significantly reduce the stress on the exciting queue. I do not think there should be any reason why anyone would object. If we can get any reason to add additional numbers, that should be welcome. Several other reasons can be there including the founders visa which was talked recently as long as they are additional numbers.

    The Immigration and Nationality Act (INA), the section of government law that guides immigration, specifically states that any non-immigrant alien visitor to the United States must have a passport that is valid for 6 months beyond the intended period of admission. That is to say that if your program or employment runs until May of 2008 you must have a passport that is valid until at least November of 2008. If the alien visitor is from a country that is in agreement with the United States to automatically assume that the alien's passport is valid for 6 months past the passports expiration. These countries are referred to as 6 month countries. That simply means that if the alien is from for ex. India and the passport date will expire before the end of of program date, officers are allowed to make the I-94 valid until the end of the passport. If the alien is not from a 6 month country the officer can only admit the alien with an admission date on the I-94 with a date that is 6 months before the passport expires. Officers at airports and deferred inspection offices do not have the authority, at a later date, after a new passport has been obtained, to change the original I-94 to the date that would have been given at the original time of entry had the passport been valid for 6 months beyond intended period of entry. The alien must request an extension of stay with an explanation submitted to the USCIS office, no fee is required, and a new I-94 with the appropriate date will be issued. However, if you call USCIS and are fortunate enough to get to speak to someone, that person, an information officer, with 2-5 weeks training, will tell you a CBP Officer can change it. Some officers will change the I-94, however, they have no authority to do so and can face penalties for doing so.

    ETIN is a MUST for any company to pay a different company. Remember, when Company-A pays Company-B, Company-A shows that amount as EXPENSE (or Loss) on their tax filing. So, if there is loss somewhere, there must be a profit somewhere. Therefore Company-A will show that the expense or loss was due to paying that amount to Company-B.

    IRS does not care about names, it identifies companies and individuals only by numbers (SSN, ITIN, ETIN, etc.)

    1. not sure about this...normally you need a SSN or TaxID to open a back account here...however some banks dont require it...which is what illegal immigrants exploit.
    so if its done without a SSN or TAXID then you may get away without paying tax.
    However some companies wont pay you if you dont have a TaXID or SSN

    2. worst of the 3 ideas...cause u will be paying individual tax rate...of around 30% or more

    They should also allow people from Backlog Centre (PD 2001-MARCH 2005) to file 485. Looks like they really cant make any impact. How many more years to wait just to file 485 ? Oh Gosh....

    Come August, all dates will be current again and you should be able to adjust.
