I had applied for I-140 Dec last year(2006) EB3 and was checking for update and found that an RFE has been sent on Dec 12. To whom is RFE sent....My company had done all the paperwork...is it to our company lawyer or me....Please advise

Thats nice pattern for EB2. It jumps almost 2 years ahead from July VB to Aug VB. Lets hope this pattern continues for 2010. Lot of EB2 folks will be happy with this pattern.

I had similar issue with my spouse H4, then I applied her H4 again before the I-94 expires on the pass port. In my case (h4) costed only $200, I didn't wanted to take a chance then applied and got the extension. If you want to safeguard your status, you better apply for H1 extension, if it is really expiring they will extend your H1 otherwise they might return saying you cannot apply for extension prior to 6 month of expiring.
So decide yourself, don;t ask peoples opinion too many times, you always get mixed results.
NOTE: according to my employer, I-94 given at the POE super seeds all the other form of I-94.
I visited my local USCIS office and the officer told me that they don't do I-94 updates and asked me to contact the CBP office. When I called them up to get an appointment, I got transferred to a lady who asked me the details. After listening to my case she said its perfectly okay and asked me to attach the new I-94 from the 797 to the passport. Is this true?
I am trying to get hold my lawyer but in vain. Please help!!!

IMO, there could be unfortunate situations for anybody which may seem to be like one will go out-of-status. Best option is go to a good attorney. It is not cheap option but certainly it is best way to get things answered professionally within a specific time period. It will also prevent your case to be wide open on forums for any agency or anti-s to target you. You will also be protected by attorney client confidentiality agreements.
I saw some questions like "I am not working on H1B though I have visa. Or things like "I am not paid on bench. Is that alright". Does it need anybody to confirm that you could be out of status? Quite naive to ask that on forum.
Best option, do not violate any law intentionally. When we take so much care by not even jay-walking, we should be super careful about the immigration laws and statuses.

IV is not an Indian organization. If this is one of the reasons why few non-indian members are not making donations then please re-consider your decision and start donating.
Also let us not dillute our fight by expanding the fight to include other problems. Once we achieve desired results, we can continue to pick up other problems and lead the fight.

As a non-indian joining IV lately, I feel IV is more an indian organization. I had communication with one of the moderators (core members of IV) and he clearly stated that retrogession is in IV's agenda, but FBI name check is not in IV's agenda as an organization. How come retrogession which is mostly a problem for indian immigrants in the agenda of this organization, but FBI name check which is a problem for most nationalities not in the agenda of this group(maybe with the exception of Europeans)? There are over 100 members at a yahoo group, and some more registered at an immigrationportal forum with common problem of FBI name check, cases delayed for 1, 2, 3 or more years because of name check. The registered use names suggest that there are from all over the world, yet no core members of IV is caring about this matter with the exception of one person who scheduled a conference call with an attorney in PA, but did not help any more. Sorry about my humble sincere feeling.

Funds are really needed but another important thing is to leverage the momentum obtained due to CIR and more recently July Visa fiasco.
I think iV should aggressively focus on recapture of visas, 1 visa per family(Hillary Clinton already supports us on this and we can rope in Zoe loe****
who supported us now) and also removing country based limit.

While having Vayalar Ravi talk to US Govt. on social security taxes is a good idea having him talk about retrogression is a very bad idea.
Permanent residency and retrogression are internal affairs of US of A. USA and USA alone will determine who gets their PR and citizenship. Any foreign official touching that subject will be seen as infringing on this nation's sovereignity.
During the 60s USA wanted lot of doctors and imported them from India. Later on they started producing their own doctors and we know how difficult it is for an Indian doctor to emigrate now. I suspect computer programmers are the next. The current focus is on importing nurses and when they have enough nurses they will have the same problem..... Isn't life very fair ?

im 17 and have my first "job" or request as its gonna b for free to giv me sum experience.. plus i work for them!! (part time as im in my penultimate year at school with no intentions of goin to uni)

We have 8000+ members but only 200+ contributed. I have been thinking about it and here is one possible answer. If you look at the poll result about whether we should push for 485 or not, there are about 280 guys supporting this goal. Maybe almost all recurring contributions are from this group. :confused:
I did not follow the I-485 filing debate; it was sickening. I made a one time contribution. I don't think I am included in the 220 count. I think there are very few members who have made a one time payment recently and are not included in 220.
I think, the count 220 includes only recurring payments that started this month. Some persons paid before this count started.
The only useful thing we can do is to work on contributions. It is hard to figure out reasons why persons are not paying. I think it will be useful if we guess all possible reasons and work on all of them.

2. What is lost if a non-paying member leaves?

Please explain what is student status and 221g. You mean , if you are student of any intitute in US, while your I-140 is approved?
I was here on F1 first and then converted o H1. I went for a H1 stamping after about 5years. Student status refers to the status of the F1 visa. They usually track it using SEVIS. My bad luck since SEVIS was not up that day or my name was not showing up since I was a pre sevis grad enrollment. 221g is a document they hand out if they cannot issue a visa due to lack of documents or need to no further administrative processing like verify employer/status on a visa etc. You need to either appear again before the consulate or they get back to your later. My case was a nightmare and I dont plan to ever go back again to India period. Guys do your research on the web regarding 221g do travel plans accordingly!
