Has anyone considered the implications of identity theft, fraud etc if the USCIS does start returning the adjustment of status applications? When my daughter applied for adjustment of status a couple of years ago her application was rejected erroneously and returned to her. When she opened the package, it not only contained her information, but also someone else's highly confidential and personal documents. The documents were completely mixed in with hers - all out of order - and even the other person's check was returned to her. The person's case was also very time sensitive and of an extremely confidential nature.
We gathered up the information and personally returned it the local USCIS office - who told us it happens all the time! We sent a letter to the person concerned telling him what had happened and advising him to contact the office immediately.
Imagine what might happen if the USCIS starts returning the 1000's of July applications. There is a good possibility they could mix up applications, return them to wrong addresses or lose valuable paperwork. They certainly won't return applications via Fedex or UPS - they'll just throw them in the mail without any way to track them.

USCIS have reviewed my application in October and in February for pre-adjudication. How I am sure about that is because in Feb my wife got an RFE for Medical and mine was fine. Unless the primary is fine they will not touch dependent.
I got an RFE for medical and my wife got an RFE for "Status during a certian period" last September at the same time. We replied to the RFE and the case status now says "Case Resumed...." for both.
Since my wife(derivative) had a RFE, can i take it for granted that my case is pre-adjudicated?

I did not understand the "time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS" part.
My situation is as follows - My I-140 is approved and judging by the current situation my child will be above 21years (currently on H4) when visa becomes available.
My questions are - Will I be able to extend my child's H4 beyond his 21 years, assuming I continue on H1? And will I be able to adjust my child's status when visa becomes available?

It seems that a solution to a case like that would be the SKIL bill or an amendment to this existing H law, not Dream Act. I understand a person in that situation that would be desesperate for a solution and it would embrace whatever it comes on your way, but we have to admit that there are implications behind the scenes if such Dream Act is ever granted. We shall resist that temptation to join that crowd, especially because in my view that just irates immigration reduction groups even further. For that reason, why don't we focus and continue to fight hard for bills which address specifically our problems.

I think we need to clarify that Reid and Pelosi are independent and not related in terms of setting up a debate. Pelosi is in the Lower Chamber - House of Representatives, Reid is in the upper chamber - the Senate. They do not have influnce over each other in terms of scheduling and the rules, etc. Pelosi is the speaker of the House, Reid is the Majority leader in the Senate (there is no speaker in the Senate). In the Senate Reid is the one who calls the shots in terms of scheduling, but it has to be on a bill proposed in the Senate (not the one propsed in the house), although the texts could be identical it is still a separate bill with a separate number. Based on the rules such bill may have to go through a comitee first (Judiciary perhaps). As for the House I believe Pelosi has lot of say when it comes to the agenda. However if it has to be the majorty leader of the "House", than it would be Stonie Hoyer.

Well here is what I have thought of doing if I get into your shoes when I140, US GC looks dicey. (I already have Canadian PR till August 2010).
I would take a three/four week vacation and go and live there. Prepare for a job and get first hand ground feeling of what it feels like living in Canada, make a living and raise a family. After all making a living to able to support yourself is a important corner stone thing. You can't live of fresh air.
Can you compare your situation ? No. You are not the same nature, skills, personality, intelligence and willingness as others and most of all your own Luck. You know yourself best and the only way you can tell that the place will work out for you is when you go get a sample for yourself and your gut feeling. I went to Vancouver and just loved the place. My wife saw the clouds and gloom and hates the place (spoilt by southern california). You will be your best judge.
Take the harshest sample: Winter is tough in Canada. Go now and take a feel of what you will be expecting and set your expectation.
Info: Approx 90% of the Canadian population lives within 100-200 miles north of the US border.
Down the road: Make a plan and see whats your options down the road. Looking back is no good way of planning for the future. 3 years + few months, you can be Canadian Citizen. You have then the option of using TN and come right back into the USA, if you even have the need. Looking back now I feel I should have started this journey 2 years back. In the next year or so I would be a Canadian and could have come right back without the 140 and 485 headache. After two years I am still holding my breath for 140. Rightfully, Heaven is where I feel at peace. US has made me feel miserable and bitter after 9 years of rough rollercoaster and no end in sight. Can't buy a house, can't live freely, always on the edge and mercy of the Boss and H1B.
Having Canadian PR in hand is like having a bird in your Hand, and US GC is like two birds in the bush (I feel the birds are in Bush in Texas :) and its going to eat me, rather than I eating it) You don't even have the US Bird in sight and the story is getting tougher....

Just to piss u off, i am requesting again to all the folks to send letters.
Well, you have not pissed me at all. I did what IV had asked in one month back. I had sent my 2 letters (me and my wife) 17 days back and collected another 12 letters from friends and send them too. I had contributed what ever IV had asked until now, what ever it may be.
I am sorry, but just a note can baffle you guys and you put all the -ve comments to the post, then sorry to say you guys cannot take any constructive opinion from others. And I think I did no wrong in asking Chanduv to stop posting innumerable threads just for one cause.

I believe my situation is a lot similar to man-woman-and-gc except maybe that I am single. This is what I have achieved so far after sticking to Company A for 4.5 years (this one was pretty big in size; so didn't have to worry about any paperwork):
1) I-140 approved in August 2008 (total of 198 days till date i.e. March 5th 2009)
2) I-485 pending since July 2007 (USCIS receipt date of September 29 2007)
3) EAD valid till October 2010
4) H1-B valid till October 2010
5) PD: Feb 2007
However as a preemptive measure against any potential layoff from company A, I have started looking around. I am preparing a checklist of things that I have to inform the other companies (say company B) so that the transition is smooth. The 2 main things I can think of to talk about with any potential employer are:
1) I DEFINITELY want to maintain my H1-B; so they will have to transfer it. I will be pushing this to make sure I have the flexibility to get a dependent at any time
2) They will have to help me MAINTAIN my GC process. For example any minor changes in the position requirements to show that the job is similar or same. Thats one reason I am primarily looking at similar work profiles
I would GREATLY appreciate if someone from this thread can point me to any location or list out the things that I should be extremely careful about or notify to both my previous employer and the future employer to avoid any future pains in my GC process. A few things that I remember are as follows, but please provide more information that may be missed out here:
1) Do I have to ask Company B to apply for anything relating to my GC? I want to make sure that they know and agree to all costs associated with the paperwork? Dont want to end up paying from my pocket as I have heard in a few cases before
2) I believe since my I-140 is approved for more than 180 days or actually my I-485 being filed for more than 180 days, I am allowed to move, correct?
3) Since my I-140 is approved and I have an EAD, can USCIS/Company A cause it to be revoked? OR it doesn't apply to my case?
4) Do I need to ask Company A to maintain anything? Or just keeping good relations with them is enough :)

Hi All,
Its seems that my approved EAD card lost from mailbox (seems like post man delivered it in diff mail box instead of mine).. It�s been more than 15 days of approval but no card in the mail.
I contact customer service and they said wait for 30 days otherwise file new one. I am not sure what are the option I have if I won�t receive my card on time? My existing EAD is expiring within next 25 days. Is there any way that I can get my card back or USCIS issue new card without filling new one?

Did you join them on H1B and then move to EAD? Did you change your I-9 form when you did that? If you didn't, as far as they are concerned, you might still be on H1B and so they might feel a need to inform the USCIS. If not, well, there really is nothing in the rule book that says they have to inform the USCIS that an EAD holder left employment.

By the way, friends, I stay behind my words. Last year my family and I started working on "plan B" and when time comes, we will move out of the US after 6-7 years chasing of a mirage. Of course, if the GC mess here miraculously improves we would stay but I must be crazy to really believe that.
Anyhow, everyone has to choose individually to stay and wait or to "vote with the feet". We all know it is a tough and painful decision but for me this is like a rotten tooth - the sooner you get rid of it, the better. Just my way of thinking.
Our "flirt" with the US immigration system resembles very much the unshared love - you love a girl and do everything for her but she is a spoiled bitch and just plays with you. Some people will never stop circle around this girl but other will finally get pissed off, will say the f-word and will move with their lives. Suddenly these people will discover that there are lots of other girls, honest and thrustforthy, who deserved to be loved. Voting with the feet... :-)
