    HI Ivar,

    So in your case, did your older employer cancel or withdraw the I - 140 or it was active. Do you know if you can still port the priorty date if the I140 is withdrawn by the older employer. I have looked at most of the forums and haven't found a concrete answer to this question.

    Also the best person to consult would be your lawyer as to whether u might get an extension to file your reply.

    I recently came across an old friend of mine. I was shocked to hear his case. He is an original applicant EB3 India with PD of September 1998. Please note he is the original applicant and this is not labor substitution.

    Here are the details

    Sep 1998 : Applied with Texas Workforce Commision as regular Non RIR.

    Oct 2001: TWC asked to do recruitment. No action was taken on submitting results.

    October 2006 : Labor finally approved from Dallas BEC. Concurrently file I 140 and I 485.

    Jan 2007 : I 140 approved.

    Nov 2007: Took Infopass appointment. Was told case pending name check.

    This case is absolutely amazing. My friend doesnt care anymore since he recently married US citizen (genuine case ABCD). He has worked at the same company since 1998 and stuck to stupid job (non IT). My PD is August 2001 and seeing his case I am getting mentally prepared for much much longer wait.

    Yep. Paid Time Off (PTO) - This will allow me to get regular checks until PTO is exhausted.

    Actually, my question is it LEGAL to work for the New employer (After filing H1B Transfer and getting the receipt) when on PTO (Paid Time Off) with current employer?

    There was discussions in this forum on working multiple jobs on H1B. Murthy claims you can as long as you have an H1B petition for each job. http://www.murthy.com/arc_news/a_h1faqs.html

    But, if you already have the receipt for the H1B transfer for the new job, why bother too much. Ask your employer if they would just pay your vacation time, and start the new job.

    "invoke AC21 without waiting for six months" - I completely agree , that is a great idea if IV feels it is not asking for too much in one bill.

    I think its good idea to try to add just one demand i.e. I-485 filing provision without current priority date into Supplemental resolution bill. But I think it will be really nice to try to get ability to change employer without waiting for six months(after filing 485) into the bill also. So that person can invoke AC21 without waiting for six months. I think both of these provisions go hand in hand.

    Does anybody know when the next session is starting and when are they going to start discussing this bill and when will we be able to find out if our provisions are there or not?

    Immigration Reform Efforts Begin Anew in 110th Congress
    01/22/2007

    Shortly after Congress convened for the 110th Congress on January 4, 2007, Majority Leader Harry Reid (D-NV) and Minority Leader Mitch McConnell (R-KY) both expressed their respective desire to pass comprehensive immigration reform legislation. Majority Leader Reid introduced Senate bill S. 9, Comprehensive Immigration Reform Act of 2007, to indicate the Senate's commitment to address the issue this Congress. S. 9 does not actually include any actual legislative language. Instead, it contains a "sense of Congress" that Congress should pass legislation "to provide for more effective border and employment enforcement, to prevent illegal immigration, and to reform and rationalize avenues for legal immigration." S. 9 sets the tone for future legislation, which is expected to come from the Senate Judiciary Committee.

    Additionally, Senators Diane Feinstein (D-CA), Larry Craig (R-ID) and a group of bipartisan cosponsors introduced S. 340, the Agricultural Job Opportunity, Benefits, and Security Act (AgJOBS). AgJOBS was part of the Senate Comprehensive Immigration Reform Act from last year. The bill would create a "Blue Card" program, under which agricultural workers who worked the lesser of 863 hours or 150 days in a two-year period may apply for a Blue Card within two years of the bill's enactment. The Blue Cards would be encrypted with biometric identifiers, and would be machine-readable. Furthermore, the worker would be able to adjust to permanent resident status by working at least 100 days for five years or 150 days for three years.

    In addition to AgJOBS, Senator Feinstein introduced, with Senator Jeff Sessions (R-AL), S. 276, the Passport and Visa Fraud Prevention Act. This bill would add a new, criminal ground to penalize trafficking in 10 or more passports, U.S. or foreign, or visas with a maximum term of imprisonment of 20 years. The bill would confer extraterritorial jurisdiction over these offenses, meaning the United States could prosecute individuals who may have committed a passport fraud crime while abroad. In addition, the bill would criminalize the actions of those sham attorneys and others who engage in schemes to defraud foreign nationals based on immigration laws. Furthermore, the bill directs the Attorney General to promulgate regulations to ensure that the prosecution of these crimes is in keeping with current U.S. treaty obligations relating to refugees (which states that refugees carrying false passports should not be prosecuted).

    In the House, Representatives Howard Berman (D-CA) and Chris Cannon (R-UT) introduced H.R. 371, the companion bill to the Senate's AgJOBS. Representative Jo Ann David (R-VA) introduced the Intercountry Adoption Reform Act (ICARE) of 2007, H.R. 120, which is intended to facilitate overseas adoptions by American parents. Representative Philip English (R-PA) introduced the Secure Travel and Counterterrorism Partnership Act, which would expand visa waiver privileges to nationals of countries that are allies of the United States in the war on terrorism. Representative Elton Gallegly (R-CA) introduced H.R. 133, Citizenship Reform Act of 2007, which would limit citizenship by birth to children born to at least one permanent resident or citizen parent. Representative Gallegly also introduced H.R. 132, which would impose criminal penalties for those who unlawfully reenter the United States after having been granted "voluntary departure." Finally, Representative Gene Green (D-TX) introduced H.R. 147, which would exempt elementary and secondary schools from the fee imposed on employers filing petitions with respect to non-immigrant workers under the H-1B program.

    Several members of this new Congress offered bills on immigration enforcement. On January 9, the House, as part of the new leadership's 100-hour agenda, passed House bill H.R. 1, a bill implementing the "9/11 Commission" recommendations, by a vote of 299-128. Chairman Bennie Thompson (D-MS) of the House Homeland Security Committee introduced this bill that would, among other things, appropriate additional resources to the Human Trafficking Center and also establish a Border Intelligence Fusion Center Program. Other enforcement bills introduced in the House include H.R. 26, Criminal Alien Accountability Act, introduced by Representative Darrell Issa (R-CA) to establish minimum prison terms for specified categories of criminals re-entering the United States after having been removed previously. Representative Roscoe Bartlett (R-MD) introduced H.R. 78, American Child Support Enforcement Immigration Act, which would bar family-based immigration petitions by one who owes child support.

    Worksite enforcement also received early attention in the 110th Congress. Representative David Dreier (R-CA) introduced H.R. 98, Illegal Immigration Enforcement and Social Security Protection Act of 2007. Representative Dreier introduced the same bill in the last Congress and the House Judiciary Committee held a hearing on the bill in 2005. The bill would direct the Social Security Administration to upgrade the technology for a new social security card made of durable plastic that would contain anti-tampering technology and a magnetic strip that employers could scan to check employment eligibility against an "employment eligibility database." All those seeking employment, including U.S. citizens, would be required to hold such a card. Employers using the system would have a good faith defense in cases concerning the inadvertent hiring of illegal workers. While enforcement proponents supported the bill last Congress, it did raise concerns among the privacy advocates. In addition to H.R. 98, another bill dealing with worksite enforcement was introduced in the House. Representative Ken Calvert (R-CA) introduced H.R. 19, which would require employers to participate in an electronic employment eligibility system. The bill would phase in compliance requirements over a seven-year period, according to the number of persons employed. The bill would also establish sanctions for noncompliance and provide for voluntary participation by entities not required to participate.

    Notwithstanding the number of bills that have already been introduced this Congress, most observers expect an effort in both the House and the Senate to include all immigration legislation into a comprehensive reform package. If, as expected, the package resembles the bill that the Senate passed in May of 2006, it will include provisions for border and interior enforcement, sanctions against employers who hire undocumented workers, legalization of the currently undocumented, and admission of new workers of all skill levels, including highly-educated professionals. More details about the Comprehensive Reform proposal is expected to become available soon.

    The majority of lawmakers agree to address these areas in the comprehensive reform bill. However, there most certainly will be intense debate, as occurred in the last Congress, regarding its details. While the debate last year focused mostly on whether and how to legalize the undocumented, the debate this year--because of the new majority--may shift its focus to whether and how many new guest workers to admit in light of concerns raised by organized labor.

    It is not about money. I have absolutely no problem giving even 100$s per month for the cause if I know how my hard earned money is being spend. Actions like deleting threads, banning users just for asking reports, makes people uncomfortable.     Well they will ask for police clearence form every country where u have stayed for 6 months or more after age of 18.
    So if he/she stayed for less than 6 months in singapore then its not even needed
    It is more than 6 months...and they started asking for Singapore Police Certs in early or mid 2005, before that they would check those out themselves..they may well still do that but ask for them inadvance now.

    Thanks, But how would I know the case number? Because it was filed by my company and I dont have any clue.

    Hmmm that makes it a little difficult. All you have to go by is the employer name then. Hopefully not too many people applied at the same time as you with the same employer. In my case, My company had provided me the case number to track the case soon after applying (before approval) but in any case, mine was the only LC they had applied for (they are a small medical device research company), so I did not have trouble.

    Also do you think there is any value in at least getting total number of LCs certified, by date and then basing our assumptions by proportioning how much each category is retrogressed? If we can actually get the real number and then making certain assumptions might still be more realistic than now when we dont know anything about how many LCs are in the queue. We might as well assume that those whose prority date is on or earlier than the certified date are approved (even if they are not) because they should be getting approved in a few months time. Especially EB3-I as I dont see rampant jumps in the priority date, you know what I mean?

    That is certainly doable. I am not a programmer per se myself, but have diddled enough in databases to try and take a crack at it. I will see if I can find the time to do this.

    It is true that the community colleges(A) and Arizona board of regents(B) set the guidelines but they have to follow Arizona Statutes which state that people with lawful immigration status are entitled to instate tuition. Therefore if (A) and (B) are not on the same page one could raise questions.

    I am providing below the statutes as well as what the Arizona Board of Regents say. It appears that the Board of Regents do not provide clarity on the issue. I think one could force the issue and demand that they be given instate tuition as provided by the Arizona statutes and Board of Regents Interpretation.

    In fact GC Card Dream should file an appeal to the Board of Regents as provided in their policy. Adding that community colleges allow H-1B's to avail of instate tuition would help get a decision in your favor.

    As required by A.R.S. �15-1803, a person who is not a citizen or legal resident of the United States or who is without lawful immigration status is not entitled to classification as an in-state resident.





    I don't think the state is involved, but its the institution that makes its own set of rules. All the community colleges in the state of Arizona accepts both H and L status as proof of residency.

    We emphasized the following points

    We quoted our personal life experience and the hindrances we encounter in our career growth.

    I have to say the points were observered with a positive note. and the staff said that these will be conveyed to the Senator.

    He also suggested, to contact the media, which we are doing and also told,
    he was also aware of immigration voice and its good doings.

    He also told the Senator voted in favour of CIR 2006.

    He suggested having a direct meeting with Senator would definetly help, as it would have a better impact, but he said that it would be easy to get an appointment of the Senator in DC. At this point, we have requested the immigration voice DC members whether they can have an meeting with the Senator and we can arrange the same with this staff member.
    He also requested, if any of our member are meeting with the same Senator office staff in different location(Detroit, Grand Rapids,Escabana etc), please refer this staff name for continuity reasons.

    I will be sending a Thank you letter soon to this Staff.

    Which number do you want ,their bedroom line or the personal cellphone number or their GFs with whom they got extra marital affair.

    Gangu bhaiya, Like I always tell my team members, there are 100000 excuses you can make for not doing the work , but if you really wanna do it, you will do that no matter how..

    The leaders in the meeting are public figures their numbers, faxes is published everywhere.. if you really wanna do it ,go figure.. you are in US for so many years waiting for your GC, and you need to be spoon feeded.. why? Please get over it and fight for it yourself.
    If you call them or fax them you will be doing it for yourself and favor to no one else. This is our struggle for ourselves. I am not a saint or mahatma to fight for somebody's else's cause.. I am fighting for MYSELF. But doing it with everyone, who share the same cause to make an impact.


    I am asking people to think before acting.

    I am not opposing webfax. I am opposing webfax you are sending to promite illegals. These organizations are going to use you to market them self. Secondly nobody is going to read your fax if you even change the words.
    Organizations supporting illegals will do nothing for legals.
    If you think that by changing the words , you can use their fax to spread your message, then why dont you go to anti-immigrant websites and change their words and send faxes to support legals. You will not do it because you know anti-immigrant is written on top of the fax.
    So why do you want to become a puppet of someone else.

    psaxena if you really want to do something, how about collecting the names of all the people in the meeting and post their phone numbers on the forum. Then tell us what to say and we will all call their offices now.

    I think they may make a strong fight back with the D70, that looks like a lot of camera for a great price.
    Absolutely, D70... looks like a good camera and nice features, but uglier then a hat full of spiders. It looks like the sigma! bit more effort in the body design department wouldn't have gone astray. Its the Volvo of the DSLR world.
