If you resign you will loose your PD and thus GC. The only option is leave of absence.

Anyone who had good knowledge of AC21 same/similar, please reply.
My original labor has an annual salary of 50,000. My current salary is 95,000. I got an RFE to provide EVL. My job duties are mostly similar to that of the original labor. However job title is different.
is this a problem? My attorney is saying the salary differenence will cause an issue. He is asking me to convince my HR to add a range 50,000 - 95,000 as my salary, which i am sure my HR would be against doing that as it is a big company. I don't even want to ask them since they might think i am trying to do some kind of fraud and raise a red flag.
is there anyone in the IV community who had successfully used AC21 with a considerable difference in salary?. Please respond with your comments.

Not simply because she applied for her SSN.
The EAD kicks in, once her employer fills out her I-9 using her EAD as permission to work inside the US. If she holds multiple jobs, then entering EAD into one I-9 will mean she has to ensure that she has all her I-9s from all employers updated to the EAD.
At this point, the H-1b is no longer used, but does not get cancelled (unless the employer revokes it). It just goes dormant and can be revived again by filing an extension. Another way is to go out of the country and return using the H-1b visa.

My PD is Feb 2004, so I've been current for almost 2 months now. Though, my ND is 9/12/2007 and NSC is processing 7/14/2007, so that's not current yet...
Receipt date and not notice date is the factor.
Also, NSC has been processing even people with October notice dates and appoved people with current PDs.

These are just guidelines from a law firm. Most of the law firms were making money in porting cases for last two years, as number of new applicants were less due to economy. That does not mean that USCIS is going to approve these cases based on number of years of education. Porting within a company is a risky deal. Even though lawers dont make it sound like a big deal, for getting new clients. The old eb3 job that was used to file the first labor needs to be filled. If you are working with a desi bodyshop, be careful. You are inviting an audit.

Finally I gave a thought to all this GC business and I am planning to start my Canadian PR too, here are my questions :
1. Does anybody know of any good immigration cunsulting company for Canadian PR processing ?
2. How much would be the total cost to get it done throught the consulting services ?
3. Are there any hidden costs which these companies tell you at the end and try to rip you ?

well companies will put the burden on u to get 7 in each section.
So my advice is u first get 7 in each section. Then only u will know if u

When we apply 1st time they are asking all the documents which is fine.
When we apply Extension they are asking all the details with Paystubs,client letter.
When we apply Transfer they are asking all the details with Paystubs.

3. Pay stubs are needed so as to prove that beneficiary is maintaining valid H-1B status when another H-1B petition is filed.
4. Client Letter is needed so that Employer (petitioner) can demonstrate that the proffered position qualifies as a specialty occupation, or that the petitioner has complied with the terms and conditions of the LCA.

Hi ,
I received RFE on my I-131 application asking for all the I-94's that is being issued to me.
I had been in and out of US many times and there's lot if I-94's involved and I don't anything with me except the latest. What options do I have?... Also couple of times during my earlier trip (initial visits in US), the AIR Line didn't even take the I-94 from my Passport which ultimately I lost.
My Passport has all the entries indicating my Date in and Date out...
Gurus - What do you advise on my case...
Anybody's input are highly appreciated and I know we could somehow get the I-94 copies by requesting USCIS. (That is time consuming)... I have to respond in next five to ten days...
What options do I have?...

My "bummer" post was specifically in response to WAIT_FOR_EVER_GC and whitecollarslave's posts about Masters in STEM. I read all the three bills and I stand by my statement that Masters in STEM are exempt ONLY from the H-1B cap; not the EB cap. (line 14 on page 2 of H.R. 5630 (http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=110_cong_bills&docid=f:h5630ih.txt.pdf).) It is only the PhDs who are exempt from the EB cap.
Before you start throwing "smart alecky" comments at others, please let me know where it explicitly says otherwise. Don't show me anything about PhDs; ONLY Masters and EB caps.
I (and probably others too) thought this was the STEM bill being reintroduced which deals with EB caps. But it is not, hence the disappointment.

That is expected based on the number of I140s that would have been approved and ready for adjudication. Also, with priority dates moving forward, more applications from earlier dates come into play and the processing dates move back.
Hopefully, they start moving forward soon and go over the July / August 2007 hump.
