On papaer it sounds like a very good idea. I have canadian PR and I was also very tempted when I read this. But here are some disadvantages:
1. Windsor is a small place so hard for wife to find a job there.
2. Schools may not be the same quality as Toronto.
3. You might be putting your career in holding mode for another 1-2 years whereas you could do a much better job in Toronto.
Basically, my point is in order to try to wait for GC for another 1-2 years, you might have to compromise with your job/wife's job/kids education. I am at a point where I don't want to compromise with any of these if I move to canada. I want to make full use of the freedom of having a PR (take up whatever job/start a business/have wife take up whatever job/good school for kids etc)

I spoke to our immigration lawyer today.
He said that entering on h1 while I have a pending 485 does not affect the 485 in anyway.
He advised that I enter on h1 even if I have the AP.
you can enter on H1. There is no issue with it.

I just applied to lending tree on wednesday for 450k loan. Still nobody contacted me :(. I have an excellent credit history and me and my wife both are using our history to apply. Finally looks the market is really tight in credit. Last time I applied for auto loan I got replies in couple of hours.
Good luck. I am still hunting in NJ and want to get preapproved.
I few months back got it from Wells Fargo. 100% loan, no PMI, 7.25%, 30 year fixed. I heard they have stopped 100% now. You need to have atleast 3% down. I know it is towards the higher side but I want the safety of keeping the money in my account while we go though his rough economy.

Your status is in no way tied to the validity of your passport. Making I94 expire with passport is not legally justified. I know two friends who have I94s expiring beyond their passport expiration date. Also, last time I extended my H1B, the I94 they sent expired 11 months after my passport expiration.
But as is usual with USCIS and CBP, different agents behave differently. Some give you I94 expiring 10 days after H1B, some the same day. They are rarely consistent.
If you think USCIS is crazy, wait till you try renewing your driver's license. Regular state DMV employees are expected to be well versed on immigration matters?!? Huh, what a joke...

My H1-b processing or the receipt date is Oct. 26, 2006. The USCIS website showed that California Processing Center are currently processing cases for the date of Jan 13, 2007.

The only thing i received was the receipt telling me the processing date of my case is Oct. 26, 2006. I paid $1690 for the application fee. I also submitted my I-140 was approved.
I went to the immigration office in downton Los Angeles by using the INFO Pass to find out the case status. All they can tell me is to wait. I asked them as if i need to pay for the premium processing fee and the official told me it would not make much difference.
I wrote the letter to the California Processing Center to find out as if my case is pending anything or if i need to submit additional information . The reply i get was the center is no longer accept any request through mail?
I am getting so depressed as days go by because i do not know what else i can do.
Can someone please give me some advises?

We will have to wait and see how this change in Job Zone for IT manager occupation will be managed in actual adjudication of PERM applications hereon, but it is certainly not a positive news.

I was exactly in the similar situation. My wife entered on H4, started work on EAD. Now we are traveling to India, both have AP as well as H visa (H1 for myself, H4 for wife). I talked to our corporate lawyers pretty much the exact same questions you are asking. Here is the response (that I have in writing from the lawyers):
1. H4 status is invalidated the first day you report for work on EAD. While you are working, your status is AOS in the US. There is no consequence of this change (ie you do not have to report anything to the USCIS).
2. When you reenter the US, you can use H4 for reentry. (Yes, even if you are still employed the employer with an EAD and went to India only for "vacation"). This is because at the point of entry, the definition for "working on EAD" is actually reporting to work. As long as the H1 is valid, you can enter on H4. Your status at the point of entry is H4 admission. However, if you report to work the next day, your H4 status again is invalidated and you are back on AOS.
This is a pretty confusing scenario for many and multiple lawyers that I consulted have agreed with the above legal advise.
So, even though we have AP, we would be using our H visas to enter.

Your BE degree will be considered equivalent to guys who have 12 + 4 from India. After all you have a fulltime 16 years education with same degree that 12+ 4 guys have. I think AMIE is getting the flak because its considered part time degree ( I know how difficult it is to manage job & AMIE studies) but that is how USCIS is interpreting it at the moment.
I have applied for I -140 (EB2) but I am with 10+Diploma(3 years) +Bachelors of Electronics from Mumbai Univerisity(3 years).
Is it considered 4 year degree and good for EB2 along with prior 5 years of experience?

Please donate that extra money meant for leisure to IV instead going to Bahama this year. You may help yourself doing this and that humble act may get your GC quick and thus enable you to enjoy cruises to Bahama every year without worrying about Visa validity and time lines.

The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.
I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

It was a disclaimer. I never said it was bad for you. But there have been people estimating it will still take 2-3 yrs for eb3 to reach 2005 ....is that true????.. i have no idea since the data cant be broken down at PERM level.

That equates to $30 billion.. Not a bad #. But I am sure all want to buy houses eventually. Thats $150 billion. Not a small #.
Lets say (again tell them).
1/100 th of 500,000 start companies, of 5 employees each=25,000 jobs.. Not bad again.
This idea is inline with our IV campaign that was discussed sometime back. We can tell in different forms to the media. Somebody may publish.
