I am in a similar situation , though not exactly the same. In my case I was laid off and my company is going to revoke the I-140 because the position is not there any more. I pleaded them not revoke the I-140 but they said they have to withdraw it as they do not want any liability. My company has about 30,000 employees. I also have the same question as to how I should avoid NOID or denial.
I have seen lot of people switch using AC21 but most of their employers do not revoke I-140. I have yet to see cases where a person's I-140 was actually revoked after 180 days and they were still safe and got their GC approved.
One of my co-worker was in same boat. His desi employer revoked his I-140 when he took fulltime employement in 2005. He got his GC finally.

this whole thing sucks. USCIS cannot adjudicate even I-131 on time. We have booked our travel tickets after 100 days of Received date of AP renewal application and looks like we have to cancel our tickets and waste $1800. This really blows and its attrocity to the core that USCIS cannot process AP renewals inside 90 days time period and its a shame that they are not answerable to anyone.
Please post your info-pass experience. We are in the same boat. My wife's AP is pending since 6th June 2010.

I guess using our degrees to pass on a message is a fool-proof idea. That can immediately catch on with media like flowers did. If not stoppers, we can write our message in bold colors on the degrees.

Ok , it may not be right thread to discuss everything here... but
What I am saying is, instead of spending N years waiting for GC, I guess we lead better life elsewhere!
Where else, in our home country... but that reminds me of descremenation again!!
So I thought of place which is not in high demand yet... africa...!
I always believe in making things happen, in stead of waiting for someone doing it for me!!

Absolutely true, It is torturing the kids for the aspirations of the parents to be seen in the national TV and for award.
It is not the poor kids are not getting the award, it is the parent, especially it is the trend with indians.

Is it possible to do so ? Can we apply for 2nd EAD application even without first one, and having got the receipt notice for first one ? If yes then this is a good solution, but then who knows how long the 2nd one will take to be approved, making it a worthless effort.
It is possible, but what's the point? It will have later receipt date. It is better to file a lawsuit to force the USCIS to issue EAD. It will cost only $350 :)

Many of us will be facing this decision and it's good to know the risks and the answers. Imagine you got a GC and now you have a +20k offer from the other company. Staying with your current employer for 6 months will cost you 10k. The question is "does the risk cost 10k?".
This is how I see it, please correct me if I'm wrong. You can be questioned about leaving the company only in two cases: 1. citizenship interview, 2 - investigation/audit. In first case I don't see much problem, as many years will pass, and if you will not keep any documents, I don't see how USCIS will be going back and chasing these 4-5-6 months of your employment.
Investigation is a different story. You have to be ready. The law says that you/your employer had to have intent to work on that position with that job description forever at the moment of AOS. Technically you could change that intent the very next day.
So.. I think this is how it will work. USCIS might request evidence/letters from you/your "after-GC" employer and if they will find something like your resume that you have sent them before getting GC, then you are in trouble. But if you will demonstrate, that let's say you met your "after-GC" employer only after getting GC (let's say at some exhibition) and he offered you right away +50k salary, then I don't see how USCIS is gonna build their case.

These bills are currently presented to the Senate in two different formats: One is the format of the Senate's consent to each of these House bills separately. The other is Senator Specter's consolidated bill that put together all of these four bills into one bill. Obviously, Senator Specter's strategy must have been to tie the reauthorization bills to the controversial E-Verify Reauthorization bill. We reported that he apparently changed his mind and was pressuring the Senate Majority Leader to introduce E-Verify bill in the Senate first. Accordingly, it is unclear which strategies will work better to get these reauthorization bills passed in the Senate before they return to the election recess in early October.
* The Senate is scheduled to return to the session on September 5, 2008, Friday, and to pick up the defense appropriation billl debates. The House is not scheduled to return to the session until September 8, 2008, Monday. Procedurally, unless each of the reauthorization bills is consented by the Senate floor without amendment, they will have to go to the conference committee or the House just consent to the Senate's amendment. The problem is the House bills were referred to the Senate Judiciary Committee just before the recess and unless a sufficient political pressure is added to the Judiciary Committee Chairman Lehey, they are destined to go nowhere when it comes to the time frame. On the other hand, Senator's consolidated bill faces its own problem because of the E-Verify reauthorization proposal. Besides, even if the Senate floor quickly takes up this consolidated bill, since it is a Senate bill, it will have to be presented to the House for their consent for the Senate versions. The question is how and when all of these actions will be taken up by the leaders of the Senate. The answer appears to be obvious. The relevant immigrant communities must recharge themselves and act quickly to add pressure on the Senate leaders to take up the bills quickly as soon as they return to the session. There is no such thing as "invoking" AC21. Its a law. Most important thing is, your I-140 must have been approved and I-485 is pending for more then 180 days....you are Free to sail in the same or similar field.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...

May be this is not a prediction thread. But the OP and some others are all about VB in another thread or two. While I personally dont have any issue with it, it just frustates me that people dont understand that VB is not going to do any magic for PD's in 2003 or later. C mon Lets be realistic. After doing all the math in so many threads, Does any one expect that the PD will be some where in the ending of 2003. Hell no. Then why is that we have a Dec Bulletin thread way back? Now some one is gonna come start a Jan prediction thread. Useless. I hate to comment on this but I hope people understand the difference between discussion as you said(which I personally agree) and useless predictions when they can make educated guess and do something else.

It's just bad luck to get that kind of CBP officer. It's upto you to ignore this or escalate it. In my opinion behaviour of CBP officer was wrong.
If you want, You can write letter to Commisioner of CBP about the incidence, following is the address :
