it is the job profile that dictates whether the case is eb2 or eb3 - the applicant should meet the criteria for the job. not the other way around.
Sure. h-1b is now; labor is what you are going to do when greencard gets approved.
try telling a consultant who is qualified for eb2 that the job dictates it is eb3 and they won't sleep or eat -:).
Reality of the process and how it works is quite different. If you really wanted to pick on things; DOL assessment of education and experience dictate that all of the IT positions should not require more then bachelors and four years of experience (ever IT labor filed with eb2 requirements it to be answered that the job requirements are NOTnormal for the positoin.
If companies don't want to file eb2 then employee will not stay (they cannot fathom waiting 10 years for greencard).
Maybe people don't want to hear this but that is reality of the situation.

tell me this is a joke..:D... if not..man join the que .life sucks in the GC lane
It is not joke, that's my unbelievable terrible start since this March. When we look back, still think it like a nightmare. And one neigbour told cop she heard my wife shout "Help me, he is gonna kill me." But you knew we even don't speak English at home. Where that ridiculous words from? BTW, when cops come, they firstly mis-arrest my another neigbour, as they also have some argue. Probably that is where it from.... But now that everything we have to explain on the court and convince the jury. Fortunately my wife always stand on my side.
Anyone could tell me what impact to my 485 approval if damn jury find guilty in my case? Thanks a lot!!!!!!

It is time for the high skilled immigrants here to take offense with what NUSA puts out ... here is a message that was sent to them a short while ago. We can do more. The collective intelligence, tax dollars and clout of this group of HIGH SKILLED immigrants can call the bluff on Roy Beck and his bunch of fear mongers...
To Roy Beck:
Unfortunately, special interest groups such as yours fail to understand the realities of globalization, international trade and commerce. Your views are an arcane throwback to the era of narrow protectionism fueled by fear, uncertainty and doubt. The world's economies are growing at a much faster rate than the US because we have failed to keep pace with the talent race and skill race. We have forgotten the great tradition of adventurism and capitalism, and instead bask in the self-avowed glory of elitist protectionism... hoping that cute scare videos and falsified statistics will deceive people from seeing what NumberUSA is what it is really about = a quest of 'racial purity'. Lets not try to fool hardworking, law abiding economic agents into believing that you stand for a moral cause greater than the collective capitalist good of the United States. Indeed, it is shameful that you should continue to pander your archaic sentiments around 'immigration control' in a land where the ONLY natural citizens are American Indians. You demean the Irish, the Italians, the Germans, the Jews, the Indians and the Chinese by painting a broad brush against 'numeric over crowding' without caring to recognize the net economic value add of these and other ethnic groups. Maybe its time for todays youth to stop fawning over Hannah M, Britney S etc and get cracking at higher education ... and maybe, just maybe, our time is better spent on being parents that can imbibe a new 'gold rush' mentality of adventure and spirit instead of fear mongering and hoping that globalization will go away :). Because, it wont Mr Beck. Never has. Never will.

Immigration Voice Advocacy Days in Washington DC: 7th & 8th June, Announcement:2010
With the continued success of the high skilled community to create more awareness for Employment Based green card backlogs, Immigration Voice will hold Advocacy Days, Press Conference and Congressional Reception in Washington DC on 7th June & 8th June.
Every member must participate in these Advocacy Days events in DC. Congress will be back from Memorial Day recess in early June and there will be a fresh look at the Comprehensive Immigration Reform, which includes high-skills immigration.
After having favorable consequences from our past effort, it is now time to have a bigger event in the front-yard of Congress in Washington DC, so that the long ignored issue of visa backlogs (retrogression) is addressed. This event will be hugely consequential as it will help our issues get much more coverage in the media and much more attention of Congress because of 2 reasons: It will be a really big crowd and secondly, it will be in Washington DC. Immigration Voice will arrange for meetings, advocacy material, and other logistics necessary for all the events during the Advocacy Days. All you have to do is show up.
Please plan to take two day off on 7th & 8th June to attend these events. If you do not live within the driving distance of DC, then there is ample time for you to book travel by air or by train ahead of time. 7th & 8th June is Monday & Tuesday, and if you book your travel and accommodation ahead of time (and there is plenty of time still) then you can participate with minimal expense.
Immigration Voice wants to do something as consequential as the flower campaign and the San Jose rally but only this time, it will be much bigger and much more consequential aimed at Congressional action on immigration reform to address visa backlogs and broken system of high-skills immigration. We aim to resolve this issue but we cannot do it alone and therefore it is imperative for everyone, and by that we mean EVERY ONE to show up. If you wanted to be a part of the past events but couldn’t, then now is your chance to make your voices heard and fight for a fair system and just process.
Always remember, we are in United States at the invitation of our employers and our employers have filed our green card petitions in order to retain us. It is only fair and only just to ask for a system that achieves that objective without delays and without putting the immigrants in probationary limbo for 6-12 years. And it is your obligation to yourself and your family to stand up for your rights and ask congress to legislate and fix the system so that it works the way it was originally intended to work. Just ask a participant of September-2007 DC rally how proud and how satisfied everyone was after the rally – not just due to impact – but just because they have stood up and spoken up for their issue.
In the two days, we plan on having over 400 meetings with the Administration (for both Admin and Legislative fixes), Office of Senators and Representatives.
As we are beginning to take appointments on your behalf but we need your confirmation before we setup Advocacy day meetings for you. Please fill in the online form (in less than 1 minute) to let us know about your plans. We will need this basic information to setup your meetings with the lawmakers.

----------------------------------------------
As one would imagine it is extremely demanding project to setup, coordinate, plan and execute 400 meetings for members coming from all 50 States. It will very much help us if you could please let us know about your plans to attend the Advocacy Days in DC, sooner rather than later.
Please stay tuned for more updates about other updates. In the meantime, please plan to travel with friends and family and let your friends know about this event. GC people is closer to citizenship and closer to get this permission.
Visa is not permanent.
So what is it now? Since GC people are closer to getting citizenship, they deserve to bring their parents? Or, the parents of GC holders are more deserving to come to the US?
You said those of us with bad parents don't need to comment. What happens to bad parents of citizens and very good parents of H1Bs? Where do they stand?
Why do you think GC is permanent and a visa is not? There are people on this forum who have been on H1B 'visa' for more than 10 years and counting. We should at least let them bring their parents, don't you think? Or should they instead go back to India?
Next time, I want you to think seriously about the issues I brought up and then post a reply. LOL. I feel like I'm talking to a kid.

all i can say is that your situation sounds like an illegal situation... if you are simply going to provide offer letter without actually having a job... but thats between you and your company and you may be perfectly legal and fine... check with a lawyer dude
Why do you think that my situation looks like and illegal one....I would really like to get an analysis from you/anyone on why this situation is illegal.
is it not ok to start a company on EAD?
is it not ok to start a company on your spouse name and work throug it?
Your explanations will be greatly appreciated.

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

Gurus,
Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the Court Disposition Document which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel
Please reply and post your valuable opinions/suggestions/advices.
Appreciate all your inputs.
Have a nice day!!!
Thank you,
Sahaayam.
There are few things you need to findout first:
1.) what section did u get conviction? does this section constitute a CMT in your state?
2.) if its a CMT, then what was the maximum sentence for this crime in your state?
Do research on "inadmissibility" w.r.t CMT's. There are waivers for first time offenders. See if you qualify for any.
Since these vary state to state, I am not sure if any on this forum could help you. Also not to mention, only an expert could give you correct advise on this.
I suggest the best person to get this addressed is criminal immigration attorneys. If you are from state of CA, you could research on Norton Tooby.
Good luck and god bless

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
Silicon Valley has maybe a 100,000 Indian engineers or more. Add families .. and a much higher number. Add Chinese and European immigrants .. and you have all of Silicon valley :)
We should hold a huge rally say in the campus of some company like Cisco .. or Google(who are immigrant friendly) on a work day .. say Friday lunch time .. and have everyone attend.
Being in Cisco .. you can pretty much get all their employees to attend... which is substantial.
Also have industry people talking in favor of better immigration policies.
(we could hold it in some other company or a common area .. anything works)
Unless we can have a substantial number of folks say 10,000 or more .. I don't honestly see too much of a point.
Even if IV collects a few million dollars .. and lobbies .. it will never have the impact of 10000 people protesting.
We need to see if we can have similar rallies ever month in major hubs like New York, Washington, Seattle, Houston.
Unless we have s sustained campaign and we have the numbers .. I personally do not see things really changing.
I see people being optimistic about 300 folks in San Jose rally and 1000 in Washington. But having been to the rally in San Jose I don't see how 3 times that number in Washington is going to cut it. (Read Logiclife's post ... but we still need the numbers !!)
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.
Thank you
V
Sounds like a very good idea if you guys can pull it off. I am not sure what is the level of support among American colleagues in Silicon valley, but their presence in significant numbers would make the biggest impact on the observers. I am sure there are those who see the bad in keeping talent out, many times the lack of certain skills needed might end up causing the whole project to be outsourced.
If that makes national news and you are right it would take about 10K or so for that to happen, then our cause is likely to get more visibility.

Democratic victory may pave the way for Bush's immigration plan
By Dave Montgomery, McClatchy Newspapers (MCT)
WASHINGTON - If President Bush can find a silver lining in the Democratic takeover in Congress, it could be this: The outlook for enacting his sweeping immigration plan, which House Republicans blocked for two years, suddenly looks brighter.
A 700-mile border fence pushed through the Republican Congress also could come under renewed scrutiny. Although Bush signed the fence legislation into law, Democratic leaders opposed the measure and may hold up funds for the project, which is expected to cost at least $2.2 billion.
"I can't think of another issue that could bring together the Democratic Congress and the president like immigration," said Frank Sharry, executive director of the National Immigration Forum, which supports the president's initiatives. "This election has really changed the immigration debate forever."
Pro-immigration groups such as Sharry's predict that the next session of Congress will be far more receptive to the most volatile elements of Bush's immigration plan: a temporary guest-worker program and conditional legalization for millions of undocumented immigrants now in the country.
Since Bush first unveiled his intentions in 2004, those proposals consistently have collided with resistance in the GOP-led House of Representatives, which refused to consider a Senate-passed bill that largely embraced Bush's initiatives.
Now Democrats will take over the House and Senate in early January under leaders who've expressed support for a comprehensive immigration overhaul.
Presumptive House Speaker Nancy Pelosi, D-Calif., has called for legislation offering illegal immigrants a "pathway to earned legalization and citizenship" if they fulfill "tough requirements," such as paying fines and back taxes, staying employed and learning English.
In a post-election press conference on Wednesday, Bush again listed immigration as a top priority, describing it as "an issue where I believe we can find some common ground with the Democrats."
"I do think we have a good chance," Bush said.
Democratic victory may pave the way for Bush's immigration plan
