I thought that I will share my recent experience.
I arrived in USA in 2003 on a L1 visa.
It was expiring soon, but instead of renewing, because of fear of denial, my company converted me to H1 using premium processing.
Department of state was going to close the VISA revalidation process, so in 2004 I sent my passport to them and got a h1 Stamp (within the USA).
I changed my employer later using H1 transfer and they kept renewing my H1 petition.
My new employer also started my GC processing and in Jul 2007 I applied for my 485 along with wife's.
Since then I have been working with the same employer on EAD.
After a long time I wanted to visit India, so applied and got my AP.
Although I had my AP, I wanted to visit India, get an h1 stamp and reenter on H1.
This is because EAD is taking too long for renewal.
I went to India, visited Mumbai Consulate, they did not ask me a single document.
They understood that I was asking for a stamp after 7 years, so they asked me "so your GC process is ON huh?". I said, "Yup".
No other questions asked.
I got my h1 stamp in 2-3 days.
Planning to reenter USA on that stamp.
Once I return my company will switch me from EAD to H1.
Hopefully EAD will arrive after that.
I will just keep that handy.
If I move to another employer, I will have a choice, use H1 or EAD.
I am keeping my H1 for the only reason, that if 485 gets rejected for any stupid reasons, I will have a way to fall back on something.
I have a house and a small kid born in the USA, don't want to have ANY illegal status, even for a day.
Wife will continue to work on EAD.
H1 is valid for 3 years, so I can travel to and fro USA to other countries with much more ease than the AP.
Plus I don't have to pay the crazy AP fees each time.
Please do comment if you find this information useful or any issues in my plans stated above.
I will update this post when I arrive back in USA.
Thanks for sharing your experience. Please let us know where did you get your stamping and also what questions and documents were asked?
Thanks.

I am in similar situation. Originally applied to NSC, got Xfr'd to CSC. Now CSC after processing EAD/AP Xfr'd my I-485 back to NSC.
ANyone in similar situation has rcvd Finger printing notices? I assume Aug 17th filers at NSC are ahead of us?
Also, i received the EADs in mail, but haven't received the AP even though online status reads AP mailed a week back. Any idea how long it takes to get AP after it online status reads approved?
Please share any information.

Filed I-485 on July 31,2007. Checks cashed on Sep 10th and received Receipt Notices for me and my wife through the attorney yesterday. I am in the EB-2 category with PD: Oct 2005.
However, on both of our I-485 receipt notices, the Category shows up as "Unknown" ...Has anyone else faced any such thing...
Please advice.

Well,I am not really happy about Coryn and Kyle (who voted against) but is most important that Senator Session will be out from the delegation.

Employees should be particularly wary of having their adjustment applications handled by the employers attorneys. If there is a dispute between the employer and employee, as when the employee terminates employment and moves on, there is an inherent conflict of interest. The attorney may continue to represent both side, but only if the conflict is disclosed and explained, and both sides explicitly consent to waive the conflict.
Similarly, the employers attorney must provide the employee with complete copies of everything filed in connection with the employees application for adjustment of status. This application is personal to the employee and has nothing to do with the employer. If the employers attorney files the employees adjustment application, he or she is acting on behalf of the employee and owes the employee a fiduciary duty of loyalty. If the CIS issues a request for evidence (RFE) or notice of intent to deny (NOID), the attorney must act in the best interests of the employee if he or she undertakes to respond.
Unfortunately, many employer attorneys see their first loyalty to the employer and not to the employee. If you are uncomfortable having your employers attorney represent you, you have the right to change lawyers and retain someone on your own.

It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status  :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!
Congrats.

This happened with me too yesterday and I wondered why it happened. I did get an alert message asking for this 'Trojan Horse ' to be put in vault'. It happened exactly while I opened this link and went to this site. Someone should send email to the owner of this blog to alert him.
My computer crashed several times after that and I had to reinstall OS to get rid of this virus. I am now in the process of installing all softwares again. All my strong anti-virus defense systems failed to stop this virus.
I got identical symptoms yesterday.. Have Mcafee..but after clean-up and rebooting my laptop won't come up..
Only reason am even writing is from my guilt of getting upset and blaming my young daughter who used the laptop just after I checked IV site. Other than getting the laptop back and make amends with my daughter have to see impact of data loss.
Hope this really does not happen again...

The Forums are not secure as they are watched by anti immigrant groups. Key communications like this can only be through state chapters as the membership to the state chapters are secure. Please contact a chapter that is nearest to you. If not PM me your phone number and contact info, I can pass it on to my state chapter (IV Tri-state) and have someone contact you with information.
This drive is Key for our issues. We need to work on this and burn the phone lines. We are very close indeed.
Please post it for other people who are not part of state chapter

From VB
"Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "Other Workers". "
First, your scenario is overly optimistic . Even then EB3 can use a max of 10,000 of such visas and pass on the rest to the other workers category.
Which basically means Eb3s with PDs> 2004 will get screwed even in a very optimistic scenario.
Worse is Eb2s do not have such a cap . So not a drop trickles down till Eb2 is completely satiated.
Assume HR5882 gets signed by president and visas are distributed according to current laws .....Eb3 will get some benefit but not much. Infact everyone other than Eb3 will get maximum benefit including famili-based, other workers etc.
Moral of the story - Eb3s with PD > 04 ....port to Eb2 ...if you can...now
I think what this is saying is that "other workers" can only use 10,000 of the spillover, and the rest will be for general EB3. Not the other way around as you have interpreted.
However, I am not disputing the rest of your post. If the job is there and you can prove EB2 qualification, go for porting.

1. I am a US Citizen living in India?
Yes
2. If I am a GC holder living in India?
No (Yes if the person resides in the US while claiming SS benefits)
3. I am neither a US citizen nor a GC holder living in India?
No (Yes if the person resides in the US while claiming SS benefits)
Even with 40 credits it is not possible for Indian nationals to get SS payments in India. If you look at the rules closely on the SSA website, there is no simple way to get benefits paid in India unless you are a US Citizen. You must be present in the US for that

Newsflash: USA is a country (with a boundary). USA has a national anthem. They like to sing it, everywhere. If it makes them happy when I sing it, I will sing it too. It is like visiting someone's home and you are asked to take off your shoes at the entrance. Maybe you don't agree with it, but out of respect to the host it is a nice thing to do.
Relax and be more generous! I think you have more boundaries in you than this country has.
(If USA goes to war with my home country, I think they will trust me less if I come here and live and refuse to sing the national anthem...)
If you dont take off the shoes at the entrance, maybe you are showing disrespect.
But by not singing their NAnthem, dont think it means disrespect !
If we sing each nation's anthem and leave out theirs, this will mean disrespect. !
I think we are not yet permenant residents of this country .. so singing the NAnthem does not look appropriate. But due compliments to Pankaj, He has a wonderful voice!
You never know what will happen to our GCs!! So lets remmember where we are from & what state we are now, that will help us to be more pragmatic.
And about the war thing, my conscience may not permit me to support another nation at this point in time!!
Please dont be offended , just sharing thoughts!

I saw a similar thread in one of the anti-immigration forums.
It was about members of immigration voice using filthy language in public forums. Dont remember the exact words but it read something like is this kind of third world behavior we get by bringing in so-called HIGHLY SKILLED immigrants to USA?
