When you change jobs after 485 Filing, is it necessary to change with an EAD or I can get an H1B transfer. I may get laid off, and EAD has not come yet and I don't have the time for EAD to come through. Can I transfer H1B while 485 is pending for less than 180 days without it affecting 485. I will make sure that job duties are similar and I am fairly certain that employer will not revoke I-140. My assumption if that I need to be working on H1B or EAD to maintain legal immigration status and there can't be any gap between the two employments.

Our applications (myself and my wife) reached USCIS NSC on July 2nd. On 09/08/2007, we both received EAD's and today (09/10/2007), we received Notice from CSC that our cases are being transferred to NSC as our cases fall under NSC's jurisdiction. My I-140 was approved by NSC in Feb 2007.
Also, our cases were received on July 2nd @ NSC and the RD on Transfer Notice I received today have RD of 08/28/2007.
Anybody in same situation...I am confused here....don't know how cases are being transfered from Center to Center and why RD is not July 2nd.
Comments ???

Thanks for continous feedback ,I have question i'm planning to use ac21 ,but my current labor certification jon title code is 15-1031 (computer sepcialist engineer -Oracle) but my new job is DBA (application development -Oracle ) But the nature of the job responsibilites are same but i believe the Job code may change b'cos of the Title.
Do you think will this be a problem if i use AC21.
Your inputs will be greatly appreciated.

Call the regular USCIS customer support number and double check the details of the visit. If it is a genuine appointment, it could have been recorded in their system.
Also, you should talk to your Attorney to make sure such visits are legal.
Never heard of it before, strange things are happening nowadays.
BTW, is your employer a consulting firm? Do you think he could be in the visa fraud hit list?
I have one week from now for his visit. He gave me his desk number too. So I guess he is still an ICE employee. I did not call him at that number though.

Q1. How has USCIS changed its national security reporting and adjudication

A1. USCIS has not changed its background check policies as those policies related to naturalization
applications. Recently, the agency did modify its existing guidance for applications where the
immigration laws allow for the detention and removal of individuals if actionable information from a FBI
name check response is received after approval. For these types of applications, including applications
for lawful permanent residence, the adjudicators will approve the application if it is otherwise approvable
and the FBI name check request has been pending for more than 180 days. No application for lawful

Remember, GC is for the future job and I-485 is not H1 filing where you need pay stubs.
One needs EVL for I-485. The job position must be open in order for beneficiary to file for I-485 application.

5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

Asking you to sign an agreement is not illegal. There are employers (even big names) who ask their employees to take care of the expenses for GC processing. The main concern should be to verify if this company practices fraud. The only way to check is either by searching on the web or talking to some other employees who work for this consultant (making sure these employees are also not part of the fraud).
I am sure you have heard about people like Nick Mandalapa who were filing multiple I-140 for the same labor certification . The sad part is that there is no USCIS online system to verify if a labor certification was used to successfullly file I-140/485.
And remember that if there is fraud it can haunt you ater in your life even "AFTER" you get your GC. USCIS can revoke your GC at any time if there is a proof that a fraud has occured in the process.

I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??

Can everybody please let us know how much money you have spent so far to file 485. We have contacted reporter and she need more information from us.
Please do this asap.
Just put total amount you have spent for 485 like Medical cost, attorney fees, mail service, birth certificate, cancelling your planned trip , photos and so on.

The bill text says there is NO fee and the applications need to be processed expedited.

Regulations promulgated under this Act shall provide that applications under this Act will be considered on an expedited basis and without a requirement for the payment by the applicant of any additional fee for such expedited processing.

So once this bill passes, we can just forget about legal immigration applications for 2 ~3 years, until all illeagul and UNDOCUMENTED applications are processed.
This is going to effect all legal immigrant community, think about waiting for AP, EAD, H1B application and guess people might have to suffer loosing jobs while waiting for these applications processed.
Hope they don't pass this bill and kick us back by 5 Years.
I don't see a relation between Obama saying ..... Cisco, Intel, Ebay started by Immigrants and DREAM. Those Immigrants he is referring to are from India/China and DREAM are from Mexico.
Am i missing something here?

Get one thing done is better than spreading limited resources on multiple topics. To increase immigration quotas is not achievable before presidential election is done.
Why not just focus on getting name check delay solved. It is under congress scrutiny already, all need are to add more oil to the fire.

I was wondering if someone will mention F-22.
First of all, F-22 is not for sale. Period. There is no such thing as a close ally as far as F-22 is concerned. Even the Israelis got a curt NO when they wanted to buy it.
Second, IAF does not want the F-22. It is US$ 150 Million a piece which makes it almost twice as expensive as any of the planes being considered. Also, if you look at the IAF's area of operation: F-22 is an overkill. None of the neighboring countries and this includes China has capabilities that will necessitate something like F-22 to deal with.
