What if the job i'm moving to after 180 days is hiring me permanently now itself? Do they still have to specify (in EVL for AC21) that they will hire me perm only upon getting GC?
Just specify that they intend to employ you on a permanent basis. It does not really matter whether it happens before or after you get your GC.

I am not saying we shud do anything forcefully. I am saying, that if we have to show IV's face as being multicultural and since we Have members from all over the world sharing ideas on here anyways, might as well show the media that aspect.
In my opinion, if general public/law makers see faces from all over the world complaining about the GC system, it would have more impact.
If a core member/moderator can comment on this, that would be greatly appreciated.

I think the reason is little bit of everything.
1. We are a very small group.
2. We are doing white collar jobs which they are affraid we are stealing
from their sons and daughters (compare that with the toilet cleaners)
3. We get No sympathy from any side. Reason: we earn lot of money (at least
thats what they think)
4. Our issues are complex. Not many people understand retrogression
or H1B restrictions (compare that with "Hiding in the shadows" argument)

I am in eb3 with priority date jan/2007 and working with EAD and 485 pending.
my sponsered employer willing to promote me with my position and i was having thought of filing a new case in eb2 and port my eb3 priority date. my company has different sister company working in different areas, can I file my eb2 application from other sister company not from the company where my eb3 is filed?
Also I have 3 years degree and 1 year pgdca plus 10 plus years of experience. I wanted to know if you know anybody who filed eb2 with 3 years degree and 1 year pgdca? according to my research i may have trouble at 140 stage?
if my eb2 gets denied, what happens to my eb3 case?
Please advice.

Actually I just wanted to point out the generic indifference shown towards the feeling of people of India by mainstream western media and governments - the long wait in immigration queue and ignoring the plight of Indian legal immigrant aspirants , setting a per country quota ignoring its population representation is just an extension of the same mentality... and I also wanted to point out how this mentality of deliberately ignoring Indian feelings and values is going to become increasingly irrelevant in the changing world where BRIC countries will wield increasing power.

Today inspite of the quota we are sort of demanding or in other words saying Google(US based company) should display Diwali. If country quota is abolished many more of us will beome PR and then citizens then we will be in a better position to demand the incorporation of our cultural values/ religious values in this country and thus the cultural/religious equillibrium of this country will get effected. So they will say this is the reason that the country quota should stay.
This way your innocent statement can be used against you and us. This was my concern against these type of nor immigration and matters related to only one country/region/religion being posted in this forum.

I had sent an email to rags months before about this friend. He decided to become an expat and move to India while his GC still languishes in the labor stage. He is an engineering manager who works for one of the big oil service companies (Think of word association with the Vice President). He would have been invaluable to this country as the country tries to become more self-reliant in the energy sector. Instead, he now lives in India and services oil wells in Russia. How is that for loss of competitiveness (loss of his service as well as his tax money to other countries)!

Today, the soft cap exists, and the numbers are retrogressed only for India and China. REST of the world is current. Hard cap would make things worse for only those countries that have higher demand and WASTE the visa numbers.

Based on Assement in this article, it almost seems that the chances of STRIVE are dead even before it goes to House Immigration Commettee. I am not trying to be negative or something but the article has such a tone. I can understand that Pelosi did not schedule any timing but what concerns me most is the fact that

Now we all know how one sided these hearings are and how long they take. In nutshell these hearings give chance to any tom, dick and harry to express his opinion and create melodrama. We already worry about melodrama of people such as Sen Sessions in the Senate. Add this drama, and it can easily eat the short window we have to get the relief. I really hope I am wrong here but I have a bad feeling about this :(:mad:

I have two passports one with H4 Visa stamped and another Surname changed. While entering US, I have used my name as in the Visa (new surname) in the I-94 card.
I have applied for H1B with new surname in this May and change of Status with that I-94.
During H1 processing, I have travelled out of US and while entering back I have used old surname( as sometime back DMV ppl told that the name on I-94 should match with H4 Visa)
Now I got H1 approval and COS approval with my middle name taken as first name and new surname.
1) First thing is, the I-94 on COS approval and I-94, currently present in my Passport does not match.
2) First name and middle name are interchanged in the passport and H1 approval.
Is this going to create any problem while applying SSN? What are the possible consequences..
Also, any similar scenarios, plz respond..

you said that you entered on new surname passport and so your i94 will have new surname..
now when again you reentered you entered on old h4 with old surname...
so you have entered US with two different surnames ...
DMV told you correctly..always your surname should match the surname in visa stamp...
you are lucky that immigration officer at port of entry might have overlooked your case..otherwise you must be in your home country by now..
you are in a serious trouble..surname issue is very big..consult a good attroney than posting in the board...

If the minister talks to the US President regarding VISA retrogression problem,How the outside world will come to know ? The discussions will be kept confidential ! I don't think everything will be disclosed to the press. VISA revalidation is another thing he can talk to US Secretary of State.

#1. Schools can have policies. For example, some schools don't allow higher education on H4 Visa.
#2. As AOS pending based on spouse, one can engage in studies (full time or part time). Also, one can do job full time or part time (if EAD is applied for). As far as immegration (USCIS) is concerned, there should not be any problem
#3. I am not sure, whether the school in question allows studies while AOS is pending. I think it does not, so they are asking to take Full Time F1.
Usually people sitting on counter may not know entire detail. You may have to ask senior staff.
I have been is situations, where INS explained me that Schools can have their own policies and that don't dictate it.

per my lawyer you can come back from EAD to H1 by filing a new H1 petition (if its past 6 years on H1, then you need some basis like approved I-140 or old LC). You will need to leave the US and return to activate the H1. So thats always an option if you jump to EAD.
In your case, you can still file a H1 transfer, if it comes without an I-94 attached (meaning H1 got transferred, but status was not activated which typically happens when last H1 status ended more than a couple of weeks ago like in your case) all you need to do is leave the US and return some PoE where you will get hte new I-94

nihar, is this "consultant" your attorney? You should contact an immigration attorney with your concerns; not familiar at all with "lottery" H1B, so have no information.
