I applied for EAD for my wife to get the SSN to get the Stiumulus package (What a riddle created by the system). The funny part is that USCIS cashed my check within 12 hours of my application being received.
I wish this happened for H1 transfers, issue of EAD, I-485 etc etc. Oh,..now they will be understaffed and over worked ...and the list goes on and on.

I am in a similar situation too. Getting married in August. Planning to file my I-485 in July and get my spouse here on H4 visa in the first week of September. It seems (from some comments in this forum as well as elsewhere) that the dates may not retrogress for August, but there is a very real chance they will retrogress for September.
You can "add" your spouse to the I-485 (note that technically it's not "adding", but filing an entirely new I-485 for your spouse) anytime before your GC gets approved (and after you get your I-485 filing receipt), provided the priority date is still current at the time of filing. But with the possibility of a big retrogression looming, this could be a long wait for some people.

Latina: If you are correct then, since it is mentioned in so many posts that IV should achieve a non country quota, it should be clear for us (Rest of the World) category that this won't affect our waiting time; because if you are right that the Sernior voices were never advocating that the Worldwide Category will suffer any delays, it gets confusing after reading so many junior posters talking about not having a per country quota (just one line), that for newbies like me it is not crystal clear, of course I am all for the unused portion of the numbers for Worldwide category going to skilled immigrants from non worldwide rather than to anybody else.

I never said school can force her to maintain F1. All I said was if she wants to be on F1 (for whatever reasons) she needs to comply with school's policies. Also her maintaining or not maintaining F1 is immaterial to her legal immigration status in the country (which is safe by the virtue of pending I-485) it is just that she will cease to be on F1 status (her current non-immigrant status, just obtaining EAD doesn't mean she has abandoned F1 status, she needs to use it)
Also, she will no longer be on any non-immigrant status when school cancels her F1, from that point on her status will solely be based on I-485 and its outcome.
The school policies does not determine whether someone can be on F1 status or not. Government has laid down the rules for F1 status. School cant say that one has to take so many credit hrs for that person to be on F1. The rule is that to maintain F1 status, one has to be a full time student with minimum 3 courses , thats 9 credit hrs, but the exception is the final semester where that student can have less then 9 credit hrs.
Plus since the F1 is not a dual intent visa type , when someone applies for 485 , the F1 status is forfitted. what you are mentioning about the previous non-immigrant visa status continues even after obtaining EAD and remain so until EAD is used only applies to the non-immigrant status like H1 , H4 , L1 etc which are dual intent visa types. They will not care for us at all! But, there is an outside chance that one of the retrogressed is related to one of them or somebody knows a politician... and our e-mail also reaches them at the perfect time! And, one of the concerned politician/minister happens to meet one-on-one with Karl Rove, or any such powerful figure in the Bush Team! And, they bring it up with the Bush Team, who assure them they will make Retrogression disappear!!!

This is the sort of thing that should make folks wake up and smell the coffee. Advocate for yourself or lose the dream. Those of you hoping to wait it out, whether it be 5 yrs or 10 yrs, let this be the warning shot. When times get tough, you see all sorts of crazy things crop up, whether intended by the gov't or through vigilante enforcement like in this case.
What makes EAD holders immune to these sorts of things? Nothing is certain in this environment.
Physicians recently faced a scare(last year) when the USCIS TSC unilaterally started deeming MBBS degrees undergraduate baccalaureate degrees and declining EB2 petitions for them in spite of nearly half a century of precedent to the contrary. This in spite of the ECFMG, ACGME, State Medical boards(vested with the task of determining qualification to practice) etc all recognizing such foreign degrees for Medical/Surgical Residency training and subsequent practice.
It was only after months of lobbying and various letters of support from medical organisations, and meetings with the USCIS by some prominent lawyers like Greg, that they relented.
If that can happen out of the blue to International physicians typically working in underserved areas. Then those of you who feel an EAD card makes you immune are living in a fantasy. Take a stand, organize better and advocate for yourself. There will likely be a narrow window later this year for us, there must be a better effort.
BTW. It took a friend of mine 7 months recently to get his EAD card. No explanation, no nothing. He did not push the issue because he was on a H1b visa, however those are the sort of things that can happen.

I have recently moved out of state and started on a different job. I updated my address with USCIS online last week. I just got a email from CRIS for RFE. I have I-140 has been approved since 2004 and applied for I-485 in July 07. My lawyer is from Frogman firm. This was the firm used by my GC sponsor employer. My new position is slight different from Software Developer to Lead System Analyst. I think this should be covered with same or similar clause.
If you have prior experience please let me what to expect and do any preparation now itself.

if you have EAD and 140 is approved (And 180 passed since 485filed), then why are you worried about H1 status ?
am I missing something here ..I let my H1 expire and am using EAD now.
I had another question - if one has EAD and 140 is approved (and 180 days passed and a person does not hav H1) - then how long can that person stay unemployed ? please reply if you know ..Thanks !!
GC is fo future employment so technically you need to have an employment offer when your GC is ready for approval. You can be unemployed up to that date, there is no requirement for continuos employment.

How did you got your RN and ND. Did you call USCIS? or got from your Attorney?
I filed on July 23rd and signed by R. Pitcher at 9.29 AM and no news so far.

Hello Folks,
I am on H1-B since Aug2009 and last year I transferred around 40K USD to parents. All these transfers were spread over the year in the denominations of 5K per transaction.(As and when I saved money).
My question is, do I have to pay taxes in US on this money transferred to India. I know that my parents don't have to but I am not sure about myself.
Any pointers in this regard will be highly appreciated. Thanks,

You can appeal quoting your friend got approved. I have seen in the past, people got their approvals in appeal.
You must consult a good attorney and go for appeal if you think your employer is willing to help and has the ability to pay, appeal is your best route or go for another job and reaply with your new employer.
