Just saw a soft LUD today. No status change from yesterday though.

all that stuff comes in at I-140 stage. During PERM/LC they dont care about his qualifications, its the job that is being certified.
See the audit questions again, all relate to justifications that the requirements are really needed for the job advertised. ie. when the job ad said MS+2 Years is needed, DOL wants to know why this job requires MS+2 Years of experience. His lawyer is right, a more conservative approach to job requirements (MS+0 or BS+5 for EB2 is much more easier to defend). As you increase the minimum job requirements, it reduces the pool of available candidates who can apply for the job. DOL wants to make sure the minimum requirements are really valid, and not set artificially high simply to reduce the pool of candidates.
Basically your LC sponsor needs to be able to justify all requirements posted for the job (education, experience, specific skills) else you can be in trouble.
Yes audit questions seem to be hinting screw up from employer side but then also it can not be judged exactly on the same line without going into detail of provided job classification, job requirement and furnished docs from employee.Now all of the areas you mentioned are crucial from employer side and in addition to that "employee's degree" evaluation is also done at labor stage,(PERM or OLD LC). My current one expires June 04 2007. The future 797 is valid from June 05 2007 till June 04 2010. But my visa stamping in the passport is till June 04 2010.

It's not the "IMHO" or anything... we certainly all are entitled to opinions - "Canon is better than Nikon" "Nikon is better than Canon" "Contax/Carl Zeiss is better than either" "What are you thinking, Minolta has fine glass too" etc. But it is just the "far superior" thing that got me going, because it simply isn't true, while the other statements certainly do have parts of truth to them. I guess some people do treat camera manufactureres with the same kind of "fanboy-ishness" that geeks do to Intel or AMD. ;)

I had sent an email to rags months before about this friend. He decided to become an expat and move to India while his GC still languishes in the labor stage. He is an engineering manager who works for one of the big oil service companies (Think of word association with the Vice President). He would have been invaluable to this country as the country tries to become more self-reliant in the energy sector. Instead, he now lives in India and services oil wells in Russia. How is that for loss of competitiveness (loss of his service as well as his tax money to other countries)!

I applied for my EAD renewal during last week of Nov 2010, it took only 42 days to receive my renewed card. It got 2 years validity, validity starts from the next day of current EAD expiration date. Even though current card is valid for another 2 months, pleasantly surprised to receive the new card in USPS priority mail. Overall, job well done by USCIS as for as this EAD renewal in concerned.
My priority date is Jan 2007, not sure whether by extending it for 2 years USCIS is not expecting me to be current in the near future. Personally I am expecting to be current during this July - Sep time frame. Worst case at least it should be a touch and go scenario, fingers crossed.

People do not agree and have different ideas - sometimes to the point of personal hurt! - this is natural. They have different interests and even when they have shared goals, sometimes their paths to those shared goals may diverge - this is natural, too. Yes, differences, discussion and divergence can lead to a final separation and then two or mroe new groups are born - and it can happen naturally and it does not have to be rushed or forced through censorship and persecution. But sometimes debates and differences actually help the whole group to stay together and find a better path or a better solution - in the heat of the discussion and in the fight of the dualling arguments a new idea, approach or solution is born. I do think that a lot of the most contentious discussions on this forum are actually the most important and interesting ones because those are the oens that will cut to the heart of the problem and reveal the real depths of the issues. Suppression of diverging opinions is the hallmark of dictatorships.
I agree with you and its good in many situations, but i think unfortunately this does not apply here... if we are not united and don't march together towards our ultimate goal... it will only make us look disorganized and we will come across as a bunch of self centered highly educated fools who don't care about the big picture.
For those who dont agree with what IV is doing, no one's forcing them to follow what IV does and certainly no ones forcing them to be here, but if you are here then you should at least trust the organization in what they do.
If you have ideas talk to the core and discuss with them in person or call them... i m sure they will be glad to take it up if the idea benefits everyone and not just me or you... breaking off driving folks in different direction is not the solution, it will snow ball into a big problem.

My wife and daughter planning to go to India next month. They do not have H4 stamping but H4 validity is there up to next year. Plan is to come back after receiving AP. I am thinking that once their AP is approved I will send their AP to India, and they will come back using that AP. Experts, do you see any problem in this. Please share your thoughts.

I filed in Mid July for I-140 with NSC. the dates in the web site shows in November 2005. Are you sure the dates are currently in MAY 2006. I cannot upgrade my case to premium processing for technical reasons. IF the dates are in MAY/June, I would appreciate JAnilsal if you can reconfirm them.
Approvals for Mid-may have started now. They are in that region. July cases would be Nov/Dec.

My understanding is that Sen Maj. Leader and Min leader pick senate
conferees. Similar with house. Democrats support the bill. Most of the
republicans oppose it. House and Senate Bill are different like day and
night. The bill has to pass because.
1. Enforcement and Boarder protection is highly needed and the house
really want it. If they need it they have to make some sacrifice accepting
guest workers program with slight modification etc. Otherway the CIR supporting conferees may not agree and bill dies leaving things same as now
which nobody wants.
2. Election is approaching. Most of the leaders in Rep party openly admitted
that Enforcement only bill will affect them adversly
3. Mr. Persident is a strongly supporting Guest Worker program.
4. If a enforcement only bill is pased thats going to affect the relationship
with Mexico.
I believe the House is against legal immigration too. Otherway some provisions might have survived in the budget bill. My biggest worry is that
if CIR supporters and Opposers (conferees) will be happy to remove legal immigration provisions in the in the reconcilation process and call it deal!
