Indian companies like Satyam had been running these farce show of outsourcing for long time, and finally the reality is surfacing up. Not only did these companies run scam with their investors but also with their clients and employees.
As a client I see them initially low balling the real cost to obtain business and when the in-house engineering capabilities have been eliminated, they will start jacking up the prices. L&T did this with us and thankfully this month we are finally kicking their a$$ out of our facility. And we will do real engineering here in USA!
Couple of years ago, I ran into an indian at one of my visa renewals outside US consulate and he told me how, Satyam forged papers to have him slip into USA on L1 and than once here convert into H1 so he can finally apply and obtain GC. All these years he worked for remarkablly low wages.

Yes, when you join work you need to fill a new I9 to officially claim your right to employment using an EAD (if you have entered as an H4). Basically, this is the documentation to prove that you are undertaking authorized employment and giving up your H4 status.
Now, if the underlying 485 of the primary applicant gets denied, then you can continue working if your H1 is still valid but sadly your wife cannot work and has to stop working immediately until a MTR is filed and USCIS resumes the case processing pending decision of MTR.
A friend of mine was in this situation. His wife stopped working, their lawyer filed MTR (wife took unpaid leave of absense for 2 months) and after the case status changed to under consideration, she resumed working. Remember, the EAD is only valid as long as the 485 is not in a denied status. If employment is continued after 485 is denied and before MTR is accepted, you can later face problems for having engaged in unlawful employment in case you have an interview.

Hi Mike. Please don't mistake the spirit of this post. By no means is it a "wish" for Nikon or Canon, or any manufacturer to be "on the ropes". The very simple fact is the D2h does not compare to the Mark II. That is from a shooters perspective. Not only my personal experience, but of other long time Nikon shooters I know who are switching. I also know from personal experience of a major wire service bureau who is not happy with the D2h quality as is switching to Canon. My observations are based on my working experience, and that of other working PJ's that I interact with on a regular basis. I truly hope Nikon's next camera and their cameras after that are killer. That would be best for all.

I am little confused here, do they take into account the reciept date or Notice Date ?.
My Application was sent on July 2, and ack on July2, however the application got transferred to Nebrska, CA and back to Nebraska, and I am told the Notice Date is Aug 30. (If I go to Online website it says On Aug 30 we recd your appln like that) But I am July 2 filer.
So if I want to move, should I think i am safe after 180 days which is jan 3 or is it March ?

Making it more strange .My I-485 got denied om april 18th and my wifes 485 denied april 19th and online LUD says denail mailed on april 21 for both and then on april 22 i see I140 denial amd mailed but we didnt get any on denail notices yet .

In central NJ, I called over 9 Doctors and only two of them had an appointment before July 1st -2nd week.
One is Dr. Neil M.S. Estrella in Clark, NJ. Appointment was available for Monday June 18th. But the fees for the exam plus vaccines is $430. The second one is Dr. Marcel Stern in Piscataway, NJ 08854. Appoitnment was available for Thursday June 21st. The fees was more reasonable at $350.
If you're in Central NJ, Hurry, Hurry Hurry.
P.S - If some of you get other appoitnments in NJ, post here so that others will know and not waste time calling other doctors.

I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.

dont worry about actual salary being higher than LC salary.
i had the same issue last year...my bonus put my total salary over $50K than what was listed on the LC. i checked with my lawyers and they said that was fine.
Just curious - Have you heard of a case being rejected just because the salary was higher than the original LC ?? (Assuming job title/description are same or similar). I think it will be almost impossible for them to reject just because is higher!! Govt. cannot dictate the upper limit of salaries (in private sector).

I know that its a greayarea but are there any general guidelines on the O*NET code that will pass as same/similar test of AC21. For example if a person change a job from a job code of 15-10xx to 15-10yy is less risky; while changing from 15-10xx (programmer) to 15-20yy (mathematician) might be more risky etc.

My employer revoked the i140 of a person after 180 days. He did not reveal this information to me and used labor substitution for me.
The other person used AC21 and got his 485 approved. INS has denied my I140 since a 485 has already been approved and there can be only one GC on one labor. INS says that once the 485 is approved that job ceases to exist.
My company is saying that they have done this in the past and got approvals. They are saying that they applied the I140 substitution long before the 485 approval of the other person.
Now they are saying that they will appeal that the other guy never had the intention of working for the comapany.
Is there any chance for the I140 approval and using the existing labor ? If not will the INS help me keep the Priority Date.
Does anyone have knowledge of such cases (or) know the results of such appeals.

Reasons:
- Section 203(b)(2)(A) of the Act states
- 8 C.F.R 204.5(I)(3)(ii)(C)
These are related to the Education for 3 yrs degree..
- What is the next step ?
- What is the chance of a positive result?

You should not have quit the job under mere threat of lawsuit esp. when he did not have anything to hold over you anyways, In future, of course, just to be on safer side, send a back dated letter with your resignation and date it to your last working date for that employer that way your 12 month counter starts from that back date..

I agree with you. But you don't have to go far to find Google at fault. If you look in the Indian English Media, you will hardly find any news regarding Diwali. If they put some news on Diwali that news will be like "Dismal Diwali" etc. I am not kidding. This is the news regarding Diwali in CNN-IBN.

Thats correct. What I meant was, if you're planning to come back before 04/30 then are you planning to come back with the current visa or are you planning to get the new one stamped?
Also, you don't have a date gap in your visa in the passport. I-94 expires 04/2007 and have a new 797 from 05/2007. So I think you are good. But in my case, my I-94 expires 01/2007 and I have 2 797s: one expires Jun 2007 and the other one will be from Jun 2007 to Jun 2010. So if my visa is given based on my latest 797 (3yr based on I140) then how do I enter US before Jun 2007?
