We cannot predict the future but we can predict with some given statistics!
If people who got their AP from NSC could just menion how long it took for them to receive ap document it would be statistical and we can there upon make some judgements !!
Noone is asking for exact dates from USCIS. We are all still very much in a limbo and this is just for getting some heads up!!
TSC is taking about three months. Mine took three months and I applied on July 2nd to TSC. So, my guess is statistically, at least 3+ months for NSC, since they will be concentrating on sending out EAD's.
But, I leave it to others to give specific numbers.

I140 denied from NSC .got REF on 03/08 . Was for A2p.fellows got same RFE and got approved from same employer but mine got denied .Didnt get official notice yet .What are my options .please advise.
Im on 4 ye H1b .and have option to change employer and also have option to keep the same employer and work for another employer at the same time .

Keep your options open regarding changing employers and file for an appeal if you can. Notice should tell you the reason for denial. What is your employer/attorney saying?

Thanks! I have visited this web site before. Now my doubt is, if I show my EAD as a proof for the status, I am worried about they will give DL only for 3 months i-e till the validity of EAD. Then I have to go again to DMV after 3 months to renew again for another 9 monts validity of new EAD. This is pain in bu--, as it continue till I get GC. Due to the retrogression, I do not know when I will get GC.

Curios, is your employer desi. Wait for sometime, tell him that you need to go to your home country and need receipt notice to use your AP in return. Catch is you have to use your EAD & AP after return.
There's no catch at all.....according to my lawyer. He said even if you come back on AP, you can still work on your H-1B so long as it's valid.

Why dont we call it a day on this issue. The OP was venting frustration, and feels entitled to do so. Nothing wrong with that, and there is no need to question his motives or logic. Considering what all of us are going through, there is a lot to be said in favor of letting out steam.
Lest anyone feel offended for anything I have said, I am not being patronizing. Indeed, after five years of wait, I feel like a good crib session will do me good too.
Chill out and enjoy the weather....after weeks of awfully low temp., the sun is out and the weather is glorious.:)

I'm sure you might have thought about this when you switched to the Fortune 500 company and knew what you were getting into. If you feel you have a chance at the EB2 by switching back to the previous employer, I think you should do it. Once you get your residency, you will have plenty of opportunities to work for even Fortune 100 companies. For now, just take the plunge and get ready for your dates to become current.

He will be out of status. Your 3 year extension beyond the allowed 6 years is based on that LC/I-140 from which your I-485 was filed. If the I-485 is rejected you have no right to stay beyond 6 years....

One can work on current H-1B (irrespective on basis it was approved), until the H-1B petition is revoked or canceled or expired. However, beneficiary is not eligible for new/extension of H-1B after I-485 denial.

Just want to share the info that I have received the Permanent residency approval notice Y'day.
Have been here in us for more than 10 years. No more h1b renewals/ stamping, DL renewal issues/ EAD issues etc etc.

I applied for my EAD renewal during last week of Nov 2010, it took only 42 days to receive my renewed card. It got 2 years validity, validity starts from the next day of current EAD expiration date. Even though current card is valid for another 2 months, pleasantly surprised to receive the new card in USPS priority mail. Overall, job well done by USCIS as for as this EAD renewal in concerned.
My priority date is Jan 2007, not sure whether by extending it for 2 years USCIS is not expecting me to be current in the near future. Personally I am expecting to be current during this July - Sep time frame. Worst case at least it should be a touch and go scenario, fingers crossed.

No, there is old Child Protection Act and it protects from aging out while I-140 is in process. So child age is determined as age on time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS.

My questions are - Will I be able to extend my child's H4 beyond his 21 years, assuming I continue on H1? And will I be able to adjust my child's status when visa becomes available?

Babu, thanks for confirming that this stupid rule is in fact true. I always wonder how USCIS gets crafty in making new rules.
It will be easier to just get the stamping done in INDIA. That way, will get stamp till 2010.

I am an Indian National residing in US for the past 10 years.
My labor was filed in September 2006 under Eb3. I received my EAD in 2007 and my current legal status is EAD. Since 2006, I am with the same employer.
In 2008, I got promoted to a Managerial position which requires Bachelors and
minimum 5 yrs progressive experience. I also have a Masters degree in the same field.
I want to port my application to EB2
1. Will this result in me loosing my EAD?
2. What will happen if there is a problem with the new EB2 application - will it also impact the EB3 application?
3. Is it better to change companies to do the porting?
Please advice.

i applied for EAD on Dec 21st, got card ordered for production email on Jan 21, and got the card via USPS 2 days ago. My PD is just few months away from May 2006 (EB2), but I still got 2 years validity (on the EAD card).
I cannot possibly imagine the fact that PD wont move even a few months when spillover begins.
