My BC does not contain my mother's name. I am getting an affidavit from my parents to support my BC. Do I also need a document from Municipal Registrar similar to what is needed if Birth Certificate is missing? Thanks!
In your case, you have the birth certificate, so you don't need to submit the non-availability certificate. It is better you contact your municipal office and apply for your birth certificate with your mother's name included.

I received IRS tax audit check for year 2005 last week. I guess mostly I can defend my audit and I have scheduled an appointment with IRS tax manager for next week
However god forbid if I have to pay penalty on audit,I was wondering this would impact anything on my 485 process. Does it have any impact

more H1s is not only good for the employers, but also potentially for the economy. More taxes coming in, more pple putting money into the flow by buying things/cars etc. If they look at it more from economy perspective, this cud get approved/passed. Sorta kickstarting the financial situation.

The elimination of NC delays will reflect positively on many pending applications with earlier PDs.
One other such positive result can come by capturing lost Visa numbers, something that can potentially happen through the letter campaign. Let us hope it goes as planned.

Hello,
So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.
He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.
I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.

i believe that whatever the above stories convey it does not apply to skilled workers......life in india/china has got better only in the last 5-7 years....otherwise i have seen above average people in india retire with barely enough to live a good life.
if a skilled worker spends 6-7 years in usa with good financial planning he can easily retire, unless one has really started living the dream(big car....big house...all the latest gadgets....yearly india trip...etc..)
i do agree that this story can be related to a non-skilled worker from any country....(even below average americans have nothing except for social security when they retire....)

Assume billing rate: $90K - $100K per year
Consulting Company cut $ 30K - 40K per year
Let's say average salary is: $60K ( i know many professionals r working for even less but let's include some little rich guys too :) )
Now 60K means $5K salary per month
After Family Health Insurance (considering married) & taxes salary in hand is $3500 to $4000
Let's take $4000 in hand
Now expenses :-
House rent : $850
Car Insurance : $150
Car Loan payment : $250 (assuming used Toyota/Honda for 8K - 12K, No big dreams :) or rich lifestyle )
House Utilities bill : $150 (like water, electricity etc)
Cable/Internet/phone : $75 ( No HBO or special channels - No big dreams :) )
Grocery : $500
Eating out once a week : $125
Lunch out : $0 ( ask your wife to give u lunch :D - No big dreams)
Misc $300
Total monthly expenses $2400
(living an average middlecalss lifestyle)
Savings per month 4000 - 2400 = $1600
Now in 6 - 7 yrs (assuming the person worked like a "Donkey" :D with not a single vacation , no trips to india)
12months X 6/7yrs X 1600savings = $ 115,200/ $134,400 (Total Savings)
Do you really think this is sufficient to buy a house & lead a retired life either here or in india ???? or maybe i hv started thinking big :D

I have a question on this:
I understand that USCIS can raise an RFE anytime even if PD is not current. However, lets say if they raise an RFE for EVL today, and the person is working in same/similar position and replies to the RFE.
Would that mean that USCIS will not raise an RFE again on EVL? What happens if the person changes the job an year after that?

One should remember the history of immigration in US. US histroy is more than 200 years. Most of the immigrants came/occupied the US, entered illegally. Legal immigration is still very new to US, by considering lenghth of immigration in US. Furthermore, till 1965, asians were not allowed legally in US to get GC. They do not like law obeying asians. This is the history. This is what it is going to be in future too.

Really great job on the singing Pankaj!!! It was really impressive!
Even though it was not really the anthem for anyone there, it was a nice gesture to sing the national anthem of the people we are asking to help us. Plus, it is the only anthem that we all have in common...

The Immigration and Nationality Act (INA), the section of government law that guides immigration, specifically states that any non-immigrant alien visitor to the United States must have a passport that is valid for 6 months beyond the intended period of admission. That is to say that if your program or employment runs until May of 2008 you must have a passport that is valid until at least November of 2008. If the alien visitor is from a country that is in agreement with the United States to automatically assume that the alien's passport is valid for 6 months past the passports expiration. These countries are referred to as 6 month countries. That simply means that if the alien is from for ex. India and the passport date will expire before the end of of program date, officers are allowed to make the I-94 valid until the end of the passport. If the alien is not from a 6 month country the officer can only admit the alien with an admission date on the I-94 with a date that is 6 months before the passport expires. Officers at airports and deferred inspection offices do not have the authority, at a later date, after a new passport has been obtained, to change the original I-94 to the date that would have been given at the original time of entry had the passport been valid for 6 months beyond intended period of entry. The alien must request an extension of stay with an explanation submitted to the USCIS office, no fee is required, and a new I-94 with the appropriate date will be issued. However, if you call USCIS and are fortunate enough to get to speak to someone, that person, an information officer, with 2-5 weeks training, will tell you a CBP Officer can change it. Some officers will change the I-94, however, they have no authority to do so and can face penalties for doing so.
