I am not sure how encouraging it will be for you to hear about some of our friends in tristate area.
Pretty much like you (Desi employers, 80/20 or 70/30 arrangements, found contracts through dice/monster/hotjobs, filed in jul 07 fiasco and AC21'ed off to full time positions). There is nothing wrong with these arrangements but unfortunately they are considered pretty much illegal from the H1b & immigration point of view.
Employers of many of them who have received their GC and many who are pending are currently being investigated. First they closed the gaping hole called substitution and now they are after all these sketchy employers and the petitions pending/approved through them.
It sucks for people whose petitions have been approved and are now trying to crystallize their lives by buying homes, etc. Administration holds the trump card in that they can revoke GC/citizenship anytime.
Few of these desi employers were nice enough to notify the beneficiaries. Many of these cases involve people who filed for EB2 i-140 to capture their EB3 dates after changing employers.

Interesting. This problem is also there. I e-filed for my self and my wife, so the payment went through credit card.
For son, I filed paper based EAD and check was in favor of USCIS, so I am very much confused about the alternatives you have mentioned - both don't include USCIS.
When I applied for EAD and AP (paper filed) my attorney advised to make checks payable to �U.S. Department of Homeland Security�.

I appreciate your input, but IV members have been talking about numbers and numbers and numbers for last 2 years in a row.
What will the numbers reveal? I had been a regular blogger at IV, but I stopped coming up here because.
1. All talk and no Walk
2. New members come aboard, are rude and offer no pragmatic approach.
3. All these bloggers give ideas and critique each other.
4. What happened to the March1 09st rally in DC?
Why has IV not taken a pragmatic approach, don't take me wrong I respect what you have done and other approaches in the past. But IV is using same approach for a new problem, the end result-----Failure
I joined this community after july fiasco, and have kept close watch on dates, everyday members keep suggesting something or the other. I don't mind being a donor to IV or contributing little what I have, But I need to see some big movement and results.

what was the result? If IV wants core members and new members to donate and be a part of something bigger than a website, then please initiate something big like a rally.
Just because their are less members to join, does not excuse a true purpose of a rally.

2. Be a donor,
I understand all this, but I as a visiting members and the people coming on here, want to see a true and real reason to be a part of IV and not just a website where immigrants come and breathe out their frusturations July Fiasco turned to be advantageous to a few members, but was a mistake for members like me and other members who could not file at that time.
Please prove me wrong and IV to be something more than a website, please initiate something big and real, and not just comments. I an aware of the achievements in the past, but it was past 3 years ago. For last three years immigrant's feelings have been played around too many times. My wife's H4 expires on Oct 1, 2007......We plan to file our I-485 by July 16, 2007.......I am sure it will take atleast 90 days to get her EAD.....whats her status between Oct1,2007 till the time EAD gets approved?......Will she be in valid status during that period?

Anyway - like I was saying freedom of speech and expression is very important for people belonging to any culture / country. Some people might think business / technology alone will ensure properity for the people involved - but the important thing to remember is that - business / technology is also a by product of these freedoms. When your mind is unrestricted by limitations and regulations - you get more innovative ideas - and you can also spread them easily.
Donot let your cultural / religious commitments hold you back - most of them are unfounded and lack evidence anyways. This is one of the reasons West is more progressive than East - because they lean more toward reason instead of tradition etc., - and they say it out loud also which we don't do. This enables them to get the bullS*it out of the way first and concentrate on constructive things - innovate, do business blah blah blah!!

Who said the position must be in zone V only to qualify for EB2?
For the position to be qualified for EB2 it must require MS. For position requirements to be considered "normal", they must fit into the respective zone in terms of SVP level. As I learned from my bitter experience, though offficially for a PERM to be approved the requirements don't have to be "normal" (if they are not, you just need to supply the "business neccessity" letter), it looks like the current PERM's software just doesn't have such possibility "in mind" and automatically denies the application if the total education plus experience requirements exceed the SVP level for the zone corresponding to the position. You will get a denial notice which will blatantly claim something like "By answering YES to question H-12 you have attested that the requirements are normal, but the total SVP level exceeds the normal level for this position..." even if you have answered NO to that damn question! Therefore I don't recommend to exceed "normal" SVP level for the corresponding position code.
However, if a suitable code falls under zone IV, nobody (except for emplyer himself maybe) can prevent the employer to require, say, MS plus 2 yrs of experience. And it is within "normal" SVP level for zone IV, and it does qualify for EB2 (because it requires MS).

I just want to point out one missing thing here. I read all postings here and you guys talking about "People like lallu, Jaya, Karunanidhi, Naidu etc,". Might be you will add some more names for this category. I am sure most of the above patriotic Indians will not like to add names like Bal Thackeray, Modi etc. Majority of you guys like to add names like Dawood ibrahim (I hate guys who kill other human being including this guy) to bad guys list. At least people like "lallu, Jaya, Karunanidhi, Naidu etc" are Ok (that does not mean they are good). They kill one or two (might be 10/50) for their self interest and money. Guys like Bal Thackeray, Modi killing entire community openly by taking Police support. Same time so called patriotic-Indians elect these guys and make chief ministers. I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.
I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.
I think this is a wrong forum . you might want to get in touch with NRA (most of the members of NRA are very conservative ) .... They might help you or make you a plaintiff in a lawsuit.. Supreme court may very well favor you given their recent second amendment rulings :)

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.

A growing number of states now refuse to issue driver's license beyond the validity of I-94. that means that until your H1 extension is approved, you wont get it, because the new I-94 with new dates will come only after your extension is approved.
Now, in Arizona, they accept receipt of H1. In Nevada they dont. Other states have other rules. I know only about these 2.

Your employer should bear the expense of premium filing because the employer procrastinate and delay filing of extensions even though its possible to file extension 6 months ahead of expiration date. IMO, we all are in the same path, some ahead of others, but basically belong to the same larger SET. Some of us have faced the problems that students are facing now, and in all likelihood these students will face the same problems that we are facing now. More personally though, I always think, if only I knew more about the GC process back when I was in school( 12 years ago), I'd have been much better now.

If your education was equivalent to US Masters (16 years) at the time of filling labor, in your case more specifically MTech or MCA etc. (16 years education) from India, both equivalent to US masters then it�s a wrong denial.
