Hi guyz,
Bit of addtional information that might be just what was needed to make final call.
I spoke to Fragomen, my Law firm, and they informed me that priority date for filing I 45 (Green Card last stage) is current for Labor applications (EB3) filed in April 2001 and unless something dramatic happens again, things will move at its own pace.
My Labor (in EB3) was filed in March 2003. Estimated time to get GC might be anywhere between 1 year to ... who knows....
I am leaning towards resigning and start it fresh.. wherever...even If it is US fresh H1 will always be there.

To bring updates evey week or every month , we might need to put an advt for a accountant for IV, unless you can wait for yearly updates.
huh ?? what's wrong with having update to date count on IV contribution and balance ? If people are funding IV , then IV can post where that money is being spent. IV is non-profit organization.. right ?

I am sure we'll all hear from IV core team when it's time to start our phone and fax campaign in support of this or any other beneficial EB provisions to be included in the supplemental bill, if it ever happens of course.
I believe this is where IV stands in terms of strategy:
For minor/intermediate relief: Supplemental bills.
For major relief: SKILL Bill
For everything else: There is CIR :D

IV should publish backlog examples such as this one to the media. This person has waited for over 7 years to get immigration benefits from the govt!!
Maybe I am missing something here but the green card for this beneficiary was started in 2005. The PD of 2000 is due to a labor-substitution. Aren't those the facts here?

I am not sure whether the thread digressed away from the original discussion on how to get the copy of the labor cert.
If that is what you are still looking for, here is a sample FOIA request (http://nixstor.blogspot.com/2008/01/how-to-get-job-description-and-salary.html).(part 2 of the blog post) I did last year and got it after 4 months. I hope DOL beefed up their resources.
DOL not only sent me the ETA forms, but also sent the whole enchilada of ads run by the sponsoring employer and other supporting documentation it provided.

The potential for misuse is too much. So I only support GC for someone with a PhD, even though I have a Masters.
Even with that potential for misuse will be very high...you will see people doing "PhD" in bottom of the barrel university ranking places. In fact professors who give easy PhD in easy university will be in hot demand. Nowdays people try to do good PhD in good university as it helps in getting a good faculty position eventually...this will bringa whole new dimension to why people will do a PhD in US. 3 year PhD like in UK will get prevalant in US.

Hi there
Yes, when you join work you need to fill a new I9 to officially claim your right to employment using an EAD (if you have entered as an H4). Basically, this is the documentation to prove that you are undertaking authorized employment and giving up your H4 status.
Now, if the underlying 485 of the primary applicant gets denied, then you can continue working if your H1 is still valid but sadly your wife cannot work and has to stop working immediately until a MTR is filed and USCIS resumes the case processing pending decision of MTR.
A friend of mine was in this situation. His wife stopped working, their lawyer filed MTR (wife took unpaid leave of absense for 2 months) and after the case status changed to under consideration, she resumed working. Remember, the EAD is only valid as long as the 485 is not in a denied status. If employment is continued after 485 is denied and before MTR is accepted, you can later face problems for having engaged in unlawful employment in case you have an interview.

What about those new foreign workers who have yet to look for a job and start the immigration journey from the scratch?

Guys
I filed my EAD recently and here is what you should do,
Send the supporting documents to the address mentioned at the bottom of your receipt.
Documents I have sent,
1. Cover Letter
2. Receipt Notice for online EAD filing
3. your earlier EAD paper in which your EAD arrived ( if this is renewal)
4. Your 485 Receipt Notice
This should suffice.
P.S I have already done finger printing.

I applied for my EAD renewal during last week of Nov 2010, it took only 42 days to receive my renewed card. It got 2 years validity, validity starts from the next day of current EAD expiration date. Even though current card is valid for another 2 months, pleasantly surprised to receive the new card in USPS priority mail. Overall, job well done by USCIS as for as this EAD renewal in concerned.
My priority date is Jan 2007, not sure whether by extending it for 2 years USCIS is not expecting me to be current in the near future. Personally I am expecting to be current during this July - Sep time frame. Worst case at least it should be a touch and go scenario, fingers crossed.

Thanks everyone for being patient and supporting us. The work is happening at all ends and it is an uphill task.
We really need to increase our membership. Higher membership will mean us looking tall when we meet lawmakers. Please all try to help us spread the word of IV to everyone you know that is stuck in retrogression. We represent at least half million people but we currently not even have 6 thousand members. Thus we have to bring lot many people into IV. I would encourage everyone to pls. register on this forum instead of being visitors.

Many users just browse through the forum/website. How about making the forum available only to registered members ?? This will also make users register/login. Remove anonymous access to forum
