    Everybody should use this template to e-mail the reporters and Senators. Its point blank and thought provoking.

    I just read the summary prepared by IV core team -a job well done.

    I like to think that being illegal is better than legal as per the provisions in CIR!

    What do you think of H4-spouses who can't work whereas those illegal can now apply for a work-visas!

    What do you think of parents who were not issued visitor visas for silly reasons? Whereas those who by hook or crook got here are being given work-visas?

    How come the illegals are guaranteed a GC within 5 years and the current legal immigrants are NOT?

    How come the illegals can work and the legal residents on certain visas can't?

    How come the illegals can work for any employer while H1Bs can't?

    I am not against giving these benefits to illegals if that's how it needs to fixed. But what about us, the bright and good folks!!

    When did h1b become a joke?

    This grand-compromise is not making sense at all. It's smelling real bad for legal-visa holders.

    Not that easy and good as it sounds.
    There is a per country quote and yearly wastage you need to factor in.

    Is per country quota true even during last quarter? I thought it was not in July 2007 and going by previous years history, India EB3 has always been getting more than their alloted 8000 (or whatever) numbers!

    And, just like wastage, I have not accounted for duplicate filings (which I guess could be a lot)!!

    So, 4 years - to me seems reasonable.

    I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other? :confused:
    Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
    Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... :eek: Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? :confused: Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR? :confused:
    I should mention that the GC is the choise No1 , and PR is a plan "B"...
    I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.
    Appreciate all useful answers and ancillary information. :):)

    chisinau, in my personal experience, applying to US GC is not viewed favourably by Canadian authorities. When we tried to land in Canada, the immigration officer specifically asked us if we had applied for US GC. Also, be sure that you do not insinuate to the Canadian authorities that your first choice is to stay in the US, but make all efforts to show that you will be moving to Canada permanently as soon as your PR is granted. The Canadians do not like granting PR to people who are going to use it as a backup for their GC process.

    Hi Folks,
    I had been to canada to get my Visa stamped for my 7th in March'07. At the time i was entering United States, the immigration officer did not issue the I-94 to the validity of visa since my passport was expiring on Oct 27th 2007. I have a valid visa until April 2010. The I-94 attached to my passport is expiring on Oct 26th 2007. Do i have to renew my I-94 without fail? Or should i just an new I-94 next time i go out of the country and come back?

    Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.

    All our cases show this status now.

    Any idea what happens next?

    Current Status: This case is now pending at the office to which it was transferred. The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register.

    Where in the email does it say that the case has been transferred to a "LOCAL" USCIS office? From your information it appears that you are a July 2007 filer. Please check your 485 receipt number, if it starts with anything other than LIN, it means that although you mailed your application to the NSC, they sent your packets to either CSC or TSC for data entry. Now that your PD is current, it is quite possible that this office is now sending your packet back to NSC (which has jurisdiction) and is now pending there.

    I say this, because, the same thing happened to me and many others whose 485 submissions were sent to difeerent offices for receipting and then those packets were sent back to NSC.

    There is a provision to withdraw the 401K without the 10% penalty. To avoid the 10% penalty, there is a rule called "72(t) - Early IRA distribution". But there are certain rules that need to be followed for this - and I am not aware of how it actually works. The only reason I know this is because I asked this question specifically to the accountant doing my taxes and he said that if I were to retire early, I could avoid the 10% penalty by claiming the 72(t) clause. However, he said that certain "rules" must be followed and you must withdraw certain amount every year - else you will be subject to the 10% early withdrawal penalty.

    I didn't follow up on this rule as I was not interested in "early" retirement. I just wanted to know if it was possible to withdraw without early penalty. I would suggest you follow up on this if you want to take all your money to India without paying the early withdrawal penalty or paying much in taxes - either here in the US or in India.

    It is FBI that is responsible for namecheck ... not sure USCIS has any control over them. My understanding is I-485 premium processing would apply only to USCIS processing of the paperwork.

    Then, of course, it won't help much because for most people name check is taking 2 years, and 485 processing via the regular route takes less time than that.

    My wife will be on H1(currently on H4) october onwards...we received our EAD's yesterday. Can I still go and apply for SSN? I mean will that mean she is on EAD and H1 no longer valid?

    Not simply because she applied for her SSN.

    The EAD kicks in, once her employer fills out her I-9 using her EAD as permission to work inside the US. If she holds multiple jobs, then entering EAD into one I-9 will mean she has to ensure that she has all her I-9s from all employers updated to the EAD.

    At this point, the H-1b is no longer used, but does not get cancelled (unless the employer revokes it). It just goes dormant and can be revived again by filing an extension. Another way is to go out of the country and return using the H-1b visa.

    Dont buy air tickets that fly thru UK. Be a dignified India and question why they need a transit visa, when you are not going to set even 1 inch outside the airport.

    To all Bachelors

    1. you can files your I485 and later add your spouse if the dates are current or you have the priority date.
    2.You can apply for EAD during I485 and at the same time can be on H1 unless you don't change an employer using EAD.
    3.Unless you add your spouse to I485 process..you have to maintain your H1 status as your spouse will be on H4.
    4.BY any chance your I485 is approved before adding your spouse(present in US)..you have 180days to apply for your spouse.
    5.If your I485 is approved when your spouse in outsite USA..then you have to go for consular processing.
    6. No one exactly knows if the PD will remain same or not.

    So anyone about to marry or planning to get married,talk to your attornies about your situation and take a decision.


    Thanks for the info. I still have a few doubts.

    For 1. I will be having the marriage certificate at the time of filing, which will be in July. That time my spouse will be in India, as she will apply for her H4 and then come (latest by August). What I wanted to know is that if my PD is NOV 2006, doesn't that make me current. I know people are saying that visa numbers may not be availabe in Sep, but if all PD are current till June 2007, and if my wife will get my PD, what difference does it make if she files in Aug or Dec 2007. What will happen in Dec that will not let her file I-485. I am meeting my attorney next week, but with the pathetic interview scheduling system, it would be good to know so I can get an earlier date for her.

    For 2. If I do change my employer, using my EAD, and if my spouse is in US, what status will that give her. a. If I file her I-485 and b. If I am unable to file her 485, if the visa numbers run out.

    For 6. I am still unclear as to how the PD may not remain current. How can a PD go back, if PD is June 2007, doesn't that mean everyone who has approved I-140 till then is automatically current (No matter when they file).


    I know others may have similar doubts so posting here. I will post the comments by my attorney as soon as I meet him.
