Guys,
I keep hearing that "STEM will be exempt from the quota". What EXACTLY does that mean? Does it mean that:
1) STEM's can apply for 485 straight away if labor is approved regardless of PD?
2) STEM's still Cannot apply until PD is current, but after that no more waiting for the country quota

These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.
Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is discrimination. Trust me when there was SLAVERY in the US , it was defined LEGAL.

Thanks everyone for writing to the editor
I got an e mail from customer service this morning stating they had forwarded my letter to upper management.
It(this issue) definitely got to their attention loud and clear, and hopefully it will have an impact of both sensitizing them to this separation in the future as well as prompting them to give our issue more coverage going forward. Perhaps I am being optimistic here, but one can only hope.

Will CIS generate the Receipt notice first before transfering the application to the appropriate service center. ( like transfering the application from NSC -> TSC when the I-140 was approved at TSC but filed at NSC)
They will not generate notices before transfering. Receipt notice number depends on the centre processing your application.

Actually, I dont know how to tackle your issue but I went ahead and certified my 131 efile without putting MI as I dont have it. I am waiting for my receipt now. I think, its an USCIS application issue.
I have heard that USCIS is going to bring a law. Which states that if you have used AP you have to use your EAD. Or After using if you extend your H-1B than you have to go for a visa stamping. I am confuse how true is this rumor is?

Hi,
My wife is doing residency using her EAD and she wanted to start a medical staffing company. Would there be any problem from the 'hospitals' since she is working as full time employee or is it depending on the individual hospital contract?

Can anyone with some indepth knowledge predict availability for EB3 Rest of world (Canada). Here is some of what I understand - although I know it may be wrong (some infor from Shusterman site)....
- 300,000 applicants in BEC
- assume 200,000 get through
- assume 1/2 have a spouce and 1 child
- therefore need 400,000 visa numbers (Shusterman had 300K here, I think they are wrong??? - pls check my math)
- now most EB immigrants are from China & India (half?????) - restricted to 7% of the annual 140,000 EB visas annually
- all* applicants up to first half of 2002 are "gone" - *except for ones in BEC = how many????????????
- AND if rest of world is 200,000 people in line for 120,000 visas annually (140,000 - 7% China - 7% India)
- now people in line go from 2001 - mid 2005 in BEC??????; but very few 2001 & 2002s left????
- thus: rest of world with PD of March 2004 - should get visa availability within this fiscal year - e.g. by Oct 2007????
