    Can you please share your experiences with renewal of Indian passport in US. They are asking for 3.5cm x 3.5cm photos which are not same as the regular passport size photos. The CGI Houston website mentions passport size photos as requirement in some places and 3.5cm X 3.5 cm photos in some other places. Can you please share on what you did for the photos? thanks a lot.

    Mumbai consulate.
    They asked for zero documents.
    I had taken a ton of documents
    Salary slips
    Tax returns
    I129 petition copy
    H1 approval
    Name it I had it

    But he asked me nothing

    Does mumbai consulate still require you to submit documents in advance (4-5 days) of the interview date ?

    I had similar issue with my spouse H4, then I applied her H4 again before the I-94 expires on the pass port. In my case (h4) costed only $200, I didn't wanted to take a chance then applied and got the extension. If you want to safeguard your status, you better apply for H1 extension, if it is really expiring they will extend your H1 otherwise they might return saying you cannot apply for extension prior to 6 month of expiring.

    So decide yourself, don;t ask peoples opinion too many times, you always get mixed results.

    NOTE: according to my employer, I-94 given at the POE super seeds all the other form of I-94.

    I visited my local USCIS office and the officer told me that they don't do I-94 updates and asked me to contact the CBP office. When I called them up to get an appointment, I got transferred to a lady who asked me the details. After listening to my case she said its perfectly okay and asked me to attach the new I-94 from the 797 to the passport. Is this true?

    I am trying to get hold my lawyer but in vain. Please help!!!

    I am sure lot of us who are stuck in this GC mess like you can relate to your frustration and must be looking for a backup plan. There are certainly other attractive options like you mentioned if one does decide to jump ship and frankly I have done the same. Should this GC issue not get resolved in a reasonable amount of time, I am fully prepared and ready to jump off of GC wagon. I suggest we all do that.

    The reality is that we are just being played upon by the companies and the US govt regarding green cards. Employers know that we are not going to budge from our jobs to maintain the coveted priority date and the government is in no big hurry to reform the system as they can collect taxes from us without being accountable to us.

    I think Democrats are also going to drag the immigration issue as seen by the article below :

    I do not mean to doubt IV, but the writing is on the wall that our lobbying efforts are not going to go too far.

    For all of you single people out there, the only fastest option is to marry a US girl/guy. For all those who are married, the choices are simple, forget the American dream and adopt a Canadian or Australian dream or endure the uncertainty of a green card application.

    I have reached the conclusion that I cannot bear this uncertainty any more and therefore, I am pursuing other options. Ciao...Good luck to all those waiting for a GC!

    Sometimes I think that rather than writing to these politicians ,we should write to USCIS.This retrogression is caused by them.They didn't wait for any bill to be passed for this retrogression.There is no use of talking to politicians,they don't care.
    I know that USCIS will not care either but USCIS did it out of nowhere ,till sep2005,everything was fine for them and suddenly in oct 2005,they put us in backward direction.Now after a year and a half ,we are at the same spot,waiting for the visa bulletin and staying depressed for a day or two after seeing it.
    I don't know .I am so mad at everybody.
    Sorry for the ranting.
    Btw,i have already sent emails to USCIS and chicago tribune regarding this .

    Perfect....
    Yes I called the original civil surgeon and the TB test is going to cost $15 only and Xray $40.

    I found the reason I got the RFE.
    I had a copy of the last TB test report.
    That civil surgeon FORGOT TO CHECK MARK the TB test !!!!
    He checked a different section !!!

    I feel bad that I missed to read it!
    I could have rectified the DARN doctor then and there.

    It was during the July fiasco. We were all in a hurry and tensed up.

    Thanks for your update.
    Once this RFE is cleared, I am going to Sue that doctor for expenses!

    I feel sad that people dont do their jobs properly in this ADVANCED country.

    Last time around exactly the same time in 2006 CIR took off like crazy because of the tremendous backing of Senate Judiciary committee chairman Arlen Specter and Senate majority Leader Bill Frist (who actually gave a deadline for a the bill to be introduced to the senate floor, to speed it up) and president bush supporting it as well. In spite of all these it took the senate from Feb-march 2006 to around September 2006 to get it passed.

    With so many people changing jobs using AC21, not only IO, everyone in USCIS will be aware of it. Let's discuss something other interesting topic rather when 180days start/end.

    IOs will see your I-485, use some calculator/software to find out of 180days and then say pass/fail. End of the game.

    :) true, a LOT of people are going to be getting very familiar with AC-21/AP/EAD.

    Back when the July VB was first published, even the birth registrar in my hometown knew about the dates becoming current (when tons of parents all landed up in his office within a day or two, trying to get certificates for their children here :)

    Airline folks who used to see a few APs here and there, are now going to be seeing a lot more people APs.

    HR folks are going to be more familar with AC-21 and EAD...

    jokes apart - seriously this is a very exciting time, no one knows what will happen - yet everyone optimistic... which is a good sign.

    I just talked to our company lawyer and she said that they are seeing a lot of 485 approvals from the receipt dates from last week of july and a little before that ...

    When you said 'receipt-dates', were those the actual receipt dates or the erroneous notice dates that would appear in the online status page?

    HI Ivar,

    So in your case, did your older employer cancel or withdraw the I - 140 or it was active. Do you know if you can still port the priorty date if the I140 is withdrawn by the older employer. I have looked at most of the forums and haven't found a concrete answer to this question.

    The government's surprise offer, then abrupt reversal, of an opportunity for thousands of skilled foreign workers to obtain permanent residency in the U.S. highlights the problems of the overtaxed immigration system and the frenzy that results from a chance to apply for a green card.

    The scramble has put tens of thousands of workers and their families in limbo after many of them and their employers spent thousands of dollars in hopes of securing permanent residency. It may result in a class-action lawsuit against the government by frustrated applicants.

    The problem began on June 12 when the government seemed to open the door for thousands of foreign workers and their families to end the long wait to apply for a green card. That is when the State Department published a Visa Bulletin, which is a monthly notice closely watched by immigration attorneys and their clients because it determines who is eligible to file a green-card application the next month. The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.

    By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.


    The announcement was greeted with a mix of jubilation and panic by thousands of engineers, lab scientists and other high-skilled foreigners who had waited years for their place in line. Working ahead of a July 2 date for filing the application, intending immigrants rushed to gather documents, complete paperwork and obtain medical exams. Many of their dependents boarded planes for the U.S. to meet a requirement that all family members be present at the time of filing.

    "The bulletin created a land rush among legal immigrants desperate to finalize their green-card applications," said Steve Miller, a Seattle-based immigration attorney.

    Then, on July 2, the State Department issued an "update" that reversed the previous bulletin. It stated, effective immediately, there would be no further authorizations for employment-based cases. The U.S. Citizenship and Immigration Services, which processes the applications, said it would instead simply process existing applications to meet this year's quota. "We already had sufficient applications pending without new applicants...," a spokesman said.

    Mike Aytes, head of domestic operations for the USCIS, said all 147,141 employment-based green cards have now been issued for the year.

    In my opinion the USCIS and DOS will not get the August bulletin out in time. They have to figure out what to do with the July Fiasco first. They probably will delay this till they fix the July Fiasco.

    This is B*^#S*&^. Take this to an attorney and see if it’s legally valid. I suggest you not to sign as he puts every possible issues and make you responsible for that. I never come across any agreement like this. Normally they ask only for non-competent agreement.

    Why do you care if the client does not pay your employer and why you pay for the recovery. Simply Blood suckers. Tell him that you can not sign as he did not inform you about this agreement in advance and its not fair.

    It will be better if you use your in house staff for this. No need tp pay lawyer fees. Afterall its just a form. For straight forward cases, your staff can do all the documentation and I-129 filing.

    Actually %age vs salary depends on your billing multiple. The % age may work out better for employees if overtime is involved and employees get to charge overtime unless you are paying overtime to salaried employees as well.

    We should put end to Lou's lies. Let's be creative. We thought of the flower campaign, we all have higher degrees. There should be a way how to stop this guy. I think we are the only ones who can do it.
    By the way, Lou's ancestors came to USA also legally like us. What is the difference then? Really the only people who have the right to criticize the legal immigration to USA are the native Americans. I know that this argument would never success with the general public here but I believe it's true.

    I don't think that Lou's ancestors even had visas. They probably came on the Mayflower, went to Ellis island and were just allowed to live anywhere they chose. Atleast we came here with legal paperwork.

    One of the ways to stop him is to show him the actions of his own employer. If you read the petition, one of the key things is

    "From the records I obtained from USCIS/INS, Time Warner and its subsidiaries, your esteemed company who Lou Dobbs works for, hired at least 55 H1-B workers in 2006. Did your company hire these workers illegally ? Did your immigration law department check the validity of their visas ?

    I am sure these are very difficult questions to answer. There is a very popular English proverb "People who live in glass houses should not throw stones" and this very well applies to Time Warner Inc. Lou Dobbs crying foul about H1-B workers while his own employer hires tons of them. I have attached the details of the H1-B approvals for Time Warner Inc. and subsidiaries which I obtained from USCIS."

    I think this is very hard-hitting since it exposes the contradictions within Time Warner. Would Lou criticize his own employer for hiring H1-Bs ? I think he would be fired if he did.
