For the past 2 years there were so many RFEs and denials and no body knew what basis. But if they bring a regulation and follow that everybody can prepare ahead and no surprises. It is not a question of making profit. They have to make profit by following law and ethics and not by using loopholes. The regulations will make the companies to follow the rules of the game. If bodyshoppers follow the law and ethics without any fraud they will become reputed companies and the regulations will not destroy them. But their profit may go down but good for everyone. Inspite of insane rules annual cap is reached even unemployment is decade high. I would term protectionist if annual cap is reduced or they make restrictions such that h1b cap usage is so low. In India best persons are available and whatever restrictions they put Indian techies will overcome unless they block it completely. 65k H1b is attached to WTO and no way they can reduce that.

We all have different views and support different nut jobs standing in elections. The real sad part is to see some people who I dont think are really bad, openly in this discussion forum putting one community down. Supporting a arsonist, a murderer, a rapist and who has blood of 2000 innocent people on his hands as a "good" administrator is an insult to the intellegence we all claim to have. All communities/castes/religions have suffered enough in India already and not one religion or people can claim to be on morally high ground. We all have kept quiet through the darkest times in India. We should not anymore. Stop insulting the great men (Nehru, Gandhi and others) of our country. With out them and their work we all would be polishing the shoes of some firangi. We are young and we should think about pushing India forward, otherwise some of us with our twisted thinking (for sure we are all showing here) will be the next numb nuts standing in the elections in few years. Jai Hind!!!

An easier fix would be to accord a FINAL status for a pre-adjudicated application. USCIS should not/cannot issue an RFE on an application once it has been accorded a FINAL status. The new status FINAL should be visible online and a formal document should be issued to the applicant stating that the application has been accorded a FINAL status.
This is easier to get done rather than an iterim GC. Applicant gets the peace of mind and can go around buying houses, changing jobs etc whereas it is just a procedural change for USCIS.

and they can deport those who have broken the laws sooner ..can we have a campaign on this ? let us start with something small atleast ...

--Improve processing time to consume full quota allotted per fiscal year. If the cases are processed at snail pace, increasing quota to half a million visa doesn't mean squat to anybody. It will fall into another cycle of "waste visas & recapture visas"

If congress would have done it's job properly 60 years back, there was no need of nuclear deal now. The comment you made makes it pretty sure that congress was a failure since last 6 decades. The benefits of current nuclear deal will be in next 2 decades. So what poor people of India eat in next two decades? Will you tell them that don't worry...hang on for next 20 years. I tried to determine, on a separate thread, the wait times for EB-2 India, EB-3 ROW, and EB-3 India.
ANd I failed miserably. My models didn't make much sense. So I quit trying to come up with a reasonable, mathematical, estimate on the wait times.
The reason I was trying to determine wait times, was so that I could then convince people to join and contribute for IV. Basically, a media campaign, geared towards our base.
Anyway, the point of this post is this. I don't need reasonable, mathematical estimates. Maybe, all I need is a quote. A quote from someone knowledgeable, like Aman. Or some lawyers association. Some chimpanzee from USCIS. I don't know. Just something that says 'It will take 10-15 years for EB-3 India to get their greencards.' Or something like that for EB-3 ROW/EB-2 India.

I agree with you completely. I don't know what Infy and Wipro are doing with their money but TCS was filling Tata Motors and Tata Steel historically. Also buying companies like Land Rover and Jaguar while screwing their employees.

Looking at approval data, i see EB2-India approvals continuing with many recent approvals from Jan 2005. Leading me to believe that most of the application current will be approved by Nov 2009 and we should see +ve movement in EB2-India date to March 2005 in Dec 2009 Bulletin.
I'd be surprised to see that much movement before the Jan bulletin. If they do a quarterly spillover, I am hoping they'll move it to March at least.

Furiouspride's first encounter with the Amway posse!
Circa 2000: Furiouspride came to the US just like any other grad student on an Air India plane. He had $2000 safely tucked away into multiple travelers checks. The very next day that he arrived in the land of opportunities, he was whisked away to a high-profile business seminar. There were shiny Camry's, Corolla's and Accords everywhere. Any which way he saw, he saw powerful men dressed in full suits who only meant business. Awe-inspiring men who knew what they wanted. It felt like it was straight out of a Hollywood movie. Just that the actors were all Indian. "Maybe this was my calling. This is why I had arrived in America.", he thought. His 21 year-old FOB mind was clearly impressed by all the 'awesome'ness and new-found 'freeeedom' around! All of his friends were told that they would be instant millionaires if they joined this business. A business that was filled with nothing but pure awesomeness and unlimited income. Independent Business Owners in Ummrika the very second day was not a small feat after all! And all they had to do to become millionaires was pay a small fee of $100? It felt untrue. The pessimists in them said "Would this possibly work? How could it be so easy?" When they heard four more hours of tape on the way back, they were completely convinced. This was the best idea ever since sliced bread; just a little better! The math totally added up.
Fast forward four months: The Fall semester was almost over and the American dream was all blurry by now. All of the IBOs had gone bankrupt and the prospects of returning to our holy motherland seemed bigger and brighter. Those past four months had flown by in buying the best toothpastes and toilet papers ever known to mankind while we went to bed empty stomach. Oh how we wished Quixtar gave us PVs for buying lunch too. Then the time for the dreaded phone call came. The millions weren't coming, so arrangements had to be made for a few thousands at least. The $2500 American Express card obviously wasn't good enough for the Spring. Yours truly explained the situation to his old man and innocently mentioned Quixtar in passing. Hell broke loose. It was the daddy's turn to be furious; for his son had fallen trap to an MLM scheme of all things in US of A. Yours truly had brought disgrace to the family.
A few weeks later, the cashiers checks arrived. After all, our American dream was still alive, for a couple more months at least. We had all learned our lessons. It was time to chase real dreams and bring meaning to our lives. That very night, all the IBOs got together and unanimously arrived at a decision. It was time to retire!

In my opinion MMS may be a nice person and may be a good economist, but it wasn't him who was running the govt. and it will not be him if he comes back again. It is a very common practice in India, a chemist will run a chemist shop but the License is in somebody else's name. Here also same thing happened, you saw Manmohan Singh on PM's chair, but it was somebody else who was running the show, and it is deception & dishonesty to your voters. I always see a "Culprit" in his eyes, which is either hiding something or is guilty. Observe him on TV, he's mostly not making too much eye contact, he know he is guilty of deception....
He also headed one of the most corrupt & criminal cabinets in the history of India. People like Taslimuddin, Shibu Soren , Jagdish Tytler, Lalu had several criminal cases against them. On the contary you may not personally Like LK Advani, It's not just him who's going to rule the country if he comes to power. It'll be the whole cabinet, most what was during Vajpayee govt. which was much cleaner & much more agressive on developmental issues, they worked on certain agendas, lot of places where you see growth, were actually the good work done by the NDA govt. You may praise Laloo for all the Railway turn around, but the reality is the foundation was layed by then Railway Minister "Nitish Kumar", AI/AI became profitable under "Rajiv Pratap Rudy" . There were people like "Suresh Prabhu", "Yashwant Sinha", "Arun Shourie", all of them did tremendous Jobs in their cabinet. Yes...only that puupet brought those changes and reforms.
