    I would urge you to change the title as most of your problems are due to your own decisions and not due to agency.


    This may not be true. This is the problem being faced by many singles. Ofcourse those singles are postponing their plans just because of USCIS policies which in the case of singles is ridiculous. There is no meaning to make a person wait for 5-10 years to get one's spouse just because he applied for a Green Card. I see various kinds of visas for the spouses in other categories like H1 has H4
    L1 has L2/L4 ( I dont know what that is)
    and so on so forth..

    but for a spouse of AOS? nothing.


    All the crap of going on H1 are ridiculous. At the first place one has to get a sponsor for H1 and then there are all those issues out of being H1 with the employer and USCIS. There is no benefit of being on AOS. They cannot use EAD. They cannot start companies freely, etc because they are supposed to be on H1 or L1 etc.

    Hi Dinesh,

    I am a physician myself who served j1 waiver and on AOS from 7/07. My son is a going to be a senior in High School this year. Why did you have a problem with state college apps on AOS/EAD?

    Most of the state colleges, (In my case, none of the state colleges), including under-grad and medical schools, will accept application, if you do not have GC/ US citizenship. I tried, wrote letters, but of no use.
    You can apply and get admission in private college, which of course cost much more.
    Also, we were not able to take any federal loans.

    If you have an approved I-140 and the job description matches that of your Labor, you shouldn't have any issues. The job title shouldn't matter either, it's all in the description/role/responsibilities and the technology. If the technology/tool changes then it's an issue because the Labor you have tells that there is a shortage of people in that area.

    How much does technology come into picture? I changed jobs using AC21 and am on EAD, my new job utilizes only 50% of the skills from previous job and am getting trained in new technologies in the new job. I am not sure if the new employer will list all technologies mentioned in the labor, but will definitely list all those that are being used. Any comments?

    Since the promotion is within the same field of expertise, within same employer, and same as LC job, I see no problem accepting the promotion. The intention of AC21 is for situations like this, that the beneficiary will not be stucked in one company or in one position.

    That is the very ideal situation of using AC21.

    Factors you forgot to consider:

    1. EB1 and EB2 applicants this July and Aug. ate up the numbers that were made available to EB3 last June 2007.

    2. EB3 Visa number is just very few, around 800 per month per PICM country.

    Also how uscis can crack down on %age system.

    Once H1Bs enter US, its hard to track and crack down on a % age system. So they are trying to crack down at the visa stamping stage.

    Finally I too received my FP notices, however I am scheduled to attend ASC in my attorney's location, I called customer service and now I need to wait till ASC finds an open spot to schedule FP at my location.

    When I joined this forum it was to look advice on my case and to offer help when I could. No one has ever taken the time to explain what the objectives of the Core are. What I see alot of are #1 asking people to contribute and #2 members complaining about people asking their questions in the wrong area or opening too many threads. Someone needs to explain fully what Core is doing and list ways for the members to help. I would love to help if I can. Unfortunately I don't have a lot to offer financially being that my husband and I are living off one income. I wish I could go to the rally but I cant afford to do that either. There must be some way that I can help- stuffing envelopes or something- anything. But what I would love to see is an explanation of what it is the Core is trying to accomplish and a set of guidelines for posting if possible because I am so sick and tired of seeing "please close this thread"

    Being an eternal optimist, I am still hanging in there with a hope that things will change after the next Presidential elections.

    Hopefully all the buzz surrounding alterantive energy will result in some sizeable investment by the government in technology if we have a democrat as a President. But if the status quo continues, they will be spending their money in building meuseums in kansas refuting the theroy of evolution and 'Intelligent Design' and other such right-wing manusha!

    My point is, it aint over till the fat lady sings, and thank god Lou Dobbs can't sing (I hope) :p

    What I know about America that if you don't have money, hospitals are supposed to take care, if you have money, hospital will squeeze every penny.

    Once I spent over a month trying to find solution: Could not get: for a female it seems to be mandatory having maternity insurance otherwise, after pregnancy, no one insures.

    I thinks people lack information in this context, so you are not getting responses.

    Sorry to say, but sending mails of unresolved issues to NY Consulate is a waste of time.
    I have sent them mails every week for 2 month (yes, I did that religiously) thinking that I would clog up their system, but I guess they had the last laugh! :-)
