I don't think it is true. My lawyer said using AP will not invalidate H1B.
I have seen many people saying they came through AP and extended H1B , some even 3 times.
Anyway, I am travelling outside and planning to use my AP while coming back. I will post a message if I come through H1B

What takes priority in life? Time with family or getting stuck in the GC mill.
I find it disheartening that a senior member like you would advice someone on foregoing their pleasure trip and donating to IV. Would you be willing to cancel all your pleasure trips/family outings to donate money to IV? If you do, i feel sorry for your family.
Please donate that extra money meant for leisure to IV instead going to Bahama this year.

I agree that car depreciates as soon as you drive out the showroom but what I believe is that if you can afford to buy your dream car and plan to keep it for atleast 7-10 years go for it. Life is short, if you can enjoy luxury and at the same time know your limits don't restrict yourself and drive used cars all your life.
As far as your home mortage is concerned, talk to your banker and negotiate favorable terms. If you plan to live in that city depending on job market, don't worry about home prices. I hope you did not buy that home to make money overnite but to enjoy the luxury of living and owing a home. In any case, don't plan to put money on home, better to save or invest where it makes more sense like stocks, CD's or land/home in India.

If people who got their AP from NSC could just menion how long it took for them to receive ap document it would be statistical and we can there upon make some judgements !!

Also there could be election year effect because most of the resources at NSC are directed to work on Naturalization cases but why to single out just EB3 cases ? Didn't they have sufficient approved EB2 140 at hand to give them a 485 ?
I never imagined being stuck for 15 months for a 140 - at the most 9-12 months was my worst case analysis. My plans of porting from Eb3 to Eb2 got ruined , job change AC21 all preparations went haywire. I've already renewed EAD card once but can't use it confidently unless this Eb3 140 is approved .
How come EB3 at TSC is going smoothly - didn't they get the directive like NSC to stop working on EB3 140 's ?

dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.
I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.

YES you can convert into EB2. If I were you and get some offer to convert into Eb2 I would do it. Eb3 is not going to move until Eb2 will become C. and chances are that Eb2 India may become C in next 2 years if same rate labor get approve. If you go on convert route. lets assume that labor takes 18 months and I 140 takes 6 months. that is 24 month it self. Now after 2 years your case can be current but if you stick on Eb3 then after 2 years it will start from 2002. So if your PD is in 2004 then you may need another 2-3 years for that.
So bottom line is you need to find some one who has job opening in Eb2 and ready to file for you. Which is very rare opportunity in given environment. almost like a winning a lottery with 10k prize.

I didnt get notice yet .I read on these posts that we have only 30 days to file MTR.What if i dont get notice till that time .Is it appropraiate that my employer of his attorney contact CIS and let them know that we didnt recieve denail yet and that way have a proof and buy some time .

Hello Everybody,
Due to budget restrictions, I may be getting laid off from my company soon. I have filed for I-485 and have received EAD. I am currently on H1B. I have a citizen friend who runs his own company. He has no employees. He does pretty much all work by him self or get it done by hiring outsouced help whenever needed. He has a legitimate company - but he does not have big revenue (May be 100K/ year). Would it be okay if I join his company on EAD to get my GC going or should I look for a firm that employs lot of people and has sizable revenues. What (if any) are any risks?

Some scenarios to consider
1. If 140 is approved and its been 6 months since date of 485 application and your company who sponsored is not revoking 140, then ability to pay might not matter and you don't care since you can use AC21
2. If 140 is approved and it has not been 6 months since 485 application date and you are on good terms with and your employer is not going to revoke your 140 , take an unpaid vacation to fill the 6 months gap if you can, then you are still safe to use AC21.
3. If your 140 is not approved but you have passed the 180 days litmus test and you use AC21 to move to another employer then the ability to pay might come in to picture if any RFE is done by USCIS.
4. If 140 is not approved and you have not passed 180 days its a variation of the 2nd case and if you can pull it off you can use AC21 and work elsewhere later.
there might be other scenarios but consider each of them carefully before making the decision. While it might seem a simple decision having come so far in your journey you don't want to make as wrong decision only to rue it.

Your situation is slightly different than many I have come across. If your qualifications, research work, project etc have unique qualities, then you may still have a fighting chance. But you may have to do a lot of homework: find out NIW holders in your / related engg field, ask a few lawyers: do not believe right away if somebody promises they could, try to enroll in as many professional associations as possible, enlarge your skill portfolio etc.
BTW, is any degree of you from US?

sanjay , prinive - believe me folks, a lot of pushing is needed, not everyone are proactive like you and me. I guess you are in the tri state chapter - you can see for yourself, how many members are active and how many are not. I am also just like you all - the core trusts me to be a chapter lead and I do want to do what best I can - I will be very happy if more and more people come forward and carry things forward.

dvb - Which airport/office did you get this done at? Is there a link to look up? My firm has applied for I-94 extension but it is taking upwards of 6 months for approval so if this can be fixed via a trip to the CBP office I would like to try to do it. Thanks for your input.
