I disagree with waitingnwaiting. I had got 221G about 5 years back. I work for one of the fortune 500 company and had all the paperwork sent by our company's professional law firm. US embassy randomly picks application for processing. It took abt a month to get the approval. As long as the application/documentation is correct and there is nothing to worry.
I would suggest to spend more relaxed time with family or going out which we rarely get with 3-4 weeks vacation.
It does not matter if you work for fortune 500. There could still be fraud or suspecion. Read Indian IT cos face US visa fraud woes - Corporate News - livemint.com (http://www.livemint.com/2011/04/11164715/indian-it-cos-face-us-visa-fra.html)

"post office monthly income scheme" - that is good info i will definitely check on that.
In short as long as a person is on H1B he is no better than his indian counter part working in a multinational or maybe he is worse, atleast person in india is close to family ,spouse can work anywhere etc etc.
So the sooner the person gets GC the faster he has made his efforts worthwile - otherwise he will find his story similar to what sai posted in first article of this thread.

When we use AC-21 and change jobs, and when we travel out of the country on using AP while coming back , at the POE if the immigration officer asks if you are working for the same employer, and you say no, then what are the risks involved?

According to an IO i talked to recently the background check has 6 stages which includes name check.
Sometimes for verifying the names and address they send it to local USCIS office for verification.
So it may not be for interview. But you could be in the last stages of the background check and will be approved soon IF the dates are current for your PD.

I had my GC approved out of line last year in aug [was current (pd march 2006), but processing time wasn't current for texas at that time]. EADs for both me and my spouse had been approved like 1 week before this happened. Hers was for 2 yrs and mine for 1 yr. What happens to her application if I loose my job or leave my job ? I am the primary.

Hello Folks,
I am on H1-B since Aug2009 and last year I transferred around 40K USD to parents. All these transfers were spread over the year in the denominations of 5K per transaction.(As and when I saved money).
My question is, do I have to pay taxes in US on this money transferred to India. I know that my parents don't have to but I am not sure about myself.
Any pointers in this regard will be highly appreciated. Thanks,

My LCA has Computer Software Engineer as job title.I have 5 years of Experience as Oracle functional consultant.Currently I'm working as Oracle consultant.My 140 is approved and got my EAD card.In jan 2008 it will be 180 days of filing 485.I want to change my career towards IT Sales.
I have an offer from an American Staffing company as a Technical Recruiter.The job responsibilities include hiring Software Engineers.But the job title is different from my LCA.I want to join this company using EAD in jan 2008 and apply AC 21.Today I have checked with my Lawyer this is what she says"
In instances such as this, when we send the letter to the USCIS regarding AC21, we include the following details with reference to the job title. � Although the job title differs, the job duties are substantially the same. The title used by the company is their internal designation for this position."
She says that i will be able to work as Technical Recruiter using EAD.Any one can suggest me on this?I have very little knowledge about AC 21 and how it works

Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.
In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.
As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).
Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)
And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.
*** Also, to the previous poster (nojoke) who said that big companies usually hold off on perms, are you suggesting that I have a better chance at a smaller company then?
UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

You do not need a lawyer. Just make sure CIS has your correct mailing address and keep watching your cases regularly for RFEs.
In the event of an RFE, you can respond on your own most of the times. If you think it requires a complex response or if you are not confident, you can hire a lawyer at that point to respond to that RFE.
I would even say handling your case on your own is safer as I know some cases where the lawyer goofed up by not responding to RFEs. The applicant was not even watching his case status as he had left everything to the attorney and he had no idea about the RFE.
It is also not necessary to inform CIS about your job change unless there is a possibility that your previous employer may revoke your 140.

Ok, just back from the doc. Took around 2 hours . Charges - $340 for adults (Includes Physical, Blood test - HIV, Hepatitis, Syphylis, Tetanus shot), doesn't include X-ray ($80).
Good thing about this place is, they do X ray, Blood test inhouse. SO you don't have to go out (means another appointment).
Right now they are doing extended hours, Dr.Anand Patel told me that appointments are full till July 4. But they do take walk in.
Go on a weekday at working hour.

I am the July 2nd filer as well. It took me quite some time to figure out the case numbers on back of the checks. All start with "WAC" means California Servcie Center. After I entered my cases number each of each (total 6 of them, 3 for my wife and 3 for me). On Sept 13. there was LUD on all of cases. but only the contents differences were appeared on two 485 cases. It said that "we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our LINCOLN, NE location for processing because they now have jurisdiction over the case.".
That is what I got so far. May God with us all!!!

I can back that one up. We received audit August 13 for 2005. Had to prove we are married & kids live with us. When called and spoke to officer she said it was an "INS flag"! Honest to God that is what she said. She then asked if we had applied in the last couple of months for 485's??? She knew all about the USCIS system and said one way of telling is if you file jointly at the same address each year then why would IRS be asking for proof of marriage and kids living there etc. She was great and confirmed they had received all paperwork. Had to resend due to liquid being spilled on copies.... Even H&R Block said it was INS based.
Then we get 4 out of 5 EAD's approved, but spouse gets RFE and it is proof of name change please resubmit marriage certificate!
