There were speculations that AUG bulletin will be released at 1 AM EST , then 2AM EST , then 10 AM ESt , then 11 AM EST....
None of the speculations came out True - Anyone has any idea when AUG Bulletin will actually come out ?
That's the key word here. ....I don't believe in "reliable" sources. I need to see the outcome.

After all these days it appears many people are still not clear about the difference between 485 processing times and priority date movement.
The two are completely different entities. When USCIS talks of backlogs they do not mean backlogs due to retrogression (PD unavailability). They are talking about the number of applications they received and the time it takes for them to process them.
When USCIS says it will clear the backlog by 2010, it means applications filed after that time will be processed in a timely manner (in less than 6 months). It does not mean that all the 485s before that time wil be approved. It only means these 485s will be processed and thrown into a cold sorage bin to be looked at again whenever the PD becomes available.
When retrogression started in 2005, EB2 India jumped forward by 6 months each visa bulletin. The reason was namecheck delays combined with the problem of Labors with Old PDd languishing in BECs. As both these problems have been eliminated now and also many EB3 filers from that time are switching over to EB2, it is highly unlikely that one will see wide movement in India EB2.

I would wait for one or two months for the next FY visa bulletins and decide on starting my new labour in EB2.

If your current/future job is eligible for EB-2, you have the qualifications to meet the job requirement and your employer is willing to start EB-2 process, I would get the process started as soon as possible. With your current EB-3 PD, I dont see anything changing in the next 1 to 2 months. You might as well start it now so you can complete the PERM documentation and advertising phase and file PERM in 2-3 months duration instead of waiting. Thats my 2 cents.

Hmmmm! if i understand correctly 7%- 8% interest is given on FIXED deposit (of Rs 50 lakhs or more ) for 5 or more years i.e person gets money after 5 years. How will the person meet expenses for first 5 years ?

I searched for my LC case in one of the DBs in this website. I could not find it, though there were lots of other cases from my employer. I have the case number and approval notice so I am sure about genuinity of my case. Is this possible that some of the cases might go missing here ?

Greencard and H-1B expenses should be paid by the employer. Anything else is illegal. I am requesting admins to close this thread.
I think H1B expenses must be paid by employer. However, GC fees need not be... as GC is an optional element (employer is not required to process GC for every H1B employee).

Hi to all,
MY I 485 RD is August 14, 2007, 180 days rule will end on 10 Feb 2008.
I am planning to use AC21 on Jan 20th itself with three weeks vacation notice to current GC filing employer to go for Contract to Hire job.
Is it safe to do?
I do maintain good relationship with current employer.
But not sure, what will be his reaction after three vacation notice ends and he comes to know I have switched job.
Also my LC as Programmer Analyst, but the new job would be Database Administrator.
Is this will be issue?
Could you advise on these questions?

Keep in mind that employer can revoke I-140 before your 180 days are up. If its just a question of a few weeks, why are you taking a chance ?

Glad to see there is some hope in future for EB3 I.
But we shouldn't rest on these hopes. If we can get at-least couple of items on IV agenda (recapture , STEM) passed we should all be greened for sure.

How about the reverse change of status ? A person currently on H1 visa decides to resign from company & wishes to go on H4 (spouse has H1B extension applied for). What is the time frame in which the H4 has to be filed for .... with respect to resignation .... before resigning or after resigning .... is so within how many days of resigning. How does this person know if he/she is in status as H4 approval might take months .... Will the spouse's H1B extension receipt notice be enough as the approval might take a while.

Most of the problems will be resolved after making legislation on the 2 options which can be easily done.
1. Remove 7% per country cap and come with more scientific number based on the H1B approvals since 2000 to get more weight to India, China, Philippines and Mexico.
2. Throw the unused numbers wide open at the end of Fiscal year based on Priority Dates. No country cap in this case.
3. Keep one Visa number per family. This one is tough to get pass through House and Senate.
The first 2 options are more feasible and can be done quietly without much political and public confrontation.
